Ohio electoral fight becomes 'biggest deal since Selma' as GOP stonewalls
by By Bob Fitrakis, Steve Rosenfeld and Harvey Wasserman
December 22, 2004

COLUMBUS -- As Republican officials stonewall subpoenas and subvert the recount process, Rev. Jesse Jackson has pronounced Ohio's vote fraud fiasco "the biggest deal since Selma" and has called for a national rally at "the scene of the crime" in Columbus January 3.

Another major national demonstration will follow in Washington on January 6, as Congress evaluates the Electoral College. Should at least one US Representative and one Senator challenge the electors' votes, a Constitutional crisis could ensue....

<snip>
On December 21, notice of depositions were sent to President George Bush, Vice President Dick Cheney, Karl Rove and Ohio Secretary of State J. Kenneth Blackwell to appear and give testimony regarding the legal challenge of Ohio's elections results in the case Moss v Bush et al.,,,

<snip>
In a December 21 conference call with activists from the around the US, Jackson said he has urged Senators Kerry (D-MA) and Hillary Clinton (D-NY) to stand with US Representatives who intend to challenge the Electoral College's expected approval of George W. Bush for a second term. A challenge by US Representatives in 2000 failed because no Senators would join their motion...

<snip>
In the Miami County town of Concord, certified returns show that all but 10 registered voters cast ballots on Election Day. But the election challenge team has already identified more than 10 registered Concord citizens who did not vote, an incongruity that points to election fraud...

Many, many, other good (and new to me) pieces of information. Apologize if dupe.

that he is urging Kerry and Hillary to contest---wow! I'm smiling. I'm sure Kerry is watching all of this and I hope Hillary is too.

4. How dare Blackwell refuse to answer under oath!
I wonder why? If any of you reading this are in Ohio prisons, start planning a nice warm welcome for Ohio secretary of State and Co Chair b*#*/c*#*#* '04.
Remember how he disenfranchised millions of low income voters, for his own personal gain.

14. Now, now, Mod Mom,
We must be grateful for small mercies.

Most neocons clearly consider being forced to tell the truth under pain of legal sanction constitutes a vicious degree of harrassment, nay, a cruel and unusual punishment? And you have the gall to complain about Abu Ghraib and Guantanamo! Shame on you! (Yes, ironical)

24. And to put a public official,
a public servant, under oath, when speaking about the record of his performance of his professional duties, simply cries to heaven for vengeance, doesn't it... Why, oh why, should he be considered accountable?

6. Deposition notices sent to Bush, Cheney, Rove & Blackwell...
If they refuse to appear, can't they be held in contempt of court? What are the legal ramifications here?

9. Notices to take deposition are issued from the attorney for plaintiff(s)
Edited on Wed Dec-22-04 11:37 AM by Straight Shooter
They are not issued by the Court. If the attorney wishes to file a motion to compel appearance, then said attorney goes to the Court and requests a hearing on the matter. At that time the Court may dismiss or grant the motion, and, following that, then the notice to take deposition must be heeded.

I wonder which Court is going to stick its neck out and tell Little Boots and his gang that they must appear to answer questions under oath.

It isn't going to happen in this scenario. These are just procedural steps being taken to fulfill the requirements of a lawsuit that an attorney must follow to show he or she is diligently acting in the best interest of his/her client(s).

Any attorneys on board, feel free to correct my logic or my terminology.

edit: possibly the argument can be convincingly made that Blackwell should be deposed under oath. But Little Boots is poison; touch him and you die politically.

29. Well, you know
if a soldier can stand up and ask Rummy, in front of almighty God and Country and the MSM, why he and his comerades have to dig through garbage to find materials for armour, there's always hope that SOMEone will have the sanity and the cajones to put their political career on the line and do what's right. It's high time someone held dubya's "little boots" to the fire. Maybe - just maybe - someone will.

7. My fav line:
“Maybe this (the explanation of the Ohio vote) is much closer to the surface than anybody thinks,” said Pete Pectarsky, a lead challenge attorney. “It doesn’t add up. If everything was above board, why are they hiding everything? They could bury people in the details… Okay, look at these records. Look at those.”

Where's that thread asking "What ere they hiding?" I need to kick that. This definitely should be our battle cry.

11. Kick!
Made my day. I was wondering what was happening in Ohio. I never thought I'd say this, but right now I wish I was a lawyer :-)

I'm wondering if anyone over there, in a precinct that has "completed" its recount, had thought of ambling over to that county's BOE and asking, "Now that all this recount stuff is over here, could I take a little look at those poll books?" Catch them off-guard, without causing a call to Ken B.? Armed with a digital camera? Just an idea...

15. "Harassment"
But Republican Blackwell's attorney at the Secretary of State’s office told the attorneys issuing the notice of deposition and subpoena that Blackwell will not testify under oath. The Republican-controlled Attorney General's office has labeled any attempt to put Blackwell under oath, "harassment."

18. I know this might make me sound like a radical crazed extremist,
which I may be anyway,
but
I think that if the inaugaration does take place:
We have no other alternative other that to take over the White House--MILLIONS of us storming the WH and taking over.

Sounds nuts, but that's the only way I see a change happening---Is it called a Coup D'Etats?

I am very, very afraid of 4 more years.....

26. We need to exhaust the avenues that we have first....
Even if it means that the revelation comes after the inaugaration. If by some miracle, it actually happens before mid-January, GREAT! But, realistically, I think we should give it 6 months or so before resorting to that measure. Which I agree, would be definitely required and justified. I, too, am terrified not only of the next four years, but the decades that will take to undo the harm and my unborn children growing up during those decades.

25. And look at that list of lady lawyers...
I couldn't help but notice that the volunteer attorneys helping out on the Dem side in the Ohio litigation are primarily women. Sorry, just a bit of professional and gender pride.

I'm going to add my name to the list of helpers. This is way too important to leave it for others to do.
