Wednesday 12/22 Election/Fraud/Recount thread
In order to organize and document I thought it would be a good idea to have a daily thread to place items related to the recounts/fraud. This also make it easier to "catch up" when we are away from the computer for a while.

Please help us. If you see something that isn't here post it with a link to the thread and a thanks to the author. Thanks to everyone who is helping in this project.

Likewise. I'm in Birmingham. I'm curious as to whether you volunteered w/ the Democratic party up there. If so, what was your experience?

I did here, and while I met a lot of great people with tremendous zeal and passion for the cause, it was overall a disappointing experience.

If the Alabama Democratic party is any indication as to how the party operates in red states then we're in trouble. I've never seen a more poorly run, defeatist, and apathetic organization. The people running the show were worthless.

IMHO, this is why we need Dean for DNC chair. I like his philosophy regarding grassroots activisim and rebuilding the party from the local level. We could be competitive in the south if we hadn't written it off years ago.

52. In all honesty,
I came to this game late. No, I didn't volunteer. I donated $$ and that is about it. After the election I knew my life would never be the same because I sat on the sideline while this happened. I had rationalized by saying that my children are young and very involved in activities and that we are a busy family.

As an example to how bad things were in Florence... my children and I wanted a Kerry/Edwards bumper sticker and yard sign very badly. I couldn't find the local Democratic headquarters after looking until I was frustrated. There was nothing in the phone book, newspaper, etc. that I could find while the Republicans were easy to find and those darn "W" stickers were everywhere. As a matter of fact, my husband finally found the headquarters--in the next town!

I just wonder if Kerry really wanted to win!

Why isn't he leading the way with the recounts and voter fraud accusations?

Why has he just ignored all of us? I thought he was a leader....

We're just lucky to have this grassroots effort.

8. I just heard an NPR story about Conyers ....
Lying in bed at 8:40 a.m. PST, I heard an NPR story on CapRadio, Sacramento, California. They said that John Conyers was asking the networks for their exit poll data, but the networks were refusing, telling him they were still analyzing the data! Without the exit poll data, Conyers said they would not be able to challenge the election results! They also mentioned Zogby's exit polls in the report. Anyone else catch this from NPR?

RALEIGH, N.C. - A dozen Democrats asked fellow party member and Agriculture Commissioner Britt Cobb on Tuesday to withdraw his election protest to avoid a new statewide race with Republican Steve Troxler.

In a letter to Cobb, who trails Troxler by 2,287 votes, the Democrats -- many of them Piedmont-area farmers -- said they "were greatly disturbed" by Cobb's legal appeals in the weeks following the Nov. 2 election.

"Please do not attempt to avoid an election defeat by using lawyers to fight the results in court," the letter read.

John Kerry and John Edwards conceded graciously after the presidential election, they wrote, and "the people of North Carolina are now urging you to see the same handwriting on the wall in this circumstance."

Both Cobb and Troxler had appealed a decision by the State Board of Elections that called for a special election in Carteret County because 4,438 ballots were lost -- more than the current difference between the candidates.

11. The North Carolina election was a MESS!!! I don't know why more people
aren't fussing about it! Lost votes, machines counting BACKWARDS (!), all kinds of shennanigans were going on. Those repuke farmers who are asking Cobb not to have a re-vote should shut the f*** up, and demand that every vote counts!

In fact, the entire State should have a do-over of the vote. I'll still never believe that John Kerry didn't win North Carolina, OR that Erskin Bowles didn't win the Senate race. Even people in areas that always go repuke were sick of the repukes this time. It's just that the right wingers made more noise publicly, and too many people "expected" NC to go red. It didn't. It just didn't go red this time.

I am going to send them an email telling them exactly what message I have for Senate Dems and what message I have for MoveOn's current direction.

Just got this today (Wednesday):

As one of our most involved members, we wanted to tell you about a fun opportunity: We'll be meeting with some Democratic senators in the new year, and we'd like to remind them why it's important to fight hard for our country's future.

If you have a digital camera, can you take a photo of yourself -- or better yet your whole family -- holding a sign with a positive, encouraging message for these Senate Democrats? As part of our presentation, we'll share select photos to steel their resolve for the year ahead.

Your message should be big, simple, and legible -- something as short as "fight for us" or "keep America free." Write with marker on a white piece of paper. This isn't the time for a long manifesto. 14. Finally news found of Fairfield county on the Saturday recount.
It's one sided as the last sentence shows. But the difference in recount (and this is assumed it's the 3%) is quite a difference. Whether this is from chads falling off or what is not told.

The Bush/Cheney team went from 42,057 in the preliminary count to 42,715 votes in the final recount. The Kerry/Edwards ticket went from 24,321 to 24,783.

state:

Nov. 2: Election Day. Democratic Attorney General Christine
Gregoire finds herself in unexpectedly tight race with Republican
real estate agent Dino Rossi. Gregoire is up by 7,000 votes at the
end of the night, with hundreds of thousands of absentee ballots yet
to be counted.

Nov. 17: With all counties reporting, Rossi wins by 261 votes
out of 2.9 million cast. State law triggers a machine recount.

Nov. 30: Machine recount shows Rossi the winner by 42 votes.

