4. 50/50 I'd say.
I've heard compelling arguments that it would. If all four justices in the marriage case are as strong as the opinion is, they would find marriage rights integral to equal protection.

6. Just a dippity-doo-dah stupid question...
If there is a case to be made for overturning the decision, how did this proposition get on the ballot in the first place? Pardon my ignorance, but I am a little too unfamiliar with how California decides to put these on the ballot.

7. Can the State courts do that? Won't this have to go to Federal court now
for a 14th Amendment claim? This would invalidate all state constitutional bans and set up a huge battle for 2010 and 2012. We better get ready!
