"Plaintiff avers that there is increasing evidence that the United States District Courts in the 11th Circuit are subject to political pressure, external control, and, mostly likely, subservience to the same illegitimate chain of command which Plaintiff has previously protested in this case, except that the de facto President is not even nominally the Commander-in-Chief of the Article III Judiciary."


"It is reasonably certain that the men who framed the Constitution did not anticipate the election of a man as a President who appears to have prevaricated about his place of birth and then ordered his loyal followers to ridicule all those who questioned the contradictions inherent in his own biography, such as the obvious fact that his Father was an (admittedly disloyal and possibly treacherous) Subject of the British Crown when he was born, even though this fact alone would disqualify the President as a “natural born citizen”, regardless of his place of birth."


"This Court has threatened the undersigned counsel with sanctions for advocating that a legally conscious, procedurally sophisticated, and constitutionally aware army officers corps is the best protection against the encroachment of anti-democratic, authoritarian, neo-Fascistic or Palaeo-Communistic dictatorship in this country, without pointing to any specific language, facts, or allegations of fact in the Complaint or TRO as frivolous. Rule 11 demands more of the Court than use of its provisions as a means of suppressing the First Amendment Right to Petition regarding questions of truly historical, in fact epic and epochal, importance in the history of this nation."


"This Court has threatened the undersigned counsel with sanctions for failure to present facts, and yet has ignored or disregarded the facts concerning Barack Hussein Obama’s birthplace sub iudice aliena which were submitted to the Court in the form of the 1961 Hospital Birth Certificate submitted in the Plaintiff’s request for judicial notice (Document 10, entered September 11, 2009) in addition the consistent but later dated Certificate which was submitted as an Exhibit to the Complaint and original Application for Temporary Restraining Order. These documents are FACTS and they went unimpeached, unquestioned, and yet utterly unaddressed in this Court’s order of summary dismissal. The fact that the President has admitted his Father was not a citizen, but a British Subject, at the time of birth, is an incontrovertible fact, which supports Plaintiff’s charges that the President is an alien."


"Plaintiff submits that the clear preponderance of the credible evidence is that, in quite a few ways, Defendant Barack Hussein Obama has toyed with and manipulated his identity in order to obtain the President, and therefore won the “hard fought” Presidential Campaign of 2008 by fraud and trickery against the American People. The Court should reconsider the seriousness of its swift dismissal of this Plaintiff’s claims."

California is the only state that will allow a person to sit the bar exam if they have a JD from an unacredited law school.

Taitz attended an online law school that does one thing for three years, teaches one how to pass the California Bar Exam. They teach no other concepts of law.

Yeah, her license will get suspended, and she'll get fined. Then she'll get a ghostwriter, and the usual suspects will see to it that her book becomes a bestseller. Then she'll do the lecture circuit (hopefully after getting a language coach).

39. I agree. I don't think she's come CLOSE to conduct that would support disbarment.
The filing of some cases that get thrown out isn't even the beginning of a case for disbarment.

The complaint comes closer with some of the more specific allegations, such as ex parte conduct with judges. Nevertheless, disbarment is the ultimate sanction. It's rarely applied.

The first thing that's likely to happen to her is that, at some point, a court will hit her with Rule 11 sanctions for frivolous litigation. That would mean that she'd have to reimburse the defendants for their attorney's fees. That alone should cool her jets a bit.

In addition, some courts, when faced with persistent vexatious litigation, have imposed special requirements: "This particular party (or attorney) must present any case in advance and receive the court's permission to file and serve it."

In the bar disciplinary process, there are steps before disbarment. I don't know the specific California law, but typical would be an escalating ladder of disciplinary measures like:
* issuance of a letter of admonition
* formal censure
* suspension from practice for a period of time (six months, two years, whatever).

My advice is that everybody sit back, relax, and enjoy the Orly Show for its entertainment value (and for its potential for driving a wedge between some Republican electeds and the crazier elements of their base). Don't pin your hopes on the long shot of disbarment.

Judge Land specifically adminished her not to bring another frivolous suit to his court in his ruling from yesterday and today she filed a motion to reconsider.

She will definitely receive sancionts under Rule 11 now.

She's admitted only in California, and files all these suits around the country by being admitted in other jurisdictions . I think many of those courts would refuse to admit her, even pro hac vice, if she had defied a sanctions assessment issued by another federal judge. That would bring her whole operation outside California to a screeching halt. Even in California she'd be subject to some sort of discipline (and, I suppose, attachment of her bank account if need be).

Her more likely reaction is to appeal the sanctions order, ask that it be stayed pending the appeal, and of course call for the recusal (and possibly the treason trial) of any judge who exhibits bias by ruling against her.

If she eventually does have to pay any sanctions, she will play the martyr card to the hilt. She'll use the order as a basis for fundraising and probably raise more money from the nutjobs than she has to pay in sanctions.

From what I've been able to discern, the State Bar Court of California must make a recommendation for disbarment to the California Supreme Court. There are no Orly Taitz actions currently on the State Bar Court's calendar.

It took more than a year for Richard Fine to be disbarred after the initial hearing before the State Bar Court. October, 2007 - February, 2009.

The wheels of justice, and all that.

Under the statute that was in effect at the time, Ann Dunham couldn't convey U.S. citizenship to a child she bore outside the U.S. because she was only 18. If someone was indeed born in Kenya with one U.S. citizen parent, that parent had to have lived in the U.S. for five years after turning 14, and hence had to be at least 19.

Therefore, IF they could somehow show that Obama really was born in Kenya and that all the contrary documentation is the product of the most sweeping conspiracy in human history, THEN they'd be correct that he wasn't a citizen.

Of course, because he was born in Hawaii, all this is moot. He was a natural-born citizen regardless of the citizenship of his parents. The only exception is for children born to foreign ambassadors. Such children enjoy diplomatic immunity as of birth, and therefore aren't subject to the jurisdiction of the United States, and therefore aren't within the Fourteenth Amendment ("All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.").

Furthermore, the law about transmission of citizenship wasn't phrased in terms of the age of majority. It simply required five years' residence in the United States after the parent's fourteenth birthday. I think that a mother could have been 25 years old and her child (born abroad, with a non-U.S. citizen father) still wouldn't have been a citizen if the 25-year-old mother had lived outside the United States for a lot of time in her adolescence and young adulthood. (The law was substantially revised during the 1980s, so it would take a little digging in legal archives to confirm this point -- and no one cares about it except the birthers, because everyone else knows that Obama was born in Hawaii.)
