First Hand Account:Dem Senators "Receptive"
thought all should read this first hand diary of some activists going to various dem senators' offices the other day. many seem receptive, but others really want more "proof." my personal feeling-you may not get "smoking guns" unless you contest and launch an investigation. hell, if they (congress) can hunt bill clinton down for 8 yrs over an affair, whitewater, why on earth cant the dems challenge this? goodness...

A report from Washington: Seeking Senate support of the challenge

Fri, 31 Dec 2004 12:39:24 -0500 Today seven of us went to Washington to meet with staffers in Senator Sarbanes' office. I felt it was a good meeting, and each of us had something worthwhile to contribute. I hope the staffers felt as I did that we represented people with different backgrounds coming together on this vital issue, each with our own perspective and our own reasons for caring so deeply. I felt that we had a good grasp of the issues involved and were also able to present the realities of grass roots activism, the contact with people who feel disenfranchised and the need to assuage their fear and ours that individual votes might not count anymore.

Two of Sarbanes's Staff met with us, Kima, who is a pediatrician, and Ryan, who seemed very aware of this problem and sympathetic to our concerns.

We emphasized how important we feel it is that Senator Sarbanes stand up for us and challenge the certification of the election, a step which would open some chance for all this to be looked into. Jay and Lynn spoke eloquently of needing to be true to those people whom they had assured that their votes would count. Tim mentioned that people who've given their all for a cause can't continue working for that cause unless their leaders support them. Jim made the point that Senator Sarbanes is largely responsible for the Sarbanes Oxley bill, which protects stockholders in their transactions in a way in which voters are not protected by the law. Kima responded to that that that legislation was passed under Democratic leadership. Steve stated that 10-15 Senators would be ready to challenge if one would lead the way. Sherri argued persuasively that we who have worked so hard, gone to various states, etc., need to see our leadership standing up for us.

All of us pointed out the various anomalies and cover-ups that have occurred, the fact that we cannot trust the official vote count in Ohio and that that fact is undermining our democracy and our faith in it. Both in the meeting and in getting the appointment for it and later in other offices, I quoted Chris' account of covering up the stray pencil marks in Ohio to make the hand and machine counts agree, and being able to say that I know someone who directly witnessed these things and can attest to them seems to make an impression. We were proud to present the excellent package of information that Sherri had put together. I wish that you all could have seen her binders, with a cover showing our group name, a list of contents, all paginated and very professionally presented.

Coordinating with the cover were the calling cards she had prepared for us, and these were very good to have to hand out as we introduced ourselves and to return when staffers gave us theirs. Steve added a very interesting map about types of voting machines used in different districts nationwide and a great deal of experience at this kind of thing. He made a good case for holding a forensic investigation of the machines and the software and explained that this is entirely possible even this late IF a Senator will make the challenge to let investigation happen. He further pointed out that a challenge would not mean we were without a president. Things would continue as they are while an investigation took place.

We feel that we presented our cause well and that we were listened to carefully by the staffers, who asked good questions and were very supportive in their comments. We believe that our position will be passed on accurately and sympathetically to Senator Sarbanes.

Sherri had prepared two more complete binders for us to use during the meeting, and I had made five more copies of a part of the package, and Sherri, Jim and I decided to visit other senatorial offices to see who would talk to us. We began with a list of possibly sympathetic Democratic Senators, then added one more because his door was open, on this day when so many offices were closed for the holidays. That one may actually have been our next best contact after our own Senator. As we passed the office of Senator Harry Reid, we decided to stop in since he is the new Senate Minority Leader, and we found his staff very willing to talk with us and to pass on both one of Sherri's binders of our information and our comments to the appropriate staffers and the Senator when they return next week.

