Tuesday 12/28 Election/Fraud/Recount thread
In order to organize and document I thought it would be a good idea to have a daily thread to place items related to the recounts/fraud. This also make it easier to "catch up" when we are away from the computer for a while.

Please help us. If you see something that isn't here post it with a link to the thread and a thanks to the author. Thanks to everyone who is helping in this project.

Iraq tells U.S. election fraud is unacceptable


Ohio Republican election officials ignored a subpoena Monday and Ohio Secretary of State Kenneth Blackwell refused to appear at a deposition challenging the legitimacy of the election. This described in an article from The Free Press, entitled: Ohio GP election officials ducking subpoenas as Kerry enters stolen vote fray. This as Kerry filed, as expected, legal action to preserve voting records that may be used as evidence of fraud (see also: Conspiracies theorized, or conspiracies invoked?).

The piece describes:


* Voters testifying they received punch-card ballots pre-punched for Bush.
* A notarized affidavit from a woman stating a machine in her Democratic Precinct did not have a cartridge, which makes it likely none of the votes cast on it were recorded.
* Miami County, where a 98.5% voter turnout was recorded, yet canvassing of the precinct debunks a turnout of this size.
* Requested voting records came directly from a private firm.
* Several affidavits of “vote hopping,” where machines were preset to record a vote for Bush as proven by the fact that machines showed a vote for Bush before the voter voted.
* How Ohio touts, as evidence of fairness, that Democrats were involved in overseeing the counting of ballots, yet these same Democrats are beholden to Secretary of State Blackwell for their jobs.
* The certainty that several members of the Congressional Black Caucus plan to challenge the validity of the electoral votes when the Electoral College meets on January 6, but so far a required Senator has not committed to the challenge.

Kerry Files Motion to Protect Ohio Vote Evidence

Monday 27 December 2004

This afternoon, an attorney representing the Kerry/Edwards presidential campaign filed two important motions to preserve and augment evidence of alleged election fraud in the November election. The motions were filed in the matter titled Yost et al. v. Delaware County Board of Elections and J. Kenneth Blackwell (Civil Action No. C2-04-1139) with the U.S. District Court for the Southern District of Ohio. The document is titled "Motion Of Intervenor-Defendant Kerry-Edwards 2004, Inc. For A Preservation Order And For A Leave To Take Limited Expedited Discovery."

The purpose of the motions is twofold: A) To preserve all ballots and voting machines pertaining to the Yost matter for investigation and analysis; and B) To make available for sworn deposition testimony a technician for Traid Systems, the company that produced and maintained many of the voting machines used in the Ohio election. The technician has been accused of tampering with the recount process in Hocking County, Ohio, though other counties are believed to have also been involved. Any officers of Triad Systems who have information pertaining to said tampering are likewise subject to subpoena for sworn deposition testimony.

If the judge in this case allows these motions, and these individuals are served with subpoenas for deposition, the information disclosed under oath could have a major effect on the case. Likewise, judicial approval of these motions will open the door to forensic analysis of both the ballots cast and the machines they were counted on. If tampering took place, such an analysis could reveal it.

The document filed in Ohio reads as follows:

Pursuant to Federal Rule of Civil Procedure 26, Intervenor-Defendant Kerry-Edwards 2004, Inc. hereby moves this Court for an order preserving materials from the 2004 presidential election and for leave to take a limited number of depositions on an expedited schedule. The depositions and preservation order sought by Intervenor- Defendant Kerry-Edwards 2004, Inc. are the same as those sought in the motion filed on December 23, 2004 by Defendants NVRI, Cobb and Badnarik. Intervenor-Defendant Kerry-Edwads 2004, Inc. hereby adopts the memorandum and proposed order filed by the Defendants in support of its own motion.

The filing by the Kerry/Edwards campaign is significant. The Yost matter deals with a recount of the votes cast in Ohio during the election. In order for a judge to consider such a motion, the plaintiff must be able to prove irreparable harm in the matter at hand, and must also be able to prove a significant chance that the case will succeed on the merits. The stumbling point for the Green Party and Libertarian Party in this matter has been the ability to prove that potential for success, because no recount would deliver an Ohio victory to them. A recount could very well deliver Ohio to Kerry, thus fulfilling the success on the merits requirement.

In the end, this filing amounts to a "Me, too" from the Kerry/Edwards campaign. This case would not exist in any form without the dedicated efforts of Green Party candidate David Cobb and Libertarian Party candidate Michael Badnarik. Though the inclusion of Kerry into this matter strengthens the case significantly, Cobb and Badnarik deserve the lion's share of credit for carrying the matter to this point.

Attorney John Bonifaz serves as general counsel for the National Voting Rights Institute, and is co-counsel for Cobb and Badnarik in this matter. Reached for comment on this Kerry filing, Bonifaz said, "We are pleased that the Kerry Edwards campaign has joined our motion to preserve all of the ballots and election machinery in the presidential election in Ohio and to investigate the potential tampering of voting machines by Triad Governmental Systems, Inc, prior to the start of the recount. We welcome the Bush Cheney campaign joining our motion as well. The integrity of this recount is at stake. All candidates ought to join together in ensuring the proper counting of every citizen's vote."

If you saw a real live presidential candidate this year, you must live in one of those "battleground states." You're lucky. Most of us never laid eyes on a candidate except on television.
In fact, most Americans are as likely to see a presidential candidate in the flesh as they are to see Elvis walk out of a Johnny Rockets hamburger stand. Despite being called a national campaign for the presidency, it really isn't national anymore. These elections have become a series of mini-campaigns in specific states calibrated to win an electoral college vote. The candidates rush back and forth between such contested states as Pennsylvania, Ohio and Florida. They act as if they're running for president of the battleground states rather than of the United States.

