The Anti-Scalia...
What are the chances that we could actually see the Anti-Scalia, Laurence Tribe nominated to the Supreme Court. He was one of Barack's favorite law professors at Harvard. He is a brilliant liberal legal mind with unassailable credentials. He would be a tremendous intellectual asset to the court for years to come.

6. A lawyer friend of mine both mentioned this...
...almost simultaneously when we realized that Obama had won. We were both at an Obama victory party last night. We both saw it as a very real possibility and were joyful at the prospect.

The great thing about Tribe is that he has the intellectual heft to battle it out with the likes of Scalia. In fact, I could see Scalia welcoming such a challenge. Whatever you think about Scalia, he is passionate about the law and the Constitution. He loves the intellectual challenge of debate.

I would pay money to see Scalia and Tribe debate. It would be like attending a masters seminar on Constitutional law.

11. If he loves it where does he get the idea is allows for inroads on
its provisions due to fear, say, fear of terrorism. If I recall right, one of his dissents basically justifies some of Dubya's power grabbing with necessity because of terrorism.

Seriously, that's the single most important test for any potential SCOTUS appoinment now. Bush set that bar with his two appointments.

Prof. Tribe is 67 and I want to see O appoint people in their 50s and 40s. Had Tribe for advanced Con Law. He's as nice as he is smart.
