1. I know the loss was disheartening, but the fight is not over,
and eventually good will prevail.

3. Can't argue with that
I think the passing of Prop 8 shows our initiative system needs a very serious overhaul.

13. Bingo.
First, the Constitution would have to be amended to okay discrimination.

4. I couldn't believe it and I'm ashamed of the voters in my state.
Of course, the pro-8 ads were well financed and really, really misleading.

They said that gay marriage would HAVE TO be taught in all California schools and that everyone would HAVE TO accept gay marriage.

just disgusting.

16. If you'd heard the ads, you'd think that you'd have to go marry someone of the same sex.
The ads really were well designed to mislead.

18. YES on 8 ad: "Acceptance of Gay Marriage in now MANDATORY!"
It almost made me think I'd have to go get a boyfriend!!!

And SF Mayor Gavin Newsom's words were not helpful, (I've met him, but what plays in the city doesn't play everywhere in CA)

29. Most of the nasty ads i saw said saying no to Prop 8 meant teaching kids how to be gay in schools.
It was so ridiculous and that fear tactic worked! I feel embarrassed for my fellow California's...they are so so stupid.

if only by a small margin. Those others passing were foregone conclusions.

14. That's right, it's a matter for Cal St Constitution: Fair Treatment...
The State Consti does not establish unfair treatment:

Pelosi Statement on California State Supreme Court Ruling on Gay Marriage

Speaker Nancy Pelosi released the following statement in reaction to the California Supreme Court's decision today to strike the state ban on gay marriage:

"I welcome the California Supreme Court's historic decision. I have long fought against discrimination and believe that the State Constitution provides for equal treatment for all of California's citizens and families, which today's decision recognizes.

"I commend the plaintiffs from San Francisco for their courage and commitment. I encourage California citizens to respect the Court's decision, and I continue to strongly oppose any ballot measure that would write discrimination into the State Constitution.

"Today is a significant milestone for which all Californians can take pride."

It *is* time for cooler heads to prevail: candles lit! Several of our gay friends are very upset, but Cali is full of fighters and we are going forward

19. I don't see how this is any different than Prop 187
Neither of these propositions should have ever seen a ballot. I'm ashamed of the state for ever letting this come to a vote, let alone the bigoted voters who gave it their hate/fear filled vote. This is a modern world. There is no more room for ignorance.

From Wiki-

California Proposition 187 was a 1994 ballot initiative designed to deny illegal immigrants social services, health care, and public education.

It passed with 58.8% of the vote,<1> but was overturned by a federal court.

I have been fighting most of the day with TWO conservative male attys about that friggin' POS! They could not articulate any valid reason for that bullshit const amendment. Their best argument? TRA - FUCKING - DITION!!! Yep...so I asked then if we should then go back to the TRADITION that blacks and whites could not marry??? Oh, they said THAT was different cuz it was JUST race and not the same sex! OMFG!!!!

Funny thing...the lady and the man at the next table to us in the restaurant ~~ who I could see and the two assholes could not ~~ were giving me the "thumbs up" sign as I dug into these two jerks!

That proposition is unconstitutional.

Equal protection clause
No ex post facto laws clause
Full faith and credit clause

31. I agree with all of this, but I cannot figure one part...
...how the hell has DOMA not been declared unConst by the SCOTUS?

You know, if a straight couple is married in Ohio, moves to California, and gets a divorce, then one of them moves to Florida, Florida recognizes the Ohio marriage and the California divorce. Why in the hell is DOMA then allowed and it applies ONLY to gay marriages to make the rules that a state does not have to recognize a gay marriage from another state which was legal in that other state.

That just gets to me ~~ for example: Calif has not recognized common law marriages for YEARS. However, if someone has a valid common law marriage in another state and that couple moves to Calif, that Male-Female common law marriage is recognized. But under DOMA, Calif would have the right to NOT recognize a marriage between a gays that was legal in the state were it was done.

I am just soooooooo sick of gay relationships being singled out for unequal and discriminatory treatment. This is just bullshit to the max.

JMHO

32. I don't see how they can go backward now.
How can they deny some people the same rights that others already have? How can they allow some gay marriages to stand and tell everyone else no way. I predict the whole thing will be declared unconstitutional.
