Why is he the first one to ask for this? This is important evidence on a very important issue and the public should have already insisted it be made public.

43. I think WE might have...
Didn't we all write our congressmen? Letters to Senators, to Sensenbrenner? I don't know about you, but I'm thinking that it was us, and Ukraine, and a whole lotta people that want to verify the voting process. And those can't can't stand what that cabal is doing, too.

6. This is big news
because it shows that the 'gov' is thinking like we are. Drawing conclusions that exit polls/results don't mix.

They couldn't ignore the similarities over in the Ukraine.

Could it be possible that the Ukraine indirectly will save America? Won, how we have come full circle.

11. Well, from a brief read, here's the heart of it...
The letter asks him to release his "raw data" and it also asks him to testify at the hearing next week.

The letter mentions the discrepancy between the early NEP polls and the result of the election. It goes on to say that this discrepancy is "problematic" and "raises serious concerns about voting irregularity." And, oh my goodness, "The only way to restore complete legitimacy on this election is to have an independent firm conduct a detailed analysis of the data, including the raw data taken at the polls early in the day."

It says that exit poll data is now being used by "Administration officials" to "evaluate the legitimacy" in the Ukraine. Uses Colin Powell's words as a reference.

Letter also requests his presence at a forum to discuss these issues.

That's the heart of it.

13. summary
Edited on Fri Dec-03-04 06:37 PM by mulethree
first letter to Blackwell has about 30 questions about 12 or so irregularities all over ohio. All sorts from warren lockdown to bad vote machine distribution to registration fraud to wierd counts to spoilage. If I recall it asked for a response by next friday?

Second letter points out that one county still has posted his deal about 'must be 80+ lb card stock' even though that was reversed; asks whats up with the county where the ES&S tech used the tabulator machine over a weekend - he had put them on 'administrative oversight' - what happened with that, what investigations been done?.
Asks him to attend a hearing Wed Dec8 @ 10am

Letter to Mitofsky ask for raw exit poll data so it can be examined by an independent expert. Peer review of exit data - long overdue. Also asks him to attend the Dec 8th 10am hearing.

Also lots of 'additional signatories' with more congressmen signing onto his call for the GAO to investigate. Looks like the original request + 3 "additionals" each with 5-6 signatures so 25 or so total.

15. Here you go >
http://www.house.gov/judiciary_democrats/mitofskyelecinfoltr12304.pdf

Dear Mr. Mitofsky,

I am writing to ask you to help clear up many of the rumors and disputes surrounding the 2004 Presidential election exit polls by releasing the "raw data" from your exit polls and by testifying at a hearing we will be holding next week.

As you are well aware, many questions have been raised regarding the discrepancy between the early exit polls conducted by the National Election Pool and the final result of the election. Specifically, just after noon on November 2, numbers were reportedly released showing that Senator John Kerry was leading in several key states such as Florida and Ohio by a three percentage point lead late in the day. As we now know, these numbers are at odds with official results.

This discrepancy is objectively problematic and raises serious concerns about voting irregularity. While resonable minds can differ as to the latter theory, the only way to restore complete legitimacy on this election is to have an independent firm conduct a detailed analysis of the data, including the raw data taken at the polls early in the day.

Indeed, exit poll data is now being used by Administration officials to evaluate the legitimacy of the election in the Ukraine. As Secretary of State Colin Powell stated, "We cannot accept this result as legitmate because it does not meet international standards and because there has not been an investigation of the numerous and credible reports of fraud and abuse." Powell recently called for "a full review of the conduct of the election" and tallying of results. Such an inquiry into the legitimacy of election results should be a priority for our country as well.

I would also like to request your attendance at a forum that I, along with many of my colleagues on the Judiciary Committee will be holding to discuss any issues and concerns regarding the numerous voting irregularities that have been reported in Ohio during the 2004 election. The forum will be held on Wednesday, December 8th, 2004 at 10:00 a.m. in Room 2237 of the Rayburn House Office Building. We are sure that you agree with us that regardless of the outcome of the election, it is imperative that we examine and openly discuss any and all factors that may have led to voting irregularities and any failure of votes to be properly counted. This will be a very informative forum for everyone in attendance and any insight or concerns that you may have on this issue will be greatly appreciated.

I sincerely hope that you will be able to attend and look forward to your response. If you have any questions, please contact Perry Apelbaum or Ted Kalo of the House Judiciary Committee Democratic Staff at (202) 225-6504.

Sincerely,

John Conyers

We owe a lot to Conyers, he's the one who called for the GAO investigation in the first place...

Hmmmm, a point-by-point shredding of the Ohio vote hours or days before a lawsuit is to be filed requesting that the vote be thrown out... Interesting...

45. Subpoena authority
I don't think they have subpoena authority in this instance because of the informal nature of the hearing. Now, if we're talking about the formal GAO investigation, absolutely. The GAO would most certainly subpoena all of the raw data and serve a summons on Mitofsky to testify. Hell, for that matter, any of the parties involved in the Ohio and Florida lawsuits could subpoena the raw data in the discovery process and depose Mitofsky as well.

One would set up a museum. Once inside, the visitor would be 100 years in the future. The musuem would have documents under glass such as the Conyers Democracy Letters, as they will become known. It will have busts of Conyers, Jackson, Arnebeck, Harris, Oberman and others as well as video and audio showing the battle to save democracy.
It will also feature a trial and sentencing for treason.

46. "Sit down, my son."
The way I see it (and this is just my opinion), this is a bold move by Conyers that really puts the pressure on Mitofsky to deliver. Mitofsky makes his living by polling and one would think he would jump at the chance to be the pollster that appears before Congress. If he doesn't appear, then it could really look bad for him and make it look like he isn't proud of his own work, or that he has something to hide. The data are going to come out at some point - if Mitofsky is smart he will use the exposure of going to Congress to his advantage.

Extra points for anyone who recognizes the quote.
