Can Rush be sued for violating the civil rights of Democrats? |
|
Is there a lawyer in the house?
This morning Thom Hartmann was going over the growing mass of evidence that Rush Limbaugh's self-proclaimed "operation chaos" has had a real and detrimental impact upon our Democratic Party. One county in Ohio is going to pursue criminal charges against Republican who voted in our primary for the purpose of disrupting it. But the intent of a voter seems impossible to prove. And in any case, the individual voters aren't the meat of this issue. Rush is.
Rush, as we all know, symbolizes the Right Wing more fully than any other personality. If we can put him on the ropes - DURING this campaign - we could use that case to demonstrate to independents that the Right as a whole has no commitment to basic principles of fairness and democracy.
So, can Rush be sued in a class action for violating the civil rights of Democratic voters?

2. I don't think that's a winning case |

conspiracy to commit voter fraud (or perjury) or aiding and abetting voter fraud (or perjury) would be a better theory.

5. Can't you be sued for advocating action by others that does harm? |
|
There are lots of limits to free speech - yelling "fire" in a crowded theater and all.

4. He could conceivably be prosecuted for accessory to election fraud. |
|
He openly asked listeners to his radio show to fraudulently change their registration to Democrat so they could disrupt Democratic primaries, after signing an affirmation that they would support the principles of the Democratic party.

Registration by party MUST be deadlined so that mischief-makers cannot f'up elections.. Primaries determine the candidates, and PARTY members should do that. Independents or "switchers" can either decide early, or they can wait until the general election..
Or maybe they could have a "beauty pageant/non-counting" ballot for independents and switchers..
