A FEDERAL judge's ruling that former U.S. Rep. Tom DeLay's name must remain on the general election ballot hung on what might be called a technicality: Was there any proof that DeLay would not live in Texas on Nov. 7, Election Day?
The court concluded that there was no such evidence. The U.S. Constitution, therefore, dictates that DeLay's eligibility to run for Congress as the Republican nominee in District 22 can be determined only on Election Day, long after the ballot names have been determined.
The judge's ruling is a victory for Democrats and their nominee, former U.S. Rep. Nick Lampson. Barring a reversal of U.S. District Judge Sam Sparks by the Fifth Circuit Court of Appeals, Lampson should have little trouble defeating a Republican candidate who resigned his seat in Congress and declared himself to be ineligible for re-election and a burden on his party.
I love that. I hope that means they will be endorsing Lampson over "cut and run coward" DeLay.