Since your tax dollars are being used to fund the presidential campaign, you have a right to expect the candidates to run a national campaign and maybe show up in your state. After all, when they received their party's nominations, the Bush and Kerry campaigns each pocketed $74.6 million in public funding for the general election campaign. They took that money and headed straight for the battleground states.

Republican Party leaders yesterday laid the groundwork for a possible challenge of Democrat Christine Gregoire's victory over Dino Rossi in the hand recount for governor, claiming a number of irregularities in the way King County handled ballots.

But state Republican Chairman Chris Vance said a decision hadn't been made about whether to ask either a court or the Legislature to reject the results of the hand recount that wiped out Rossi's win in two earlier counts.

That decision will be made by Rossi, Vance said.

Turn up the heat. Let Senator Schumer know we want him to object to
certification of the Electoral College vote. Objecting to
certification would be a mandate for a government by we, the people.
Objecting to certification would be a mandate for reliable,
transparent voting technology with equal access to voting for all.

On January 6th, Congress meets to certify the Presidential election.
If even one House member and one Senator object to the electoral votes

15. Sen. Chuck Schumer is a logical choice
to challenge certification. I thought of him even before reading this post. He's a decent man, his senate seat is pretty secure, and yes, I already called his office yesterday, and urge others in New York to do so.

COLUMBUS -- Ohio Republican election officials thumbed their noses at a subpoena Monday, December 27, as Republican Secretary of State J. Kenneth Blackwell refused to appear at a deposition in an election challenge lawsuit filed at the Ohio Supreme Court. Meanwhile John Kerry is reported to have filed a federal legal action aimed at preserving crucial recount evidence, which has been under GOP assault throughout the state.

President George Bush, Vice-President Richard Cheney and White House Political Advisor Karl Rove received notice that they will be deposed Tuesday and Wednesday, December 28 and 29. The trio’s Ohio attorney, Kurt Tunnell, so far claims his clients have not been properly served. Under Ohio law, the Republican-dominated Ohio Supreme Court is responsible for serving the three with subpoenas.

Meanwhile, the Election Protection legal team has collected new statements under oath describing more voting and vote-counting problems on November 2.

"Triad Governmental Systems, Inc. services voting tabulators via modem" is absolutely breathtaking to us in the Information Technology field. Triad non-chalantly used this modem method to reset machines in preparation for the Ohio recount. No doubt that this is a practical short-cut: Makes sense; it saves gas, time. In fact, this is the same mechanism that I -- a computer consultant -- use to support 200 computers spread out across North Carolina.

It is now public record that Triad "legally hacked" into Van Wert County, Ohio on December 9th, and other counties on different dates in preparation for the recount. We, at the conspiracy farm, hardly feel righteous indignation.

The big picture: Everything is fine until you consider that passive modem-access means that these machines have been available for remote re-configuration for months if not years. We know this because nothing special was done (like Triad calling Van Wert's elections board) to prepare for this recent remote connectivity. The connectivity has been in place for legitimate purposes and we do have a suggestion that it is against the rules for this remote login facility to be used for illegitimate purposes.

No guarantees, but we do have anti-conspiracy rants that make us all feel better.

According to the prestigious Software Engineering Institute at Carnegie Mellon University, here is all it takes to commit a crime on the Internet or modem access point (http://www.cert.org/archive/pdf/homeusers/mmo.pdf):

Means - the tools are there, nicely catalogued and ready to go.
Motives - with so much on the Internet, motives are there, whether the priority is money, curiosity, politics, or power.
Opportunity - there are many, many access points to the Internet, most inexpensive and some free.

In fact, go to http://www.chuckherrin.com/hackthevote.htm to find out how a Republican does it (for educational not criminal purposes). Also, let's not forget about our open Wheel of VOTER Challenge II: 2K in which no one has been able to contradict a popular FTP hack.

Long gone are the days of users and administrators knowing and trusting each other. Users on the Internet are anonymous, and their number grows daily. O.K., we now have the means (internet), motive (politics), and opportunity (modem-accessible) to hack into a county's central tabulator. Combine that with a close election in which only a few key battleground counties needed to be manipulated and voila: Mr. Bush and the War and Church machine.

We keep hearing there is no evidence of widespread fraud. But have we heard there was no fraud at all?

We hear there were election problems to the tune of 57,000 GAO reports but we are assured they were not enough to turn the election.

We hear there is no proof that these machines were tampered with. These are the same reverse assurances gamblers get when they use Video Poker machines.

Maybe we should ask Buddy Therrell, Nathan Ramsey, Timothy Scott Guthrie and Kevin Wade Lemmonds who have been charged with possession of illegal gaming machines. "Besides the machines, police confiscated 18 illegal circuit boards from one of the locations."

But don't listen to me, I am just a video poker conspiracy nut.

We now see that everyone on the internet has the means, motive, and opportunity. Believe me, my Mom -- the John Birch Republican
(http://www.jbs.org ) -- would have hacked the election if she could have. But luckily the internet is a bastion of pure intents and motives comprised of folks much better than my Mother. Hackers were just trying to save America from itself, right? We certainly don't want to wander down that dark scary alley of world peace, high employment, fair wages, lower abortion rates, cleaner air, cleaner water, respect.

