President Bush to Be Subpoenaed; Blackwell Tries to Avoid Sworn Testimony; Over a Dozen Members of Congress to Challenge Election

In a sign that Votergate news stories will soon become impossible for the mainstream media to ignore, news of ground-breaking developments in the national scandal is now coming so fast and so furiously through internet channels that The Advocate strains to report it all in a timely fashion. Indeed, even an Associated Press article now being carried by all major media outlets, auspiciously entitled "Ohio Recount Ends, Shows Vote Closer," states clearly that "he completion of the recount will not bring an end to questions surrounding the vote in Ohio. A group of voters citing fraud have challenged the election results with the Ohio Supreme Court.... the Government Accountability Office, an arm of Congress, also is investigating election problems."

8. Did anybody notice that OSC has issued a 12(b)(6) rule nisi?!
There's a 12(b)(6) rule nisi order from the Ohio Supreme Court today on the Supreme Court case that STAYS the obligations of the defendants to answer and says that Arnebeck's suit against Moyer will be dismissed unless he proves that it shouldn't.

This is serious.

16. Rule 12(b)(6) is one of the grounds for a dismissal
Rule 12(b) of the Federal Rules of Civil Procedure lists the defenses that have to be set out in the answer of the defendants or they are waived. It is fairly routine for a defendant to include some of the 12(b) grounds but almost universal that a defendant will include 12(b)(6) which is failure to state a claim upon which relief can be granted. In this case, the Court made its own motion to dismiss and ordered the Complainants to show why their case shouldn't be dismissed. This is unusual and serious. As I predicted in an earlier post (to the usual catcalls and hatemail), fraud has to be pled with particularity. The who, what, when, where and how. Most pleadings are called "notice pleading" which means that as long as the defendant has a general idea of what the Plaintiff is talking about, that's sufficient to survive a motion to dismiss. But fraud is different. You can't just say "We allege fraud" like you can "We allege that Defendant breached the contract."

The rule nisi is sometimes called a "show cause" order and it sets out a deadline whereby a party has to come to the court and show something (usually why something should be ordered or why something should not be ordered).

Additionally, the Court STAYED anything that the Defendants (the contestees) have to do until the motion to dismiss is resolved. No subpeonas, no discover, no nothing.

This is not a good development.

It seems the GOP is going to do what they do best now - avoid reviewing the actual merits by never allowing the case to be heard. It's all of a piece with not allowing the votes to be counted, not allowing the defendant to speak (Bobby Seale) and on and and on...

Next question - is there any counter motion available to Arnebeck, or is this checkmate?

I appreciate your taking time to explain to this layman what's really going on.

23. Do we know how confident Arnebeck is with his pleading?
In other words, I've been lead to believe Arenbeck has at least somewhat of a smoking gun, based on his interviews.
I realize attorneys bluster and blow, but Arnebeck never seemed like he was doing to much of that.

Could he actually produce the inkling of evidence needed to overcome the stay?

12. rtlf, have you heard anything about Arnebeck's response today that
shows the suit shouldn't be dismissed against Moyer?

I wasn't understanding how serious this was until you commented. I didn't think Arnebeck and the Kerry bunch would get very far with the OSC. Interesting indeed....Thanks! :hi:

17. That's what I was looking for when I came across the 12(b)(6)
I don't know if it was filed or not. I was trying to find it so that I could read it when I came across the 12(b)(c) and I just went "oh crap, a 12(b)(6) rule nisi from the judge is not good."

He wouldn't testify under oath to the 9/11 commission and he won't testify regarding election fraud. There is no way...

* will decree "I don't have to testify because blah blah blah" and the MSM will accept it and so will the American people.

It sucks, but that is the way it is.

for the nice welcome! I'm glad to finally get more involved and get an account here... this place has been a great source of information that's real hard to find out there! And I must say, it's real nice to find support from others who feel the same way. (I've spent a lot of time on other forums arguing with republicans and seem to be outnumbered there.)

And, if they try to say that the courts cannot subpeona a sitting president... well... role out Jones v. Clinton... :P

Republicans stuck their foot in it by their relentless persecution of Clinton. We need to go back and study all their tactics to get at Clinton (minus the special prosecutor, of course) and see what we can do to yank their chains around - tactics that they've already used and cannot argue against!

Besides, election fraud effect MANY MANY more people than a sexual harrassment suit.

I knew there had been a well-attended protest, but the eggs flying and the venomous atmosphere was a far cry from how the MSM portrayed it.
