Has Apple's iPhone wipeout update crossed the line and tossed netware into the
legal thicket which the RW courts will use to control software and put limits on development and the net.

IMO, they crossed the line. Their update should have only applied to the original version of the iPhone software and not have scanned the iPhone for altered or additions to the iPhone.

Poor practices lead to bad law.

1. This is one of those deals that I so much wonder about. Once you purchase
something, is it not yours to do with what you want?

It strikes me the same as if you're off work, is not your life your own and no one else's damn business.

4. There has been an on going battle between open source and private software
which you sign away your right of ownership when you sign their agreement when you download the software. I agree they need some protection to their labor and their right to make a buck. But if I do not offer for sale or compete with them, and if I improve or modify something for personal use I don't believe its their business.

This will go to court and IMO is the opening that the RW will use to control the net.

..the heavy-handed game they have to because they made a deal with the devil.

AT&T SUCKS here in Dallas, they didn't use to but once they switched the network to GSM, call quality and dropped calls, everything went to hell.

I wouldn't buy any phone tied to a crappy provider.

3. Windows Vista and its updates has done the same
in my view this is a corporate culture that assumes the product is theirs, even when you paid for it

Where they may be able to do whatever they want to do is in the fact that you buy a licence, and essentially the product is not yours

Again, this is corporate and is not limited to software

OpenMoko is still in alpha, but their wiki claims:
"You can install any OpenMoko software over the whole range of supported phones, and if you upgrade your phone, you don't lose that software. Bugs fixed on any phone are fixed on all."

Open Source...


I think iPhone just stabbed themselves hard in their customers' backs.

6. I thought it was funny when I saw that...a game where smart guys break the
code and Apple fights back. Now round 3. I'll bet the smart guys will do something interesting next. I updated my iPhone yesterday. No problems.