We are much better off now. If this were a murder case, we would be pushing for First Degree Murder. Manslaughter is reserved for reasonable doubt. These machines should get the death penalty. The hackers and vote-riggers are traitors. Now excuse me while these loose votes and I go frolicking in a meadow.

I keep hearing Santa in Rudolph the Red-Nosed Reindeer saying to the Senators, "c'mon Dancer, c'mon Daschle." Contest the results NEXT TUESDAY. America needs a hero, red nose and all.

Politics is a game played by rules. And the most important rule regarding close elections is that you don't win by being conciliatory during the recount process.

Indeed, the only way a candidate who trails on election night ends up taking the oath of office is by refusing to concede and then confidently demanding that every vote be counted - even when the opposition, the media and the courts turn against you.

That is a rule that Al Gore failed to follow to its logical conclusion in 2000, and that John Kerry did not even attempt to apply this year. Both men were so determined to maintain their long-term political viability that they refused to fight like hell to ensure that the votes of their supporters were counted.

That refusal let their backers down. It also guaranteed that, despite convincing evidence that the Democrat won in 2000, and serious questions about the voting and recount processes in the critical state of Ohio in 2004, George W. Bush would waltz into the White House.

I would caution the media not to read more into what the Kerry-Edwards campaign has said than what you hear in the plain meaning of our comments. There are many conspiracy theorists opining these days. There are many allegations of fraud. But this presidential election is over. The Bush-Cheney ticket has won. The Kerry-Edwards campaign has found no conspiracy and no fraud in Ohio, though there have been many irregularities that cry out to be fixed for future elections. Senator Kerry and we in Ohio intend to fix them. When all of the problems in Ohio are added together, however bad they are, they do not add up to a victory for Kerry-Edwards. Senator Kerry's fully-informed and extremely careful assessment the day after the election and before he conceded remains accurate today, notwithstanding all the details we have since learned.


At the time this statement was made, it was indeed read by many activists as charting a new course for the Kerry-Edwards campaign's post-election stance -- one in which the ticket would ascend to their presumably rightful places if presently-unanticipated events unfolded which warranted doing so, but that otherwise neither Kerry nor Edwards expected to nor were willing to take any great pains, or even any pains at all, to uncover voting fraud in Ohio. The belief, in short, was that Kerry and Edwards were checking out entirely from any concerted effort to reverse the results of the November election.


Section 2: The Six Incontrovertible Maxims of the Vestiges of the Kerry-Edwards Campaign, Post-Election

A detailed analysis of Kerry-Edwards campaign statements since the election, however, reveals that the campaign's present stance is far more nuanced than it would at first appear. The Advocate asserts, for example, that regardless of any statements made by Kerry, Edwards, or their legal/political agents, the following six maxims are and will remain unalterably true throughout the post-election phase of the 2004 presidential race:

1. The Kerry-Edwards ticket will seek to ascend to the Presidency and Vice-Presidency if and when events warrant them seeking same, and they are assured of significant but localized, or at the very least manageable, political repercussions...

EDITORIALS
As we learn that the election recount will cost Ohio taxpayers something in the neighborhood of $1 million, we wonder again about the self-serving individuals who have attempted to stir election turmoil in Ohio for their own personal agendas.

Sadly, well-meaning people, fueled by incessant Internet repetition of claims that have been debunked and/or explained over and over again, are viewing the Ohio election as a disgrace for democracy and claiming that the the election is a fraud.

Our editorial last week decrying the situation and the role of individuals who are more interested in their own image and personal gain than they are in the democratic process has promoted critical e-mails from across the country.

ACTION ALERT: NM Counties to Begin "Clearing" Voting Machines?

Rick Lass, the Green Party attorney, is reporting they received a letter stating that Bernalillo County plans to start "opening and clearing" the voting machines used on Election Day, and inviting them to be present. The letter gave Monday, December 27th, as the start date for this operation.

A call by Lass to the County warehouse was answered by a gentleman who said they were waiting for final approval from the Secretary of State's office. He also said seven other counties were planning to "clear" their machines this week.

Lass said,

Obviously, this would have huge repercussions on any kind of meaningful recount.

Our lawyers are looking at legal options, such as asking for an injunction until all our legal avenues are exhausted. In the meantime, could you call your county clerks first thing in the morning and find out if and when your county is planning on clearing the machines? If soon, please ask them not to, and explain that the recount is still going to happen, or at least it is still a possibility. If the clearing is going forward, please try to find someone to go down to where the machines are kept and observe the process.

Monday afternoon, John Kerry's lawyers joined John Bonifaz in two important motions to preserve and augment evidence of alleged election fraud in the November election, stemming from Triad's actions in Hocking County.

But why are Kerry's lawyers bothering to intervene in this (or any other) case? Last night, Kerry's attorney Dan Hoffheimer told Keith Olbermann his investigation is over:

"There are many conspiracy theorists opining these days. There are many allegations of fraud. But this presidential election is over. The Bush-Cheney ticket has won. The Kerry-Edwards campaign has found no conspiracy and no fraud in Ohio, though there have been many irregularities that cry out to be fixed for future elections. Say what? I could rant at length about this betrayal.

But let me zero in on the crux of the matter: legally speaking, when do "many irregularities" (Hoffheimer's own phrase) rise to the level of "fraud" and ultimately "conspiracy"?

There are many answers to that question, but they basically fall between two poles.

Absent evidence of outright and widespread voter fraud to hand George W. Bush Ohio in the November presidential election, this week's recount should be the chance for challengers to say, "Enough is enough."

