Question about the USSC ruling and legal standing

They said that a private party, a non-governmental entity did have standing to bring the lawsuit under HAVA. The court did not rule on the merits of the case.

Democrats control the Ohio government, but could the US Justice Department file a suit to get around the question of standing?