Dec. 2: Democrats declare they will seek an unprecedented
hand recount.

Dec. 8: Counties begin recounting ballots by hand.

Dec. 13: Seattle's heavily Democratic King County announces
discovery of more than 500 mistakenly rejected ballots. By week's
end, the number grows to 723.

Dec. 17: Republicans win a judge's order blocking King County
from counting the 723. With every county reporting but King County,
the state's largest, Rossi holds 49-vote lead in the hand recount.

Dec. 21: Democratic state chairman says the results from King
County show Gregoire winning statewide by eight votes - not counting
the 723 ballots. County officials will not confirm those numbers.

Dec. 22: Washington Supreme Court hears arguments on the 723
ballots. King County is scheduled to report its recount results, not
including those disputed ballots, Wednesday afternoon.

Clear Box Voting System 1.0

As we all grow weary of the U.S. elections fiascoes over the last four years, courtesy of Ohio and Florida partisan Secretaries of States, I unveil your 2004 Christmas present. It is the brand new Clear Box Voting System, nice and boring (may need some egg nog):

1) Everyone gets a Voter ID number. Your social security card or your drivers license is your Voter ID card. Ok, so you already have your Voter ID card ... let's vote.
2) It's Election Day. You walk into a school auditorium, college classroom, church, indoor sports arena, or current polling place, and notice a large clear acrylic box in center of room. You also notice a standalone video camera 20 feet away.
3) You approach the familiar registrar and present your Voter ID card with correct address. You may make address correction there if you have a bill from correct address; you go to the SLOW Line.
4) Everyone receives a serialized standard blank ballot form (distributed in order) with a detachable matching serial number tag at the bottom. You initial both.
5) If you are the first voter of the day you receive a certificate saying you are first voter. Your serialized ballot MUST say "00001" and includes explicit precinct number pre-printed. This number is the zip plus four number for that address.
6) You complete your name, birth date, voter ID number, "m" for machine, "p" for paper, and sign the log book next to numbered line matching the serialized ballot number.
7) You choose between a paper menu (p) or touch screen machine (m) that will be your way of viewing voting choices.
8) If you are in the wrong precinct, you MUST go to correct precinct, sorry. Since voting will take 15 minutes at all precincts that should be a motivator. All touch screens in a given county have the exact same powerpoint program. The voter, registrar, or voting official merely enters their three digit precinct number to display correct ballot. After that, the voter hits NEXT or PREVIOUS to see next page. On Last page, just click done. It will default to this ballot for next voter. All other ballots can be locked out.
9) All voters designate choices by marking the paper ballot (op scan sheet). Your vote will be scanned by the same machine all at the same time.
10) Voting occurs at desk or stands at kiosk or uses clipboard and uses a #2 pencil to fill in bubbles on op scan ballot. Could use school auditorium, college classrooms, church pews, indoor sports arenas. Machines are at the kiosks. No more waiting a long time since voters will always have option of paper menus. Since this requires space and not a machine should be able to vote in less than 15 minutes tops.
11) Voter reads choices from the screen or paper menu. Each race is numbered. Voter completes bubble for each race. Just like the SATs. There should never be more the 10 choices. If more than 10 choices (that is max per race line), like in California's Governor race, then voter must leave related group blank. Failure results in vote for this race nullified. Ballot still good for other races. May have more than one bubble selected on some races.
12) When done marking op scan ballot, voter removes, by tearing perforation, and keeps claim tag with pre-printed serial number and precinct number. Op scan ballot is deposited into clear acrylic lock box in the correct orientation. Your vote will be scanned by the same machine at the same time as the others later that night.
13) Video camera records transaction. Use two 6 hour tapes should cover whole day. Only interruption in in tape should be when changing tapes. The display time of day MUST be visible on these tapes.
14) When polls close, registrars log last serial numbered ballot and last voter receives a certificate saying they are the last voter. Bi-partisan registrars sign and date the line right below Last Voter. Total number of voters are immediately posted on public window.
15) In continuous view of video camera, the first of two op scan machines are wheeled over to the acrylic box based on random selection procedure. There are two op scan machines available for back-up also selected randomly if needed.
16) Tabulation is performed immediately after the polls close and is open to public as long as safe building occupancy rules are followed and 50/50 of each party. May need to reduce numbers of one party. Two bi-partsan officials (or more as long as there is an equal number of both) on 4 Op-Scanners connectable to printers.
17) The Registrar #1, chosen by a coin flip, picks the Op-Scanner of their choice (they are numbered), then the other Registrar will pick from the remaining 3.
18) Registrar #1 places ALL of the ballots (removed from the Clear Box in view of camera) into the selected op scanner. The op scan sheets will run whether the perforated tags have been removed or not. Officials may remove claim tags. This is because they go in top-first.
19) After all ballots are run (will take fifteen minutes per 1000), the labelled memory card is removed and two copies of the results are printed immediately. The print outs look like the paper menus with results right next to candidate listings.
20) Registrar #2 now places ALL of the ballots into their selected op scanner (different from first); after all ballots are run, the memory card is removed and two copies of the results are printed immediately.
21) Results are compared for all races between Registrar #1's print out and Registrar #2's print out. If they match, one copy is immediately posted on interior window or polling place visible after hours.
22) If results do not come within 10 votes for every race, then Repeat and Re-Rerun using the opposite's machine. The other two op scanners are backups for failures.
23) Must re-run all night till midnight until they come within 10 votes.
24) Multiple runs are averaged (add and then divide by 2, 3, 4, number of runs) and results are manually tallied on two sheets and posted.
25) Whether successful tabulation occurs or catastrophic machine failures, all ballots go back into locked clear acrylic box at midnight and both Registrars, or their designates, load the labelled box, memory cards, un removed claim tags, and videotapes, all clearly showing precinct # (zip plus four), into one car and drive to county elections office for drop off to receiving official.
26) Boxes are paired with their out-of-precinct brothers and both receive certification or are re-run at elections office by 3:00 AM in front of bi-partisan officials.
27) All precinct results are posted visibly at elections office and then entered into internet database for world wide viewing.
28) Revised results are driven and posted back at problem precincts, cleared stating "revised." The first print outs are NOT to be removed. Post explanation for changes. Include out-of-precinct numbers on posting.
29) "Provisional" ballots are never separated from other ballots. Once they receive a ballot they are no longer provisional. They should no longer be discarded or ignored for any reason. They are continuously re-run with others. Problems are ignored by op-scanner. This fair since it penalizes both parties equally. Number of errors should be tracked and posted.
30) Mail-in absentee balloting is called out-of-precinct voting and is performed on special serialized ballots that are requested by phone and mailed to county elections office. Identifying info will be requested including a PIN number. There is one acrylic box per district for this out-of-precinct at the elections office. They tabulate all of these on election night in front of bi-partisan witnesses. There will never be more than two acrylic boxes per precinct (one for in-precinct and one out-of-precinct at main elections office). Military, overseas, and invalids (with approved handicapped designation) may vote absentee vote and their votes must be dropped in or received in the out-of-precinct box by that night. Their ballots have special serial numbers and their passport numbers.
31) If early voting is allowed, then repeat above procedure every day during early voting time period (one week?).
32) Central spreadsheets MUST always keep in-precinct and out-of-precinct tabulations separate as a separate line item, with total clearly showing. There are no other numbers.

