He is either down by 180 votes if you believe the Star Tribune page or down by 167 if you believe the Minnesota Secretary of State page. The real answer is that no one knows because there are so many challenged ballots that have to be reviewed next month. Nate Silver at 538.com thinks Franken will narrowly win once the challenged ballots are resolved.

...and lots of challenged ballots for the State Canvassing board to decide on. It'll be a while yet.

http://www.fivethirtyeight.com/2008/11/projection-franken-to-win-recount-by-27.html#commentsthere will be a take home exam later in the day. You will be given new challenge inputs and be expected to calculate the exact number of votes Franken wins by. I came up with 69. It seems appropriate.
