But body says members aren't criminally liable for voting for other members who are absent.A Travis County grand jury today issued a report calling on Texas lawmakers to cease the common practice of voting electronically for colleagues who are not at their desks or to change Legislature rules that prohibit the practice.
The grand jury in the 299th district court was asked to consider a citizen complaint that such voting amounted to tampering with a governmental record or impersonating a public servant, the report said. The grand jury found that the voting did not violate any criminal statute and noted that separation of powers provisions in the Texas Constitution preclude the judicial branch from interfering with the enforcement of House rules.
The grand jury called on the House speaker — Republican Tom Craddick — to enforce the House rules.
The report said that some citizens believe the Legislature "has a proclivity for passing laws for citizens to abide by but will not even abide by its own rules, which are equivalent to laws imposed on private citizens. "