Let's preserve "Justice for All" as well as "Under God." Make whatever changes to above procedure that accomplishes justice and makes God smile.

No Vote, No Justice, No Peace. No God.

I, for one, believe all four are knowable: VOTING, JUSTICE, PEACE, GOD.

I read this...

"John Kerry carried New York in November, but he may not get the 31 electoral votes.

That's because an error gave New York's 31 electoral votes to somebody named "John L. Kerry."

State officials say they're rushing corrected copies of the documents.

The mistake was found after the official "certificate of vote" appeared on the National Archives Web site."

Is this for real? Didn't this happen someplace else as well because they had written John Edwards instead? Can they really get away with taking the votes away from Kerry? And do you think anything fishy is going on with how this is coming out NOW? Why now? Repubs are cheering because they say that even if Kerry won the Ohio recount, it seems that he would not have enough electoral votes because of this! Coincidence???

(Sorry if this is old news, but I couldn't find anything on this...)

thanks for the welcome! I'm sorry for sort of posting that in the wrong place. Since I'm new it wouldn't let me set a new topic yet and I don't quite have the hang of this yet either. I'm just concerned they're pulling something else here, just in case Ohio were to change, so Kerry still couldn't actually "win" on some technicality. Why is this coming out now? I really can't believe they would take the votes because of a typo like that, as if it's not obvious who they meant, right?! Anyway, thanks for the response, I'll look further to see if I find anything. :) I guess someone else MUST be on top of that issue!

Objecting to the Counting of One or More Electoral Votes. 3 U.S.C.
§15 includes a procedure for making and acting on objections to the
counting of one or more of the electoral votes from a state or the
District of Columbia.

The statute states that "o votes or papers from any other State
shall be acted upon until the objections previously made to the
votes or papers from any State shall have been finally disposed
of." However, in 1873, before enactment of the law now in force,
the joint session agreed, without objection and for reasons of
convenience, to entertain objections with regard to two or more
states before the two houses met separately to consider any of them.

Disposing of Objections. The joint session does not act on any
objections that are made. Instead, the joint session is suspended
while each house meets separately to debate the objection and vote
whether, based on the objection, to count the vote or votes in
question. Both houses must vote separately to agree to the
objection.

These procedures limit debate on the objection to not more than two
hours, during which each member may speak only once and for not more
than five minutes.

The legal battle over Ohio’s presidential vote is being fought by
not only a dedicated legal team, but also by dedicated volunteers
who believe that the voting process has been compromised. They have
been willing at their own expense, to drop whatever they are doing,

and disenfranchisement. The following six people have given their
time and heart to this cause.

Bonnie McFadden, formerly a deputy public defender, law professor
from both the University of New Guinea and the University of Hawaii,
and director of the Cambodia Defenders Project in Phnom Penh,
Cambodia, currently resides in Maui.

Karen Peterson, an attorney who worked for more than a decade in
legal services specializing in public benefits, consumer and family
law and was a professor at both Cornell and the University of
Minnesota law schools

Lillian Ritt, formerly a research attorney working for the San Diego
Superior Court and the 4th DCA Division 1 for more than twenty
years, and part of the team researching election law for Al Gore

Steve Chaffin, an attorney in Ohio for twenty-four years, has worked
in many ways to provide for those who have needed legal assistance
and not been able to afford it.