We were also able to put our case to staffers and leave information in the offices of Senators Biden (Del.), Feingold (WI), Feinstein (CA) and Kennedy (MA). Senator Biden's staff people were very nice and interested and shared with us that all Democratic Senators will caucus on Tuesday, and would almost certainly discuss this as well as other vital questions. We found that a very interesting point, and we're all hoping they all get together and pore over some of Sherri's excellent binders. Senators Biden, Sarbanes and Reid now have them, and Senator Mikulski will by then. Senators Feingold and Feinstein's receptionists were pleasant and willing to pass along our information.

Only Senator Kennedy's office was rather negative about it, seeming to indicate that there was no point in challenging, and doing so could cause Democrats to lose political clout, to which we asked, "what clout?"

Interestingly, while one staffer spoke to us, we could hear the one behind him fielding a call from someone asking the same thing and recording their comment. We left our last copy there, started to walk out, then realized we were three buildings away from where we'd started and weren't sure of the shortest way back, stepped back in to ask, and heard the one who'd been on the phone saying something about wondering whether he should let people like that know that Senator Feinstein is the best bet. We were glad we'd left her info too.

We'd also put the small version under the doors of Senator Boxer, whom we'd heard was the strongest possibility, and Senator Murray (WA).

A shocking thing to us was that as we went from office to office discussing the anomalies in the election, no one argued or seemed shocked or defended the 2004 election. Although all didn't necessarily state agreement with us, none challenged the idea that inappropriate and illegal things had happened. The question was about proof and the ability to produce it and prevail, rather than about whether bad things had happened.

I will email every single dem senator a new letter I wrote via my fax machine here at home. I want to make sure things go through etc. Ive only hounded these people for a month. what is one more exhaustive whirl

This is a time for some passion and anger.

we have proof of treasonous election fraud and tampering. The case has already been made.

Now the point is: politicians who ignore the information that has been made available to them, will be put on the defensive to explain why, knowing what they did, they didn't stand up to defend a democratic election.

There really is no good explanation except that they were dupes, or fools, or worse - complicit in a treasonous coup d'etat for a bunch of fascist bully thugs.

How are they going to explain their stance to their constituents, to their children, to history?

There will be no explanation for not defending democracy.

I think we can put a hell of a lot more heat than we have. These folks should feel a tremor of fear - if they don't stand up, they'll be aligned with the quislings and dupes who allowed democracy to be destroyed, on their watch.

I make the case somewhat clumsily, but the point shouldn't be softened: if you do not act, history will have consequences for you. Your self esteem should demand the correct course of action.

I believe too that if one Senator stands up, several will. I'm sure no one wants to do it alone. I really don't understand what's going on with Kennedy?? Although I think Biden is a real possibility. As is Byrd, Boxer, Jeffers (did you go there?).

last week (I had posted here) she did not sound too interested...mostly a "will look into it"... Still have not gotten word back from Boxer - who normally answers email right away... Boxer is great! i hope she pulls through like she did with Iraq...

It's been really frustrating. I was able to send to Sen. Feinstein, but not at all to Sen. Boxer.

Since Nov. 2 I've encountered (on CSPAN) several panel discussions of Democratic pundits hashing over what went wrong (i.e what WE did wrong) with this election, and how to improve our chances next time. It's been unbelievably aggravating to hear so many of them talk about merely refining some version of the status quo, dismissing the importance of the tens of thousands of activists and the groups we've formed, and so on and so forth. Makes me want to bitch-slap the lot of them. Too many of them just don't seem to get it, do they?

Anyhow, I'd be grateful for a working e-mail address for Barbara Boxer.

I'm getting the vibe that several of them WANT to do it, but not alone.

All of the Senators who want to contest need to say so to each other. They need to agree that they will stand up together.

This is very exciting to hear, and very significant. I like the last paragraph of your report, Laurel, and have this to expand upon:

Conyers' report is apparently not being torn apart. If his findings weren't holding up, if the report were flawed, these activists would be hearing about it when they met with the Senators' staff. There seems to be NO issue with the credibility or validity of his information. None.

