Personally, I don't think * would gain anything politically if Congress rejects the gay marriage amendment (we're close to getting enough votes to kill it in the Senate).

that he'll throw a tantrum. The media will cover it for a few days, and since there'll be nothing else to really cover on the topic, it'll go away in terms of electoral politics.
In terms of court cases, we'll see a blip now and then related to CA & MA, and perhaps other states if they get pulled into the fight.

The amendment won't even be introduced until AFTER the election.
It's being done for political purposes. They have no intention of doing this quickly. They want to draw it out in order to motivate their rabidly intolerant base. If they finish before the election, then the rabid right will see no reason to go vote for him