We've said it many times before, but we've got to repeat it here: There are votes in every election that aren't accurately counted. Out of millions of ballots, it is a statistical impossibility, so long as man is responsible for creating and maintaining the system that counts the ballots, for everything to be absolutely perfect in every election.
That does not matter if the ballots are paper ones counted by hand or electronic ones tallied by computers, from punch cards to touch screens.

Does that mean every vote doesn't count?

No. Every elector must exercise the privilege as an American to go to the polls and cast ballots with the reasonable expectation that their vote will be counted.

Ohio recount over, shows Bush, Kerry few hundred votes closer


TOLEDO, Ohio -- The presidential recount in Ohio finished Tuesday, shaving a few hundred votes off President Bush's six-figure margin of victory in the state that gave him the election.


The recount shows Bush winning the election by 118,457 votes over John Kerry, according to unofficial results provided to The Associated Press by the 88 counties. Lucas County, where Toledo is located, was the last to finish counting, with its results reported Tuesday coming about two weeks after the recount started.

The Kerry campaign supported the recount, saying it did not expect the tally to change the election winner. Supporters of the recount requested by two minor party candidates said they wanted to make sure that every valid vote was counted.

If the November 2 election is accepted by Congress on Jan 6 this may be the end of representative government in America! Call and email your elected representatives to DEMAND a full investigation and national revote (on nonfraudulent paper ballots with no machine counting) of this most shameful episode in our history. Election fraud is a felony and is treason. Everyone involved, at whatever level, should be prosecuted and punished to the maximum penalty allowed by law! If the Ukrane citizens can force an honest new election to correct massive election fraud, why can,t we do it too? We need a revote with full and proper international monitoring of all political races in every state to restore honest elected government in our nation.

If Bush and the Republicans really did win the last election then they have nothing to fear from a revote as it will establish their legitimacy. If,on the other hand, the growing mountain of evidence of massive and organized election fraud is accurate then the will of the people will be heard. Any American, Democrat, Republican, Green or whatever who would tolerate rigged elections is betraying every principle of this nation and is guilty of treason.
Research this issue and tell everyone you know to get involved before it is too late!

As most informed people know, Ohio was the “battleground” state that effectively delivered the 2004 election for George W. Bush. Most people know that the Bush margin was narrow. Probably most people do not know that it was nonexistent.

Dr. Richard Hayes Phillips, a scientist at the University of Oregon, is among a growing number of well-credentialed experts who have become alarmed at evident anomalies in our nation’s vote-counting process. Professor Phillips has studied Ohio results for the past several weeks and has posted an affidavit about the matter.

Phillips is a hydrologist with a Ph.D. in geomorphology, “well-versed in standard techniques of statistical analysis, with special expertise in spotting anomalous data,” according to the sworn statement. He has followed up the affidavit with an updated report.

He's the "War President." He's the highest ranking public official. What do these two statements have in common? They are both actual legal arguments against testifying under oath. The first was used by Bush to avoid being caught for perjury. Now Secretary of State Kenneth Blackwell, Ohio's leader in foot dragging regarding investigation into Ohio's less than stellar election performance, says he shouldn't have to testify under oath either:


COLUMBUS, Ohio (AP) - Secretary of State Kenneth Blackwell has requested a protective order to prevent him from being interviewed as part of an unusual court challenge of the presidential vote.

Blackwell, in a court filing, says he's not required to be interviewed by lawyers as a high-ranking public official, and accused the voters challenging the results of ``frivolous conduct'' and abusive and unnecessary requests of elections officials around the state.

Citing fraud, 37 people who voted for president Nov. 2 have challenged the election results with the Ohio Supreme Court. The voters refer to irregularities including long lines, a shortage of voting machines in minority precincts and problems with computer equipment.


Gee, why would old Kenneth suddenly be worried about having to testify under oath? Could it be that a presidential candidate who barely lost a questionable Ohio vote has filed in federal court? Although you'd never know it due to the media coverage the SCLM is not giving it, the Kerry/Edwards campaign has joined the legal proceedings in Ohio:

Legal Fight Over Recount Could Continue For Weeks

SANTA FE — Green and Libertarian presidential candidates are continuing their legal fight for a ballot recount in New Mexico and plan to take their case to the state Court of Appeals.

Lawyers for Green Party candidate David Cobb and Libertarian candidate Michael Badnarik said they will ask the court to order a recount of presidential ballots in the Nov. 2 general election.

However, it potentially could take weeks or even months for the Appeals Court to issue a decision.

The candidates are appealing a decision by District Judge Carol Vigil in Santa Fe, who ruled against them two weeks ago.

The candidates are fighting a decision by the state canvassing board to charge them in advance the full cost of a statewide recount — an estimated $1.4 million. They have paid the state a deposit of $114,400 and contend that's all state law initially requires to obtain a statewide recount.

When Mahatma Gandhi said, "First they ignore you, then they ridicule you, then they fight you, then you win," he could have been talking about Ohio in 2004. Secretary of State Kenneth Blackwell, who presided so triumphantly over the granting of Ohio's 20 Electoral votes to President Bush on December 13 even though the recount had not yet started, has gone past ignoring and ridiculing the recount movement. Now that his house of cards is tumbling down, he is starting to fight back.