Judy McCann, a civil rights attorney from Santa Rosa, California,
left for Ohio with one day’s notice

Melanie Braithwaite, an attorney in Columbus, Ohio, wants to
volunteer for this election contest because of her concern for her
children and grandchildren.

OLYMPIA -- The state Supreme Court today unanimously overturned a
lower court order that had stopped King County from counting 735
disputed ballots cast in the closest governor's race in state
history.

The court, siding with Democrats, King County and Secretary of State
Sam Reed, said that state law gives counties the power to reconsider
ballots mistakenly rejected in earlier counts if there is evidence
of an error.


The win for Democrats come as their candidate, Attorney General
Christine Gregoire, appears to have taken the lead in her race with
Republican Dino Rossi.

But the court said Republicans read the law too narrowly. The court
took a broader approach, saying that because the ballots were
mistakenly categorized as having mismatched signatures, they were
not "fully canvassed."

Prior court decisions show that that "is just the sort of apparent
discrepancy or inconsistency that the board can correct," the court
wrote.

The court also addressed Republican concerns that the security of
the questioned ballots had been compromised, saying while
Republicans "suggest that there may have been some impropriety
involved in this decision, or that the ballots involved might have
been tampered with, but point to no facts supporting such a
conclusion."


"We're thrilled," said state Democratic Party spokeswoman Kirstin
Brost. "All along, this has been about counting every vote."

State Republican Party Chairman Chris Vance said he had "nothing to
say."

But most of the local election officials contacted for this story _ and in dozens of other interviews conducted throughout the year _ said they were unaware of discrepancies between vote tallies and the number of ballots cast. Instead, county officials often claim large discrepancies are the deliberate choice of many voters to ignore major races like president or governor.

"Most of them just didn't vote," Kirby said. "It's weird but it happens." But he double checked the vote in his West Virginia county and called back a day later to confess: "It was an error. I know, because I made the error."

Officials in two of the 10 counties selected in this study refused to review ballots or check for missing votes.

"I don't have time to go through all of this, although it does sound like it ought to be gotten to the bottom of," said County Clerk John Jones of Worth County, Mo.

Only 1,132 of his 1,326 ballots registered a presidential vote, which means nearly 15 percent of Worth County voters appear to have ignored the presidential race. "Sir, I cannot record votes for president that are not there," Jones said later.

Only 2,063 of the 2,283 ballots cast in Adams County, Idaho, registered a vote for president. Officially, only 90 percent of the voters in this rural county had an opinion in the presidential race.

"If you can convince the secretary of state of Idaho to order a recount and to reimburse my county for it, then we'll do a recount. But I'm not going to do it," said Adams County Clerk Michael Fisk. "All of that stuff has been put away. What difference does it make? The election is over."

Fisk said Scripps Howard's request that he review he election tallies angered him.

"You are not going to assert that any votes are missing in Adams County. I'm not going to listen to that stuff. Goodbye," With that, Fisk hung up the telephone.

"There's a few straggling lawsuits out there, but I think we can handle those," said Heller, who was just sued by a Democratic activist claiming he's withholding election records that could bring Bush's victory in this state into question. Bush defeated Kerry in Nevada by 21,500 votes, 418,690 to 397,190.

Marvel, a veteran rural Nevada assemblyman, said he and other electors got letters from Democrats urging them to defect and switch their votes to Kerry. "I filed my letter you know where," he added."

41. Ohio Recount Report from Shelby and Miami Counties

my Ohio report

Hello, all you democracy lovers! Thank you so much to those of you
who donated (or have pledged to donate) so that I could go to Ohio
to help in the recount. Here is a short report about what your
generosity made possible. Though I thought when we set out that we
might overturn the election, I found out that Ohio law made that
very unlikely. But our work was helpful in uncovering evidence of
wrongdoing.

On Tues, Dec. 14, four of us from Madison set out for Shelby County,
Ohio,

On Wed. we spent 3 hours at the Shelby County Board of Elections
office, looking at the poll books and signature books, counting
signatures and looking for anything suspicious. The Director of the
Elections Board, Kay Baker (Republican) was wary but polite. She
tried calling the Secretary of State's office for instructions, but
couldn't get any, so made do with someone in a neighboring county.
She let us see the books, but only one at a time. Later we found out
the Phil and Maureen had not been allowed to see the same books in
Champaign County!

We obtained a list of all the provisional votes that had not been
counted in Shelby County, with the names and addresses of the
voters. We called 2 and found one who said that she had arrived at
the polling place, which held several precincts. A woman official
had asked her where she lived, and then directed her to a certain
line. When, after 2 hours, she reached the head of the line, she was
told she was in the wrong precinct and given a provisional ballot.
Because the Secretary of State Blackwell had decreed that those
voting provisionally in the wrong precinct would not be counted, her
vote was junked, even though the correct precinct was in the very
same building! The officials could have 1) told her the correct
information or 2) told her to go to the other line, but instead they
insured that her vote did not count.

