put himself in precarious legal/ethical position... he should have recused himself immediately... not doing so means he gave a judgement, directly or indirectly, on a law suit where he was a defendent... grounds for disbarment.

If he recuses... then another, less conservative judge gets the case... which would have been much better for him than what he did do, but bad if he wants to keep Bush (and himself) the winner of the election.
At any rate, the MSM media picked up on it WAY TOO FAST without considering the implications... which I think was the ultimate goal.
The link posted above has a good summary of the implications (legal/ethical and case-wise) of the judgement.

Nevermind that their precious Chimp has killed countless pregnant Iraqi women with our bombs over a bunch of lies, but they be damned if anyone wants to benefit from Stem Cell Research. but generally they post RW talking points. Often they will show up in the form of war apologists, pretending to be progressives, but giving neocon type defenses of why the war was such a good idea. Those ones sometimes pretend to be soldiers.
Others ask "innocent" questions repeating RW talking points, ostensibly to have them refuted, sometimes posting the RW email that their brother sent them.
Some build up their post count with innoccuous posts in the lounge and then when they've been here a respectable amount of time and gotten a respectably high post count, start spouting RW talking points.
Some pretend to be Greens, and run around urging people to abandon the Democratic party. Some of them just like to sow discord by posting flamebait.
The majority of them are pretty obvious and get tombstoned very quickly. A handful have actually lasted months or even years and racked up thousands of posts.
Generally, if you see someone spouting RW crap, you should alert the mods. They usually get taken care of pretty quickly.
This post is not intended as a "how to" guide.

I'm not going to conjecture anything, as I'm not a lawyer; but it's obvious that Arnebeck counted on this and had planned it as part of his strategy.
What his end-game is going to be we'll have to wait and see, but it sure as hell just went to a whole new level of interest.
As said above... the MSM has finally picked up on the fraud issue by reporting the "Toss-Out"; and they are the ones that have appeared to been used the most in this maneuver.