In a story in yesterday's Akron Beacon Journal and the online version of http://abcnews.go.com/US/wireStory?id=363968&CMP=OTC-RSSFeeds0312">ABC News, it was reported that "Secretary of State Blackwell requested a protective order to prevent him from being interviewed as part of an unusual court challenge of the presidential vote.... If Secretary Blackwell doesn't want to submit to cross-examination in court, and refuses to answer the detailed questions about the Ohio election sent to him by Rep. John Conyers, then how will we get to the bottom of what happened in Ohio on November 2nd? As reported in the Black Commentator, Rep. Conyers' letter asked Secretary Blackwell, among other things, why he had not investigated criminal acts committed on Election Day, such as intentionally misleading voters about the location of their polling place, thus increasing the number of provisional ballots found invalid.

Those of us particpating in the county recount process have seen Secretary Blackwell's presence in several key recount decisions so far. For example, in Fairfield County, a full recount should have been ordered when the 3% test sample did not match the official vote totals. Instead, based on what county officials said was a recommendation from Secretary Blackwell's office, the recount was "suspended" so that they would not have to do a full recount. In Champaign County, a precinct signature book, necessary to verify that the number of votes that were cast, will not be made available to our recount observers until after January 10 (four days after Congress has counted the Electoral College votes on January 6), per orders of the Secretary of State.

UPDATE: According to a post on Democratic Underground, the attorneys of record (Lowell Finley, John Boyd, David Garcia) filed an appeal to the original suit in District Court (different from the Supreme Court case and still open for appeal) and sent letters to the SoS and each of the 33 county election directors to make sure the machines could not be purged. As long as there's an active recount request, it's illegal to erase the previous election without a court order.

In addition, an ABC News affliate is reporting :

Green and Libertarian presidential candidates are still pursuing their legal fight for a ballot recount in New Mexico and plan to take their case to the state Court of Appeals. Lawyers for Green Party candidate David Cobb and Libertarian candidate Michael Badnarik say they intend to file a notice of appeal with the court.


Also, the Bernalillo County Clerk has now stated that the voting machines won't be cleared until the Supreme Court rules on the recount. Apparently it's all in the lawyers' hands now, so it's been requested that we stop calling county clerks and the secretary of state's office at this time. As it stands, the machines are being protected until the courts respond to the recount suits.

The Ohio Recount officially finished today without any major changes. The final recount tally gave George W. Bush 118,457 votes more than John Kerry, or a margin of approximately 318 votes less than the total certified by Ohio Secretary of State Kenneth Blackwell on December 6th. The 88 county statewide recount finished when Toledo's Lucas County completed its recount earlier today.

New Mexico Recount Goes Back to Court

NEW MEXICO -- December 28 -- Attorneys for Green Party presidential candidate David Cobb will file a Notice of Appeal on Tuesday from a District Court decision which rejected Cobb's request to start the New Mexico recount without paying the entire cost of it in advance. Last week the New Mexico Supreme Court declined to hear the case. Since the Supreme Court did not rule on the merits of the case, it can be heard by the New Mexico Court of Appeals.
The Notice will be filed on behalf of Cobb and Libertarian presidential candidate Michael Badnarik who are both seeking a recount of New Mexico's presidential vote. The candidates paid the state a deposit of over $100,000, and say that New Mexico law does not require that the entire amount of the recount be paid in advance.

"We believe the law is on our side and look forward to a full recount of the presidential vote. There are still many unanswered questions about provisional ballots, missing votes and the integrity of voting machines which don't produce a paper trail. The people of New Mexico deserve to know that their votes will be counted fairly and accurately," said Cobb.

On Tuesday, Cobb and Badnarik's attorneys will also be notifying the New Mexico Secretary of State, the Attorney General and the Clerks for all of New Mexico's 33 counties, that the Notice of Appeal prevents them from "opening and clearing" voting machines throughout the state.

"Although, generally, voting machines can be cleared 30 days after the official certification of the vote, New Mexico law is clear that this can't happen when a recount has been initiated. The candidates have paid the deposit for the recount and we expect it to go forward, so any adjustment to the machines would be clearly inappropriate until the recount has been concluded," said Lowell Finley, one of the attorneys representing the candidates.

Kerry Joins Cobb's Request to Preserve Evidence in Ohio Recount

OHIO - December 28 - The Motion filed by Green Party presidential candidate David Cobb last week, asking a Federal Court to preserve a wide range of evidence to ensure the integrity of the Ohio recount, was officially supported by the Kerry-Edwards campaign today.

"Senator Kerry filed a Motion today which essentially says nothing more than 'me, too' to our filing from last week," said Blair Bobier, Media Director for the Cobb-LaMarche campaign.

Cobb's attorneys on Thursday had filed a Motion for a Preservation Order and for Leave to Take Limited Expedited Discovery in the U.S. District Court for the Southern District of Ohio where recount litigation is pending. The Motion, filed on behalf of Cobb, Libertarian presidential candidate Michael Badnarik and the National Voting Rights Institute, requested that voting machines and election records be preserved.

"We welcome Senator Kerry's belated interest in ensuring the integrity of the Ohio recount. This effort, initiated by the Green and Libertarian presidential candidates, has been focusing on the integrity of the election process and not on the outcome. In order to trust the election results, we have to trust the process. All presidential candidates, including George W. Bush, who are committed to an open and accountable voting system should demand an investigation into an election clouded by serious allegations of fraud and suppression," said Bobier.

The Ohio recount has been plagued with almost as many problems as the underlying presidential election. One of the more notable instances took place on December 10, in Hocking County, Ohio, when a representative from Triad Governmental Systems, Inc. reprogrammed a computer used for tabulating votes and instructed the county's Deputy Director of Elections to create a "cheat sheet" so "the count would come out perfect and we wouldn't have to do a full hand recount of the county." Triad later reported working on voting machines in a number of other counties prior to the initiation of the recount.

