Couldn't Hillary sue McCain for using her image and voice in his ads... |
|
...to make it appear that she supports his political viewpoint and ideology?
In his latest ad, the Hillary footage doesn't specifically say "I reject Barack Obama and support John McCain," but a good lawyer could argue that this is the implication.

1. I think if you are an elected public figure, use of your image and soundbytes are open for use. |
|
Otherwise politicians would not be able to use even their opponent's image in any ads either.

3. Plus, this probably counts as fair use as it's being used for commentary, albeit false commentary. |

4. No. (Could Bush sue DUers for all the photo-shopped images of him?) |

In genetic terms he probably isn't really a chimpanzee.
More pointedly, Using McCain's 100 years comment in ads would be the same thing. He didn't mean exactly what it sounded like but people are perfectly free to impose their own interpretation on his comments as seen from a point of view. Move On is not legally obliged to hew to McCain's stated "official" interpretation of his remarks any more that McCain is obliged to reflect the full range of Hillary's attitudes. Everyone is free to their own interpretations... as free as the speaker is to say something in the first place.

5. at the very least she should demand he not run it. I think the fact she has not |
|
is an embarrassment to her. The news is saying she is angry at not being chosen, but honestly she has barely put the effort forward to get a dem in the white house. Her pronouncement that she has done more than anyone in her position is a joke. Primary losers traditionally join in to get the winner election. It makes her look like she cares more about herself than having a Dem in the white house. I for one will no longer tread lightly on her feelings if her actions have a part in electing McCain. He has been using her to divide Dems with some success. Can someone point to any action she has taken that says she has a problem with this?

7. Don't be petty. I obviously meant elected not election. Is my proper use of diction |
|
really important here. I worked all week and I'm tired. That being said, yeah Dean joined in to elect Kerry. Hillary has spent all her time talking about her voters, as if she controls them. The truth is, as soon as she lost many of them became Obama voters and she seems to spend her time trying to convince them to be skeptical rather than supportive. I have no sympathy for her.

11. NOBODY FREELANCES!!!! Why is this so hard to grasp? |
|
Nobody freelances in a presidential election.
If the campaign asked Hillary to respond to the ad she would respond.
They don't want her to because they DO NOT WANT TO TOP POLITICAL NEWS STORY OF THE DAY TO BE HILLARY.
Jesus... this is how campaigns work. Hillary will not say a word without coordinating with the campaign, THEY control the message.
Every damn day on DU a bunch of people bitch about what Hillary isn't doing without recognizing that the Obama campaign does not want her doing ANYTHING right now.
If you want Hillary to say something the write the Obama campaign about it!

but she wont and she will have a whole night devoted to her and women's rights. It will be a happy time thank her supporters and to celebrate as we get ready to elect Obama our president.

13. seriously, you are off-base |
|
speaking out about it just gets it more attention. as others have pointed out, Hillary would be stepping on the campaign's message if she starts freelancing comments at this point.