That night we had a training by Jesse {last name removed}, an energetic and
delightful young man who is a member of Billionaires for Bush, where
he goes by the name of Noah Accountability. We learned how to
observe the punch card ballot counting, such as is used in Shelby
county, and then the optical scan ballot counting, used in
neighboring Miami County.

Jesse was late for the training because he was dealing with a
situation in Greene County. You may have read about the women who
discovered that the ballots were left in an unlocked office all
night. They got volunteers to do a vigil at the office at night, to
protect them. Lights were seen in the office in the middle of the
night. On the previous night, she had gone to the office and found
her 2 volunteers up against police cars, being harassed by the
police. The night of our training, when she came out of the Greene
County Elections Board Office, she found her tires slashed. A day or
two before this she had received a creepy call from a man telling
her where she had been all day, and then that night she was run off
the road by 2 SUV's! Jesse assured us that she had been working on
this issue for a long time, and was well known, but that we probably
had nothing to worry about!

The Miami County recount, held in Troy, began very differently from
most. The Chairman of the Board of Elections started by greeting all
the participants, and then had us all stand and say the Pledge of
Allegiance! Then he explained, in so many words, that this recount
would go forward and we weren't to make trouble. I said, "We'll need
to get up and stand behind the counters to see" because they had us
about 9 feet away, across 3 tables pushed together into a giant
square. He said that we would stay seated, and a discussion ensued.
Finally the Director of the Elections Board agreed that he didn't
mind if we stood behind the volunteer counters.

Then Brian {last name removed}, who is a retired statistician, stood up and
declared that they were not obeying Ohio law, which says that a
precinct or precincts comprising 3% or more of the county's voters
will be randomly chosen and counted by hand. (If a subsequent
machine count exactly matches the hand count, then the other 97% of
ballots can be machine counted.) But they were not randomly picked,
they had been picked already by the Board, which chose one urban,
one small town, and one rural precinct. Of course, the election
offficials paid Brian no mind, but proceeded with the recount.
The reason that random selection is so important is that if election
officials were crooked, they could, under present practice, cheat in
all the precincts but one, and then pick that one for the recount,
leaving all the dirt safely hidden. So the fact that nothing
suspicious was found in a 3% sample chosen by the Elections Board
does not put doubts to rest.

When it was done, there were a total of 1659 votes. When the ballots
were run through the optical scanning machines, the workers cheered
when they saw the correct numbers come up on the machines. But it
wasn't all over yet. Steve Quillen, the Elections Board Director,
took the info from the vote tabulating machines on a CD and took it
into another room to print out the results. This was yet another
step in the process where one cannot feel sure that nothing tricky
is being done. So I asked if I could come with him, and he agreed.
When he got the printout, and we all got copies, Erica Weiss, a
volunteer from Boston, noticed something peculiar.

There was a total of 1660, one vote extra, and yet no candidate, or
even a category like overvote or undervote, received the extra
ballot. Though Brian and I had to leave to go to Shelby County,
Andrew and Erica held their ground, insisting that since the results
did not match the hand count, a full hand count of the county was in
order. The representative of Ken Blackwell told them to forget about
it, that it didn't matter and there would be no hand recount. They
called the legal team in, but in the end they lost, because the
letter of the law said that the hand count must match the
tabulators, not the printout!

Of course this was ridiculous, because the print out is what people
refer to. Though it seems unimportant, the mystery of that one vote
that the software added to the total might be very telling.
In Shelby County, the recount started in a very small room crowded
with all the observers possible: 3 each from the 4 parties! Brian
made his speech about the lack of random selection, and was met with
hostility from a member of the Elections Board, who insisted that it
had all been done according to the Secretary of State's directives.
By badgering him enough, we got him to quote the directive, which
merely said the precinct should be "randomly selected." Although the
Democratic observer next to me, who whispered that she "didn't even
want to be here", also told me that the gentleman was "a local
lawyer who knows everything!", apparently he didn't know the meaning
of random.

With punch cards, you have something called "header cards" which
tell the machine which rotation of the ballot was used in that
precinct. (Which candidate was at the top, which was next, etc.) We
were told to check that they had the correct header card before each
precinct during the machine count. (A clever cheat could use
Precinct 2's header card in Precinct 4, thereby switching Bush and
Kerry votes, for example.) But we were also told that there was no
way that we could read a header card, so basically, that was a
hopeless task.

In the end, it turned out that they didn't have header cards, they
used a computer simulation. So for each precinct, they punched a few
keys to get the new configuration. Was it legit? Probably. Could I
be sure? Of course not.

The Shelby recount went smoothly, with the machine count getting the
same total as the handcount, eventually. (They had to redo the
handcount.) We came back the next day and compiled figures on how
many people voted according to the poll books and the certified
vote. In 11 precincts, only 2 came out the same, and 2 precincts had
significant differences, like 22 and 11 votes. I sent it on to the
legal team.

After the recount was over, we all (8 Green and Libertarian
observers) went to a Chinese restaurant for dinner, and debriefed. I
learned interesting things, like that optical scanning doesn't work
so well if the weather is too humid!

