Presidential Recount Request Headed To Court

SANTA FE — A judge on Wednesday upheld the state canvassing board's decision to require more than $1 million up front before a recount of presidential votes in New Mexico could begin.
State District Judge Carol Vigil made the ruling after a hearing.
A lawyer for the Green and Libertarian presidential nominees who requested the recount said they would take their fight to the state Supreme Court unless some kind of compromise could be worked out with the board.
"I think the judge's decision does not comply with the law," Lowell Finley said.
He had argued that the board went beyond the law Tuesday when it voted to require the payment of $1.4 million by 10 a.m. Thursday.
Finley said the Greens and Libertarians are "fully prepared" to pay for the recount, but that the law requires a deposit of no more than the $114,400 they already have deposited.
Vigil said the $114,400 "has got your foot in the door," but that the board was within its rights to require more up front.
Finley said he would discuss with board lawyers the possibility of narrowing the recount request to review only a portion of the state's voting machines used in the Nov. 2 general election.

New Mexico Recount in Court Today

The Albuquerque Journal reports that Democratic Governor Bill Richardson and two colleagues on the New Mexico State Canvassing Board yesterday agreed to a recount of the state's presidential ballots, but only if David Cobb and other recount advocates pay $1.4 million by Thursday to cover recount costs.

Lawyers for the Cobb-LaMarsh campaign and the other recount seekers are in court this morning (Wednesday) to seek to allow the recount to proceed without the high price tag. Recount backers seek to verify the accuracy and credibility of New Mexico's voting systems, and have raised concerns about touch screen voting machines and the so-called "undervote."

"There's tremendous grassroots support for the recount and for verifying the accuracy of our voting system. We have 800 volunteers who are ready to jump in and monitor the recount process," said Rick Lass, the New Mexico recount coordinator for the Cobb-LaMarche campaign.

The state Canvassing Board on Tuesday, after some deliberation, granted a late November request for a recount by presidential candidates David Cobb of the Green Party and Michael Badnarik, a Libertarian.

Recount backers say their goal is to verify the accuracy and credibility of New Mexico's voting systems. They have raised concerns about touch screen voting machines and the so-called undervote.

But according to state election officials, recount proponents will have to come up with $1.4 million by 10 a.m. Thursday in order to proceed.

"I am requiring that much money because the taxpayers are not responsible for footing this bill," Secretary of State Rebecca Vigil-Giron said.

Protests must be sent to Gov. Richardson and other New Mex Dems. Are these guys nuts? Do they WANT rightwing Republican controlled source code tabulating our votes? Is this fiefdom-ism? What? What is this?

I'm going to do it anyway, but wasn't Richardson against the whole recount idea anyway?

Maybe lighting a fire under his ass the way we lit one under Kerry will help, but I don't understand why he didn't want auditors looking into his state to begin with.

18. I just said it wasn't decided. Its not, its in litigation and I pointed
out to Gloria on the other thread that it was premature to preannounce something that the Greens hadn't said yet. They just had to postpone the training till they know when/if they can get the recount going.

17. The obvious question
Please don't flame me... I have held my faith in Kerry all this time, and have written to him more than once since 11/3, kind letters. Kerry is STILL OK with me and I am not going to take being accused of bashing him.

But the obvious question is... why doesn't he put up this money? It's pocket change to him and would be a wonderful gesture. The Greens (and donors) did him a great service in Ohio and he should return the favor. Also he couldn't be accused of being a sore loser, since NM doesn't have enough EVs to change the election. He can say it's only about having votes counted and there's NO way the point could be argued.

Shall we start the letter campaign? Thoughts...

23. Gawd, I'd just love it if when the IRS tells me they want to audit my
tax return, I could authoritatively say, "Kaa-ching, that'll be 50 million C-notes to proceed!"

Seriously, if it truly costs so much to audit, we need a more transparent voting system. Can the question of unreasonableness of fee be raised here? I mean, where's the disincentive to hide public information if hiding it creates more windfall income for the possibly corrupt?