The Hocking County incident was first revealed to the public by David Cobb during his testimony before the Congressional Forum chaired by Representative John Conyers in Columbus, Ohio on December 13.

HELENA (AP) — The Montana Supreme Court on Tuesday declared ``one or more'' contested ballots in a disputed House race in Lake County invalid, meaning Democrat Jeanne Windham won the seat.

The 6-1 decision creates a 50-50 tie in the House and means the next House speaker will be from the party of Democratic Gov.-elect Brian Schweitzer.

The justices issued a two-page order Tuesday overturning District Judge Kim Christopher's ruling earlier this month that seven contested ballots had properly been counted for Constitution Party candidate Rick Jore.

Throwing out even one of those ballots means the vote tally swings to Windham, the court said.

We may never know what happened in the Ohio vote

The right to vote and to have each vote count is the cornerstone of democracy, but deep cracks are showing in this cornerstone.

Disturbing reports of voting irregularities in Ohio recently led nine of us from Minnesota to monitor the recount of its presidential election. The recount was not only to verify the outcome of the Ohio vote but also to ensure accountability in a flawed system.

Problems encountered by tens of thousands of Ohio voters included: waits as long as seven hours at polling places; shortages of poll workers and voting machines; electronic voting machines that malfunctioned; election-counting discrepencies; voters being directed to the wrong polling place, and uneven policies governing the use of provisional ballots.

As observers, we encountered irregularities and obstacles in the recount process. In Perry County, we inspected the voter logbooks, which showed 100 people voting in one precinct without any signatures, leaving no way to verify who actually voted. A lawsuit asking the courts to overturn the results of the Perry County auditor's race alleges that the number of votes exceeded the number of people who signed the voting books.

Coalition Against Election Fraud Holds Continuing Vigil at Senator Kerry's Home: 12:30 ­- 1:30 pm, December 28th through January 5th (4:00-5:00 p.m. New Year's Eve only).

The Coalition Against Election Fraud (CAEF) will hold a daily vigil from 12:30-1:30 p.m. at Senator John Kerry's house at Louisburg Square on Beacon Hill in Boston, Tuesday, December 28th - Wednesday, January 5th. On New Year's Eve the vigil will be from 4:00-5:00 p.m.

At the end of each day's vigil, the Coalition will submit written requests from Massachusetts voters to the Senator urging him not to certify the vote of the Electoral College when Congress meets in joint session on January 6th. We are also asking Senator Kerry to encourage other Senators and Representatives not to certify, and to support any other Senators and Representatives who are planning not to certify.

If no Senator objects to the Electoral certification on January 6th, it will be an admission of both the Republican and Democratic parties that democracy is no longer an option for most Americans.

CAEF is attempting to dispel the myth that any criticism of the election process is the work of 'spoilers' or 'sore losers'. The millions of citizens who have suffered disenfranchisement from voting do not fit this description, nor does anyone who recognizes that our election process is not secure and very susceptible to tampering. We are fighting for a fair and transparent election process, and that affects everyone.

On December 13th, in an unprecedented action, Massachusetts Electors unanimously adopted a resolution calling on the Massachusetts Congressional Delegation to demand a full investigation and remedying of all voting irregularities.

"All the votes must be counted," stated Elector Tom Barbera. Electors in Vermont, Maine, California and North Carolina also voiced concerns about the Presidential election when they voted in the Electoral College.

Members of CAEF note that despite a massive grassroots movement that is sprouting up across the country, mainstream news media have yet to fully cover the 2004 Election Fraud story. We hope news media will play its fundamental role in all investigation efforts.

OLYMPIA, Wash. (AP) — Counties have refused to reopen the vote count in Washington's ultra-close governor's race, and Republican Dino Rossi was reported under pressure Tuesday to carry a last-ditch fight into the courts.

The three vote counts in America's closest governor's race are over, and on Thursday morning, Secretary of State Sam Reed is prepared to certify Democrat Christine Gregoire as the victor by 129 votes, state elections chief Nick Handy said.

Reed has warned against counties reopening their tallies.

The Democrats won the final recount for governor by playing the game better. Now the GOP's best and maybe only hope is litigation.

The nasty fight for the Washington governor's mansion is not likely to end anytime soon. Election tabulations are not noble searches for truth. They are poorly refereed contests fought by partisan warriors in power suits, and until both the Democrats and the Republicans declare an end to combat, the fighting will continue. At the moment, Democrats are on top, but Republicans refuse to surrender, and who can blame them? Their candidate won the first two tabulations, by 261 votes out of more than 2.8 million in the regular count in the Nov. 2 election and by 42 votes in a machine recount.

For decades, Democratic electioneering philosophy has been turnout—making sure their voters participate in the election. Republicans have traditionally preferred to see a low overall turnout because conventional wisdom says their core supporters are among the most reliable voters, while Democrats are favored among people less likely to vote regularly. The GOP, meanwhile, has a history of worrying about cheating.

While Republicans were resisting Democratic efforts to reconsider previously disqualified King County ballots, surely they knew there was a possibility, even a likelihood, that the party would lose the fight to exclude them. So here's another tactical mistake: The GOP should have tried to stop county election certification statewide until the rules were clarified. Instead, 38 of the state's 39 counties finished the third and final count and certified the results before King County's outcome was clear. Now, Secretary of State Reed says, the counties, most of them Republican-leaning, are finished—they may not reopen the recount process, even if there are improperly disqualified ballots out there.

