Judge: Van Hollen can continue elections lawsuit

Attorney General J.B. Van Hollen will be allowed to continue his lawsuit against the state elections agency, a Dane County circuit judge has ruled.
Judge Maryann Sumi said today that Supreme Court rules allow Van Hollen to sue the Government Accountability Board even while the state Justice Department represents the agency in other matters.
Sumi said Van Hollen's office adequately separated the lawyers working on the elections case from lawyers representing the accountability board in other matters. She also noted that the board received an independent lawyer immediately.
It's unclear whether the accountability board will seek a review of the decision by the Court of Appeals.
Van Hollen is suing the board to force it to expand its voter registration checks under state and federal law and to force ineligible voters off the rolls.
Sumi also allowed the state Democratic and Republican parties, as well as three labor unions, to intervene in the case.
