Parties Dealt Blow in Recount Flap

HOUSTON (Dec. 15) - Two minor parties seeking a recount of the New Mexico presidential election tally suffered a defeat Wednesday when a judge ordered them to pay $1.4 million for a new tabulation.
The ruling by District Judge Carol Vigil, which called for the Green Party and Libertarian Party to deposit the money by Thursday morning, was a blow to the parties' campaign for a hand count.

"We feel this was an improper decision and there's nothing in the law that requires us to pay this, so our legal team is looking at our options," said New Mexico Green Party spokesman Rick Lass.
He said the deposit, which New Mexico's secretary of state's office determined was needed to ensure the parties covered the costs of a recount, was more than his state party had raised for the campaign itself.

Democrats and Republicans have opposed the recount. Democratic Gov. Bill Richardson was a member of the three-person canvassing board that decided Tuesday that the minor parties needed to deposit $1.4 million.
Vigil affirmed that decision Wednesday.

The parties can now take their case to the New Mexico Supreme Court if they cannot or will not make the deposit. However, Chief Justice Petra Jimenez Maes was on the canvassing board that slapped them with the bill in the first place.
Republican President Bush beat Democratic Sen. John Kerry by 5,988 votes in New Mexico, according to the count certified by the canvassing board last month.
The Green Party is hopeful its candidate, David Cobb, can gain about 2,000 votes in a new count, Lass said. That would ensure its position on the 2006 ballot without having to endure a tedious petition drive.

I am extremely disappointed in your actions to stop the recount of votes in New Mexico.
I have supported you sense you were my congressman way back when, but in light of your actions I must reconsider that support. You are apparently not the man I thought you were.

Why are you making it so hard for a recount to go forward? I thought you were a democrat, and one who may one day seek national office. Surely a recount is in your best interest to ensure the integrity of the vote.

Recounting TouchScreen Systems is stupid. Getting the machines secured immediately after the election would have been best.

Just stop and think about wasting 1.4million bucks for a recount of the same. Huh,got it now?

and give them some money, they have all the extra and I know they contributed to one of the recounts going on (either Washington or Alaska) The Glibs have been doing all the work so far.