So Democrats found additional votes before the game was over, but Republicans did not. "How can you anticipate that things are going to happen?" Vance asks. "The election is not supposed to be about who is better at gaming the system." Unfortunately for Vance, that is precisely what the election is about at this point. The process is so imperfect, and the 2004 governor's race is so close, that we will never really know who won. All we can be certain of is who is declared the victor.

Under cover of John Edward's late night promise to "count every vote," Kerry's lawyers have been adeptly pursuing evidence that could reverse the election outcome, while keeping their candidate so Teflon-coated that he remains untouchable by "sore loser" or "conspiracy theory" jibes.

Indeed, Kerry's slick moves have been so effective that many of his own supporters still half-believe that all this is not about questioning the election result

SANTA FE— Green and Libertarian presidential candidates are continuing their legal fight for a ballot recount in New Mexico and plan to file a notice of appeal today with the state Court of Appeals.

Lawyers for Green Party candidate David Cobb and Libertarian candidate Michael Badnarik said they will ask the court to order a recount of presidential ballots in the Nov. 2 general election. However, it potentially could take weeks or even months for the Appeals Court to issue a decision.

The candidates went to the Supreme Court with an expedited lawsuit rather than taking the traditional but slower approach of going to the Court of Appeals after losing in district court.

Finley said in a telephone interview the candidates will ask the Appeals Court to issue a stay to prevent county clerks from clearing election returns from voting machines while the legal challenge is pending in the weeks or months ahead.

Filing a notice of appeal should be enough to preserve vote tallies statewide for a recount, according to Finley.

I'm hoping C-SPAN will show up tomorrow morning at 11:00 for the press conference at the National Press Club but it is hard to know what they will do. We will show the Linda Byrket film "Video the Vote" and distribute copies to them on videotape. You can read the media advisory as well as the op-ed-turned-advertisement that will run in the Post on Thursday. As a public service we've put together a page at TheWashingtonPissed.com reviewing the controversy and asking people to join us in sending flowers to 15 key people there, to share our grief with them and our condolences on the death of what at one time was a great newspaper. If there is anyone with a platform in the corporate news media who is genuinely a part of the political opposition in the U.S. he or she is on vacation right now, enjoying the last few moments before the lights go out on the Constitution of 1789 that made us, for a time, the world's most successful democracy. Both the New York Times and on Olbermann's blog have selectively quoted from Kerry and Democratic Party officials to create the erroneous impression that resistance to Bush is futile. Don't believe them.

A lot of people think the Electoral College is designed to protect states' rights. But did you know that Congress could decide how to count a states votes?

Buried deep in a story by Jim Seigal of Gannet News about the Ohio recount is this nugget:


Ohio's 20 Republican electors cast their official votes for Bush on Dec. 13, even though final recount totals won't be certified by the state until this week. That scenario ... could spell disaster in a very tight presidential race if the recount somehow reverses the winner. Congress could eventually be forced to decide Ohio.




The official electoral college webpage at the federal archives describes what happens if there is a disputed vote outcome in a state (remember Florida in 2000??)


A very close finish could also result in a run-off election or legal action to decide the winner. ... The law provides that if States have laws to determine controversies or contests as to the selection of Electors, those determinations must be completed six days prior to the day the Electors meet.



This year, the Electors met on Dec 13. So, if a recount wasnt' complete by then, Congress would have to decide whether or not to count Ohio's votes for president. That didn't happen this year, thankfully. But, its not exactly a situation that gives you a lot of confidence in our system. I wonder if the folks in the Ukraine have any tips for us.

Q: OK, I’ll get right to it, then. Many in the party were extremely disheartened to see voting irregularities worsen instead of improve in this past cycle, and in light of the stories we’ve seen coming out of Ohio and Florida, what do you think Democrats can do to restore faith in the system? Do you feel that you can take the lead in this issue? It was certainly the number one topic at the last group of meetings that DFA had.

HD: I think we need to focus on election officials. County Clerks, Secretaries of State in particular, because the Republicans have been so partisan in exercising their responsibility to help people vote, they‘ve in fact tried to suppress turnout instead of encourage it. Secondly, we, I think we need to try to get laws passed, by referendum if necessary, that says that no voting machines in a particular state or jurisdiction may be used unless they can be recounted by hand. Oregon has such a statute because Bill Bradbury (Oregon’s Secretary of State) got one passed in 2001. We should try to state by state overhaul the election process both by referendum and by electing where possible Democratic Secretaries of State and County Clerks.

Q: In other words, just seizing the thing locally is the way to go….

HD. Well, obviously, we’re not going to get rid of the Bush Administration for the next four years and this Congress wants to suppress votes instead of increase them. So I think the local venue is the best thing we can do.

Q: Do you think it’s too much to hope for that we’ll get any kind of media coverage regarding the Bush Administration’s active plan of disenfranchisement through basically ill equipping the polls, all those shenanigans that were pulled, do you think…

A Well, in order to do that you have to have some proof that that actually happened and while I think suspicion are well justified, we don’t actually have proof that there was a plan to do that, and until we have some proof, it’s not likely that we’re going to get much media coverage. There is a lot of circumstantial evidence and I think we are getting some media coverage on the circumstantial evidence, for example the over vote, Cuyahoga County, The addition of 3500 votes that didn’t exist before the balloting even started, on some of those electronic touch screen voting machines, those things we have to be concerned about, and I think we can get press on them.

About a half dozen supporters of John Kerry are holding vigil in front of his house, still hoping for a Kerry presidency.

