Ballot review shows Frye could be San Diego mayor

SAN DIEGO (AP) - A review Tuesday of ballots cast in the San Diego mayor's race showed that a maverick city councilwoman would beat the incumbent mayor if a judge ordered thousands of disputed write-in votes to be counted in the official tally.

The ballots with Councilwoman Donna Frye's name on them were not counted because, under state law, voters must darken a bubble next to the write-in line on the optically scanned ballots.

After reviewing thousands of ballots cast at 709 precincts on Nov. 2, observers counted 4,180 ballots with Frye's name on them and the bubble left blank, The San Diego Union-Tribune reported.

Is there a California or federal law saying that as long as voter-intent can be determined, the vote should count?
