In 2005, DeLay moved to dismiss the charges against him. The lower court dismissed one count, conspiracy to violate election law, but let stand two counts alleging money laundering and conspiracy to commit money laundering. That decision was upheld on appeal but the appellate process wasn't concluded until June 2007. DeLay is now awaiting trial on the remaining charges.
