It needs 60 votes to pass because of budget rules, so there's no need for cloture.

3. Evidently vote will be held open until Sherrod Brown returns from his mother's wake, about 10:30PM.
A plane will be sent to return him to the Senate.

42. Bayh, I think is holding back until he knows that Gillibrand and Brown get their vote in.
With this sort of cloture vote, he would have to be ready to cast a no vote if he knows the bill won't make cloture, so he can reintroduce the bill later - you can't do that if you vote aye.

40. She voted yes on the stimulus in the earlier cloture vote.
I think we already know how the votes are going to end up - 60-38.

Kennedy will be the only Democrat not voting, and Gregg's voting against the stimulus.