The little knot of demonstrators, calling themselves the Coalition Against Election Fraud, stood shivering in the cold yesterday, hoisting signs and pressing fliers into the hands of bewildered passersby. Taxi drivers, neighbors digging cars out of the snow, and Beacon Hill residents who happened to be strolling by were subjected to earnest pleas to join the cause.

''Who knows? Maybe we'll overturn the election," said Sheila Parks, a vigil organizer.

KERRY JOINS COBB'S REQUEST TO PRESERVE EVIDENCE IN OHIO RECOUNT

The Motion filed by Green Party presidential candidate David Cobb last week, asking a Federal Court to preserve a wide range of evidence to ensure the integrity of the Ohio recount, was officially supported by the Kerry-Edwards campaign today.

"Senator Kerry filed a Motion today which essentially says nothing more than 'me, too' to our filing from last week," said Blair Bobier, Media Director for the Cobb-LaMarche campaign.

Cobb's attorneys on Thursday had filed a Motion for a Preservation Order and for Leave to Take Limited Expedited Discovery in the U.S. District Court for the Southern District of Ohio where recount litigation is pending. The Motion, filed on behalf of Cobb, Libertarian presidential candidate Michael Badnarik and the National Voting Rights Institute, requested that voting machines and election records be preserved.

"We welcome Senator Kerry's belated interest in ensuring the integrity of the Ohio recount. This effort, initiated by the Green and Libertarian presidential candidates, has been focusing on the integrity of the election process and not on the outcome. In order to trust the election results, we have to trust the process. All presidential candidates, including George W. Bush, who are committed to an open and accountable voting system should demand an investigation into an election clouded by serious allegations of fraud and suppression," said Bobier.

The Ohio recount has been plagued with almost as many problems as the underlying presidential election. One of the more notable instances took place on December 10, in Hocking County, Ohio, when a representative from Triad Governmental Systems, Inc. reprogrammed a computer used for tabulating votes and instructed the county's Deputy Director of Elections to create a "cheat sheet" so "the count would come out perfect and we wouldn't have to do a full hand recount of the county." Triad later reported working on voting machines in a number of other counties prior to the initiation of the recount.

The Hocking County incident was first revealed to the public by David Cobb during his testimony before the Congressional Forum chaired by Representative John Conyers in Columbus, Ohio on December 13.

64. New Media Communications--fascinating octopus of electoral
success. (Republican, of course.) They manage the websites for all of these campaigns and even the Ohio election night website!
All their clients won their elections, no matter how slim the chance.

New Media Comm. - Have we looked into these guys yet?


A post asking for a connection between Datamaxx and Triad led me on a hunt to find a link. In my searching I ran across New Media Communications.

The lead story on these guys is the fact that every candidate they backed won thier election. "Every client who turned to us for online strategy and Internet solutions came out a winner," NMC President Mike Connell said.

Most notable was the Bush/Cheney '04 Presidential campaign. President Bush won 51.1% of the popular vote, enabling him to start off his second term with a mandate. Bush was the first U.S. President to garner a majority of the popular vote since his father did the same in 1988. He earned a record breaking 58.9 million votes -- more than any other U.S. President .


In his South Dakota Senate race, former Congressman John Thune scored an upset over current Senate Minority Leader Tom Daschle in the most expensive Senate race in history. This marked the first time since 1952 that a seated Senate leader has been defeated in a re-election bid.


David Vitter made history as the first Republican to earn a Senate seat in Louisiana since Reconstruction. He gathered a decisive 51.6% of the votes in an unusual three-way "open primary," thereby avoiding a runoff election.


In Ohio, Senator George Voinovich won a second term with a comfortable 63.9% of the votes.

Seven congressional seats went to Republicans whose websites and electronic communications campaigns were created by New Media. Far from shoe-ins, many of these pivotal races were highly competitive to historic proportions:


Minnesota's Mark Kennedy emerged the victor after weathering fierce and blatant attacks from Michael Moore in "Fahrenheit 911."


Geoff Davis of Kentucky faced down Nick Clooney, a former television host, whose campaign was heavily supported by friends of Clooney's son, Hollywood actor George Clooney.


Robert Simmons and Heather Wilson won hotly contested battles in Connecticut and New Mexico, respectively.


Joe Barton of Texas, Mike Turner of Ohio, and Kenny Hulshof of Missouri, rounded out the list of successful candidates who turned to NMC for Internet identity solutions.

In addition to its work for specific candidates, New Media created a number of electronic communications tools for the National Rifle Association, the Republican National Committee and the Ohio Republican Party. The efforts of these groups made a difference in strategic arenas all across the country. New Media also worked for two grassroots groups in Michigan and Ohio to successfully defend traditional marriage. These ballot initiatives to reaffirm the definition of marriage (as the union between one man and one woman) won by a wide margin in both states.

"We have really been blessed in this election cycle," Connell said. "This important string of victories for our clients is nothing short of phenomenal."

GovTech Solutions, a spinoff from New Media Communications, was created in 2000 to produce sites for federal lawmakers and agencies. Its clients include 27 members of Congress from House Majority Leader Tom DeLay to Ohio Reps. Bob Ney and Dave Hobson."

I imagine the working folks will have a chance to read this now. I know it is probably difficult to call during working hours, but if there are any of you out there that can, please do.

Spead the word. Ask Ohio AG why they will not enforce the law. Is it truth that they stated putting Katherine Blackwell under oath is harrassment?
I tried to locate an 800 number, but there was only one for consumer protection. If anyone knows of an 800 number for Ohio AG please post.
