Good read. Orly Taitz is prevented from filing "similarly frivolous" cases in this George court.

The judicial smackdown is of truly grand proportions:

Then, implying that the President is either a wandering nomad or a prolific identity fraud crook, she alleges that the President “might have used as many as 149 addresses and 39 social security numbers prior to assuming the office of President.”


Finally, in a remarkable shifting of the traditional legal burden of proof, Plaintiff unashamedly alleges that Defendant has the burden to prove his “natural born” status.


The factual allegations must be sufficient “to raise a right to relief above the speculative level.” Bell Atl. Corp. v. Twombly, 550 U.S. 544, 555 (2007). Plaintiff’s complaint is not plausible on its face.


Presumably, some other military doctor, who does not resort to frivolous litigation to question the President’s legitimacy as Commander in Chief, would be required to go to Iraq in Plaintiff’s place. Similarly, the doctor who Plaintiff is being sent to relieve and who has likely been there for months would be delayed in receiving his well deserved leave because his replacement seeks special treatment due to her political views or reservations about being placed in harm’s way.


A spurious claim questioning the President’s constitutional legitimacy may be protected by the First Amendment, but a Court’s placement of its imprimatur upon a claim that is so lacking in factual support that it is frivolous would undoubtedly disserve the public interest.


And last, but friggin' painful for their lies about the "millions" O is spending on legal fees:

For the reasons previously stated, Plaintiff’s motion for a temporary restraining order is denied and Plaintiff’s complaint is dismissed in its entirety. Defendants shall recover their costs from Plaintiff. See Fed. R. Civ. P. 54(d).

The tone of that judgment sounded to me like it had an air of annoyance and almost a belittling manner. It felt like it was essentially calling Taitz a whackjob and the servicewoman a coward for not wanting to go to Iraq - not that I really disagree with either of those things, but I'm hesitant to think that should be blatant in a ruling like that.

40. I got frivolously sued in federal court years ago (along with 40 other defendants)
and when the case was finally dismissed against me, the judge delivered a similar harsh smackdown. Which he was free to do, and which I roundly applauded.

The plaintiff in my case was subsequently declared a vexatious litigant, lol.

46. Judges are notoriously
short tempered about incompetent lawyers. They don't have to answer to anyone unless someone wants to try and impeach them. I love that he ordered her to pay the defendents legal fees. And that he was appointed by Bush and recced by Chambliss is just too delicious.

The American taxpayers paid for her third and fourth years of medical

To the extent that it alleges any “facts,” the Complaint does not connect those facts to any actual violation of Plaintiff’s individual constitutional rights. Unlike in Alice in Wonderland, simply saying something is so does not make it so. The weakness of Plaintiff’s claim certainly weighs heavily against judicial review of the deployment order, and in fact, would authorize dismissal of Plaintiff’s complaint for failure to state a claim.


Further bwwahhahahha! in the footnotes:

One piece of “evidence” Plaintiff’s counsel relies upon deserves further discussion. Counsel has produced a document that she claims shows the President was born in Kenya, yet she has not authenticated that document. She has produced an affidavit from someone who allegedly obtained the document from a hospital in Mombasa, Kenya by paying “a cash ‘consideration’ to a Kenyan military officer on duty to look the other way, while obtained the copy” of the document. (Smith Decl. ¶ 7, Sept. 3, 2009.) Counsel has not, however, produced an original
certificate of authentication from the government agency that supposedly has official custody of the document. Therefore, the Court finds that the alleged document is unreliable due to counsel’s failure to properly authenticate the document. See Fed. R. Evid. 901

I suspect Ms. Taitz only carries malpractice insurance for her dentistry practice.

In fact, if you dig you'll discover the only reason Taitz sought her law degree (from an unaccredited online law school) and took the bar was so she could defend herself in malpractice suits.

35. IF she faces charges under Article 88 of the UCMJ, she most definitely has a case
and I suspect she will face mroe charges than just an Article 88.

Taitz is messing in areas of law she has no clue about, has made recommendations to file a spurious lawsuit and if it results in harm either via civil or criminal court proceedings, Rhodes has a case.

Yet just this week, Orly Taitz stated that she would have Obama out of office within 30 days. Her grandiose comments, and attempts at litigation, are the legal equivalent of Star Trek techno-babble. She is promising to crawl through the Jeffries Tube, and neutralize Obama with a stream of reverse tachyon particles.

That is why so many Freepers are keep posting that she is either a moron, or a double agent. They know that she could not win the case, even if she really did have a case. Every second and dollar spent supporting her is a second or dollar spent in the service of Obama.

Most of the lawsuits have been against state or federal officals as the primary defendant. Very few have been against Obama directly.

There has to be a point when this has to stop. I can't imagine that this can go on and on like this. She is clearly mentally unstable...while she has another pending case before Judge Land she says he should be put on trial for treason! The cherry on that sundae is that she is going to appeal this case to the 11th circuit. Given her statements and clearly having no supporting evidence to support an appeal, its absurd. Who is funding this nutjob? I don't think there is a lot of pressure to push her out on the of the limelight by the Dems though because she is really doing a dis-service to the GOP. Its becoming sad and uncomfortable though, she is deeply disturbed and really needs someone to take her by the hand and lead her off the stage. It is upsetting that people are allowing this to continue. Where the hell is the CA Bar in all of this? Can she not be dis-barred in some procedural move? That would end this insanity and put this issue to rest finally.

that the trial was a set up. But then, she apparently is not particularly bright (stoooopid with a fair ration of insane). The only reason a judge would entertain this claptrap in his/her courtroom would be to deliver this sort of smackdown (on a middle-school civics class level yet). She has now had her most likely one and only professional "shot across the bow". If she continues to file this nonsense she will be either heavily fined, disbarred, or perhaps both. She is not going to stop, so it should be fun to watch.
