My wet dream Supreme Court after two Obama terms.
In my dream, Scalia, Stevens, Ginsberg, Breyer, and Kennedy all either croak or retire. Obama gets to appoint 5 justices, creating a new progressive majority on the court.

The surviving conservative bloc:

John G. Roberts, Jr. (born 1955)
Samuel Alito (born 1950)
Clarence Thomas (born 1949)

The emergent progressive bloc:

Jennifer Granholm (born 1959)
Deval Patrick (born 1956)
Sonia Sotomayor (born 1954)
Harold Hongju Koh (born 1954)
Kim McLane Wardlaw (born 1954)

The surviving swing vote:

David Souter (born 1939)

Obama's two terms see the appointment of 3 new female justices (Sotomayor, Granholm, and Wardlaw), the first Hispanic justice (Sotomayor), and the first Asian-American justice (Koh).

1. Why in the hell would you want Ginsburg and Stevens to croak?
We want Thomas, Roberts and Alito to croak. Not to mention Scalia.

10. He does?
Holy cow, I just Googled it.

I don't remember this from July of last year.

Oh, well, a life appointment is a life appointment. He may end up like Stephen Hawking, but he'll still be dangerous to civil liberties.

6. I hear Souter might step down, and I think Scalia will hang on
Scalia is so much a partisan that he'll stay there till his dying day if the president is a Democrat.

I doubt his health is that great.

14. Remember, Evil seems to live forever on the Supreme Court. That undead Rhenquist was 107 years old
and riddled with lymphoma and he still held on! Shrub was "smart" when he picked young Evil for the court.

16. In response to other posters questioning why the 5 should be gone.
Really, I think it would be wise if any that are of liberal leaning to retire as soon as possible. Thereby, be replaced by younger justices resulting in a longer period of impact.

They can retire at 65 with full pay.

Few die while on the court.

Personally, I would prefer that any new appointments have been born in 1955 or later.

If enough are replaced it might cause the other 3 to resign to seek employment with higher pay.

18. I believe we should change SCOTUS appointments to a fixed time.
I think 25 year terms would be a good idea. This would allow their term to last long after the President who made the appointment. It would also end the game of picking the youngest possible person so they can serve forever. It pisses me off that Roberts will be Cheif Justice for most of my adult life just because he was appointed in his 40's. What kind of crazy shit is that? Plus, it removes the guessing game on when someone will step down.

19. That just games the system to find people that will stay for all 25 years
Edited on Tue Nov-18-08 01:11 AM by Hippo_Tron
And chances are that somebody who is 50 is going to be a lot more likely to stay for 25 years than someone who is 60.

I've always thought the Justices should pick their own Chief that rotates on a four year term.

20. Then the 45th President can appoint Obama to replace Thomas.
So far, only William Howard Taft served on the Court after being President. The appointment of Obama can correct that oversight.