I cannot feel confident that no fraud took place in Ohio, based on
this recount. I do know that massive voter suppression happened,
because I saw a CD filmed on Election Day. It showed the huge lines
of mostly African American voters waiting in the rain for hours.
They were forced to wait because election officials had cut the
number of voting machines, despite huge increases in voter
registration. And over 100 machines were left in storage all day,
despite calls from the polling places for extras.
Many people were told false information about where to vote, and
people who waited in the wrong line were never allowed to go to the
front of the correct line. Instead they had to wait again, and some
people just couldn't do it. People were given provisional ballots
when the officials knew they were in the wrong precinct, which meant
that the officials knew that their ballots would be discarded, even
though they didn't.

I urge everyone to continue working to restore our democracy. You

Here are the directions for what to do after you've printed out the two pdf files:

1. Have a copy shop print the leaflet, and cut to yield 4 double-sided leaflets per 81/2 by 11 sheet. Remember the yield is quadrupled: if you want 1,000 leaflets, have the copy shop print and cut 250 sheets. If you copy the leaflet directly from this email, rather than the attachments, paste each page 4 times onto one page of a Word document. Use margins of .4" around the outside, and gutters of .8" between the four leaflets (the .8" gutters will become .4" margins when the leaflets are cut). Choose a 10-point font or larger and a strong, readable, condensed type (we like AbadiMT-Condensed).

2. Get your friends together and hit the streets. Distribute the flier in popular pedestrian areas during peak shopping times (Dec. 26th...the gift-return day; January 1st-3rd...the long weekend), and peak commuting times during the week. Be confident; the facts are on your side. Enjoy yourself; you're protecting a great democracy. Be energetic; make sure that when January 6th arrives, you and your friends have done all you can to protect voting rights in America.

On December 21, notice of depositions were sent to President George
Bush, Vice President Dick Cheney, Karl Rove and Ohio Secretary of
State J. Kenneth Blackwell to appear and give testimony regarding
the legal challenge of Ohio's elections results in the case Moss v
Bush et al.

But Republican Blackwell's attorney at the Secretary of State’s
office told the attorneys issuing the notice of deposition and
subpoena that Blackwell will not testify under oath. The Republican-
controlled Attorney General's office has labeled any attempt to put
Blackwell under oath, "harassment." Blackwell supervised the
November 2 vote in Ohio at the same time he served as co-chair of
the state's Bush-Cheney campaign.

Most of the stories that I'm posting are coming from other sources than DU. I haven't seen independent discussion threads for many of these articles.

A few times a day, something will catch my fancy and I'll start a new thread for it. Or I might copy one of these articles into an ongoing discussion if it is relevant.

I certainly hope that other DUers will watch this thread and start new discussions when they are inspired to do so.

SANTA FE (AP) - The state Supreme Court on Wednesday denied a
request by two third-party presidential candidates to immediately
order a recount of votes in New Mexico’s presidential race.

The Green and Libertarian candidates had tried to get the high court
to order the recount without requiring them to pay more than $1
million in advance.

The advance payment was mandated by the state canvassing board,
which said it didn’t want taxpayers to end up bearing the cost.

The candidates complained in their lawsuit that the board went
beyond its authority in requiring a $1.4 million payment upfront.

The high court issued a brief order Wednesday denying the
candidates’ petition. It gave no reason for its decision.


A lawyer for the candidates called the ruling a great
disappointment. He says there were many problems with voting
machines and ballot counting in the Nov. 2 election, and a recount
could have pinpointed them.

President Bush won the presidential race in New Mexico by nearly
6,000 votes.

The preliminary results elated Democratic Party officials, and it came only hours after the party scored another victory, when the State Supreme Court agreed with the Democrats' contention that more than 700 newly discovered and erroneously disqualified ballots in heavily Democratic King County should now be considered.

The day's events dealt a serious blow to state Republicans and Dino Rossi, 45, a businessman and former state senator, who had been certified the winner of the Nov. 2 vote after eking out a margin of 261 votes out of almost three million cast. He later won a machine recount by 42 votes.

Official results from the manual recount will not be announced until Thursday, after King County, which includes Seattle, reviews the 723 disputed ballots. Republicans, who fought hard to keep those ballots out of the tally, were already vowing Wednesday to press election officials to consider several hundred other disqualified ballots cast in other counties.

Whatever the final results, they are almost certain to be contested.

"This count, this election, is not over," said Chris Vance, the chairman of the state Republican Party. The Supreme Court, he said, "basically threw the door open to start all over again. I think that's crazy."

He said Republicans planned to "show up at 9 a.m." on Thursday "on the doorstep of every county auditor with people whose votes weren't counted for Dino Rossi."

Under state law, if a second recount reverses the outcome an election, the cost - in this case $730,000 - is then covered by the state. But the Democrats had raised almost $2 million from across the country to finance the effort, with help from Senator John Kerry and Howard Dean.

He added, "It's time for Democrats somewhere to draw a line in the sand and say we are not going to let bully Republican tactics determine who our governor is or how an election is going to be determined."

Dear Mr. Rapp and Mr. Barbian:

I have just reviewed a tape prepared by the documentarian Lynda Byrket of the hearing held by the Hocking County Board of Elections on December 20, and based on that tape I have more questions and concerns than ever about the conduct of your firm in connection with the Ohio presidential election and recount. In particular, I am concerned that your company has operated - either intentionally or negligently - in a manner which will thwart the recount law in Ohio by preventing validly cast ballots in the presidential election from being counted.

