AMENDMENT 1.

Congress shall make such laws as necessary to guarantee the freedom of a Real American to lie and slander indiscriminately without fear of the mainstream media offering critiques of his or her behavior that may have the effect of "convincing enough voters that that is negative campaigning."

Palin told WMAL-AM that her criticism of Obama's associations, like those with 1960s radical Bill Ayers and the Rev. Jeremiah Wright, should not be considered negative attacks. Rather, for reporters or columnists to suggest that it is going negative may constitute an attack that threatens a candidate's free speech rights under the Constitution, Palin said.

"If convince enough voters that that is negative campaigning, for me to call Barack Obama out on his associations," Palin told host Chris Plante, "then I don't know what the future of our country would be in terms of First Amendment rights and our ability to ask questions without fear of attacks by the mainstream media."

9. My neighbor isn't running for president
It is central to our political system that short of a credible threat of violence anyone can say anything about politicians.

(Countless hundreds of DUers would be in court right now if that were not the case.)

Palin is not saying that the First Amendment gives her the right to smear Obama. (which it does)

She is saying that the First Amendment gives her to right to slander Obama without anyone else being allowed to complain about it
