Judge tosses out Army captain's complaint questioning president's birth; Orly Taitz on notice

U.S. District Court Judge Clay Land today tossed out a complaint by an Army captain fighting deployment to Iraq by questioning the legitimacy of President Barack Obama.

Land also put attorney Orly Taitz, who represents Capt. Connie Rhodes and is a leader in the national “birther” movement, on notice by stating that she could face sanctions if she ever files a similar “frivolous” lawsuit in his court.

In her California case, there is a hearing on the DoJ's motion to dismiss scheduled for October 5.

We are awaiting further smackdowns from the DC court of appeals and from the Third Circuit in two of Phil Berg's cases.

And Orly has filed a notice of appeal from the Major Cook decision from a few weeks back in the same Georgia federal court.

So, fire up the Jiffy-Pop, because her circus might come to an abrupt halt depending on how things go with the multiple bar complaints against her.

From the judge's order:

"For the reasons previously stated, Plaintiff’s motion for a temporary restraining order is denied and Plaintiff’s complaint is dismissed in its entirety. Defendants shall recover their costs from Plaintiff."

Now she'll have to start paying for the legal bills for the defense. It just gets better and better.