You have done this by preparing "cheat sheets" providing county election officials with information such that they would more easily be able to ignore valid ballots that were thrown out by the machines during the initial count. The purpose of the Ohio recount law is to randomly check vote counts to see if they match machine counts. By attempting to ascertain the precinct to be recounted in advance, and than informing the election officials of the number of votes they need to count by hand to make sure it matches the machine count is an invitation to completely ignore the purpose of the recount law.

You as much as admitted that this was your purpose at the December 20 hearing:

Rapp: "Remember: the purpose was to train people on how to conduct their jobs... and to help them identify problems when they conducted their recount... If they could not hand recount the ballots correctly. they would know what they needed to look for in that hand count."

Observer: "Why do you feel it was necessary to point out to a team counting ballots the number of over-votes and under-votes when the purpose of the team is to in fact locate those votes and judge them?"

Barbian: "It's an easy mistake as you're hand counting.,. It's just human error. The machine counts it right... We're trying to give them as much information as possible to help them out.

Interviewer: "You were iust tryinp to help, them so that they wouldn't have to do a full recount of the county, to try to avoid that?"

Barbian: "Right."

It would be very helpful to me, if you could explain what you meant by the above statements, since on their face, they would appear to indicate an effort to thwart the Ohio recount law.
Beyond, this question, and notwithstanding your general assertions that you did not tamper with any votes or violate any law, it appears that notwithstanding the abbreviated hearing of the Hocking County election board, a number of questions and issues regarding Triad's actions remain unanswered. In order to help resolve these doubts and concerns, I would ask that you respond to the following questions.


Additional Ouestions Concerning Hocking County

1. Did Mr. Barbian ask Ms. Eaton or any other representative of the Hocking County Election Board to notify him of the precinct or precincts which were to be recounted by hand prior to the recount on December 13? Were any similar requests made in other counties? If so, which ones? At the hearing, Mr. Barbian stated that he required this information to serve as a "sample." However, the Eaton affidavit appears to indicates that he sought the information on the precinct to be recounted, not a sample precinct.

2. Did Mr. Barbian advise Ms. Eaton or any other representative of the Hocking County Election Board as to how to post a "cheat sheet" to insure that the hand count would match the machine count? Was any similar advise proffered by your staff in other counties? If so, which ones? Again, at the hearing, you indicated that you were merely providing information to the Board, however, it appears that the information was specifically designed to help them avoid completing a full recount by disregarding any valid ballots that were not counted by the machines on election night.

3. At the hearing, Mr. Rapp indicated that you could not comment on any matters beyond giving information the Board of Election workers since it was "interpretational." Please explain what you mean by this, given that the Eaton affidavit appears to attribute specific statements to Mr. Barbian that go above and beyond giving information to the Board.

4. Did Mr. Barbian advise Ms. Eaton or any other representative of the Hocking County Election Board that he would put a "patch" on the election machinery? If so, why? Was any similar advise proffered by your staff in other counties? If so, which ones?

5. Did Mr. Barbian advise Ms. Eaton or any other representative of the Hocking County Election Board that he would be visiting to go over questions that attorneys would be asking in connection with the recount? If so, was any legal information of this nature ever given to representatives of the Hocking County Election Board prior to the December 20 hearing?

6. Please describe any other disagreements you have with the attached affidavit by Sherole Eaton.

7. Please provide me with a copy of your service agreement with the Hocking County Board of Elections and the structure and files of the machines in question.

8. Was Mr. Barbian placed on any administrative or other leave status as a result of his actions relating to the recount or any publicity relating to these matters?


Additional Ouestions Concerning Other Ohio Counties

9. In which counties in Ohio did Triad personnel interact with election machinery after the November 2 election and before the recent presidential recount. Please state the counties and the personnel.

10. Our research indicates that any handling of ballots - which are defined by the Ohio Code to include election machines - may only be done in the presence of the entire election board and qualified witnesses. In addition, any modification of the election machinery may only be done after full notice to the Secretary of State. When your staff made adjustments to the election machinery in Hocking and the other 40 Ohio counties, was the entire election board present? If not, why not? Did you provide any notice of any of the actions you took to the Secretary of State? If so, please provide us with copies. If not, why not?

11. To what extent did Triad provide election results to the Secretary of State's office on or immediately after election day for Hocking or any other county?

12. Please note which if any of the 41 counties Triad services for election matters contacted your firm prior to the recount. Was there any cost associated with your services concerning the recount? If so, how were such costs paid for.

I know that Triad is as eager as anyone to resolve this matter as promptly and completely as possible. Your response to the above questions will go along way towards resolving many of the concerns that have been raised with respect to Triad's involvement in the election.

LISBON - The statewide recount of the presidential election is
coming today {Thursday} to Columbiana County.

John Payne, executive director of the county elections board, said
they were notified Wednesday a total of four representatives - two
for Kerry, one for Bush and one for Badnarik - would monitor today's
recount, which is scheduled to begin at 9 a.m.

The ballots to be counted are of the punch-card variety, made
infamous by the hanging and dimpled chads of the 2000 presidential
election in Florida. Sixty-nine of Ohio's 88 counties still used
punch-card ballots.

...the four elections board members - two Democrats and two
Republicans - are to count the ballots by hand. Only three will be
on hand, however: Democrats Dennis Johnson and Dr. Anthony Rich, and
Republican Jerry Ward. The other Republican, Al Fricano, had a prior
commitment.

It was easier to walk into the Franklin County Board of Elections to witness the recount of votes than it was to get into a preview screening of "Finding Neverland." I totally expected to have to open my bag and be scanned by a metal detector when entering the building.

Once we had established that out of 360 punchcards, 4 were overpunched, 7 were underpunched, one vote was cast to the Libertarian ticket, 78 people found it necessary to continue the abuse started in 2000, and 270 absentee voters wanted change and believed John Kerry was the best bet for a better future. It was my impression the Republican party members at our table weren't thrilled with that result but if they were expecting to find votes for their boy in Franklin County, they were living in a bigger dream world than those who wrote-in Mickey Mouse. Oh, wait! Republicans have a different definition for reality than the rest of us, correct?

Mickey Mouse, Martin Sheen and Lewis Fahrakhan tied with 2 non-valid votes. Jessie the Body Ventura received 2 votes proving there are still hardcore WWF fans out there. Butch Davis won 2 votes so if you know him, let him know. There's always next time, Butch. A couple of people wanted a Clinton back in the White House but only one bothered to specify Bill. I'm stunned Mickey Mouse got one more vote than Kermit the Frog! C'mon people! It ain't easy being green but he doesn't give up! Just like David Cobb who, by my very UNofficial count received 20 write-in votes as a valid write-in candidate. Ralph Nader captured the hearts of 96 faithfuls. (Again, my numbers here are very UNofficial.)

Voters need to question why some counties use one method and others a different one. We now know how inadequate the Ohio code is concerning recall procedures.

local political group are still holding out hope the ultimate result
that kept George W. Bush in the White House can be reversed.

To that end, members of Democracy for America-MA say they will let
their pens do the talking leading up to the Jan. 6 challenge vote of
the Ohio vote, which would be triggered by support by one U.S.
senator and one congressman.

Democracy for America-MA will set up a subcommittee focused on
opposing the war in Iraq, election irregularities and reform,
creating grassroots support, getting more media coverage and backing
a separate Impeach Bush uprising.

"The grassroots movement that started with the election woke a lot
of people up," said Laurie Lee of Framingham, the Web master for
DFA. "If you can teach people to form their own groups and take
their own actions, you have a much better chance of success.

A disturbing story has been widely circulated that a vote for Bush
was the default choice in the software of electronic voting machines
in a number of states. By definition, “default” settings are built-
in by the manufacturer to make sure their programs work properly,
and can be changed by the user. Some examples of default settings
on a home computer are screen savers, type face, and screen resolution.

According an article by Ann Harrison, posted at
http://www.counterpunch.org/harrison12082004.html

in certain counties in Ohio, Florida, Pennsylvania, Texas, and New
Mexico where touch screen voting machines were used, there have been
complaints from voters who selected Kerry on the touch screen and
saw their votes change to Bush on a summary screen. In addition,
there was a specific problem with the Sequoia AVC Edge machine (not
used in Ohio) where voters actually saw preselected default choices
presented to them.

With touch screen machines, it is possible to set up a default
choice for Bush that would not be seen by the voters. Their votes
would be automatically cast for Bush unless they successfully
overrode the default choice of the computer. Likewise, if they
deliberately chose not to vote for president, their votes would be
counted for Bush.

Mahoning County was by far the largest county in Ohio where touch
screen voting machines were utilized. According to a report by the

Mahoning County utilized ES&S Ivotronic touch screen machines. The
administrative password for these machines was reported on the ES&S
website itself.

By default, the password is 1111. According to
http://savethevote.com/issues/glitches.htm this password cannot be
modified easily, which would mean that anyone who knows the password
could change other default settings on the machines.

A press release was sent out today to the press and public this morning.

The video footage provides a first hand glimpse of what transpired
in Franklin County on Election Day, only in heavily leaning
Democratic precincts, including unexplained voting machine
shortages, organized campaigns directing voters to the wrong polling
places, malfunctioning voter tabulation equipment, election worker
confusion and incompetence, and a host of other problems. However,
as detailed in an official affidavit by Richard Hayes Phillips, a
geomorphology Ph.D. from University of Oregon, the extent of voter
disenfranchisement was systematic and widespread in African American
precincts throughout the state. Dr. Phillips sworn testimony read:

"For the second Presidential election in a row African American
voters have been subjugated to second class citizens through
systematic efforts by Republicans to suppress, intimidate, and
disenfranchise our vote," said Rev. Bill Moss, the original
Plaintiff in Ohio, and founder of the Center for Freedom and
Justice. "Whether its Katherine Harris or Kenneth Blackwell, the
purpose is the same: do everything in their power to ensure George
W. Bush becomes President. If those in power are willing and able to
thwart democracy and abuse the civil rights of American voters,
right in the face of the press and public, what won’t they do? I am
contesting this election because tyranny, particularly in the guise
of democracy, is our civic duty to fight."