Right now our enemy is fear. Specifically, the fear of standing alone in an event of historical proportions.

This can be conquered. If Conyers' case is holding up, then this can be overcome.

I read a report about a day or so ago by kerrygoddess that there would be "at least a couple" of Senators. Those were the exact words. Now with this report, with specific people named, I'm really getting psyched. I can't help it. Maybe I'll be let down, but if that is to happen, I'd rather have spent these days hoping than despairing.


SENATORS: Now is your chance. Do you stand up to defend the Constitution and the laws of the land? Do you stand up for the disenfranchised? Do you stand up for the right to free elections? Do you (*half expecting to get flamed for this*) stand up for your wronged colleague and friend?

Or do you sit, tacitly defending what you have now read of, and what you cannot discredit?

i just want to add, don't forget about the great illinois delegation. if any senator stands, and dick durbin DOESN'T, i will faint dead away. i don't know exactly what is up, but i think that people have visiting his office here in chi. i think he will support schakowsky, who signed the gao letter.

How could you know that any Senators were receptive if you didn't meet with any Senators?

Of course the staffers were sympathetic to you. That's their job.

It is odd that the staff in Kennedy's office was so frank with you, but at least they did not lead you on.

33. I think you misunderstand the term
"smoking gun".

"Smoking gun" means incontrovertible evidence that will be sure to convict in a court of law. "Smoking gun" means something that no one can dispute. If you catch someone at the scene of murder with a gun that is actually smoking in his hand, that's the "smoking gun" evidence.

The equivalent in the fraud cases would be:

1. Confession of one of the fraud participants, explaining exactly how it was done and naming accomplices.
2. Video of someone stuffing ballot boxes.
3. Code that is proven to be taken out of one of the actual voting machines or tabulators that contains portions that pad the vote for one of the candidates.

I am sure you can think of a few more possibilities.

All the stuff you are talking about is evidence, but not hard proof, or "smoking gun". Characterizing it as "smoking gun" just opens the presenters of it to ridicule.

the SG is routinely discovered after staring an investigation based on prima facie evidence (i.e. we see irregular transactions and we need discovery powers to ascertain how they were conducted).

44. Electoral fraud accusations are not "forensic accounting"
as the Ohio Supreme Court ruling has shown. If you file an electoral fraud suit, the court will not allow you to go on a "fishing expedition". You have to present proof.

IMPORTANT INFO - that Democratic Senators are caucusing TUESDAY. Get your last minute letters, emails, phone calls in today MONDAY!

FABULOUS WORK, art3! Those of us in the boondocks are VERY GRATEFUL to those of you in DC! And this account indicates just the sort of careful, methodical, professional work that is needed right now. (There's a time for ranting and protesting and being crazy about this--but quiet, careful informational work is equally, if not more, important, at this critical decision moment.)

intensitymedia: --you make a good point about the "mandarin" atmosphere of the Senate. It's so remote from democracy these days. And it's ironic, isn't it? --as firespirit points out--these "leaders" who sit on the top of the mountain, and who are so careful of their own privileges and position, can't seem to act on their own. I understand it--the BushCons are an extremely dangerous and vicious bunch of fascists. Still, we long for real leadership--for courage. As our rights are taken away, one by one--now our very right to vote--who will defend us in these halls of power?

Hekate: I so agree with you! It drives me crazy when these deaf and blind Democrats start talking about "what we did wrong." We did NOTHING wrong! We WON!

A friend points out that if Kerry had been better at articulating the crimes, thievery and outrageous violations of national and international law that the BushCons are guilty of, he might have garnered an even bigger % of votes, enough to overcome the fraud. In other words, if Dean had been permitted to run, instead of Kerry (or Kerry had been more principled). And I think this may be true. The DNC's compromising, fearful, "let's do the Iraq war more efficiently" B.S. was not only hard to stomach, I think it DID turn some voters off--voters wanted leadership and courage. (Almost 60% were against the Iraq war before the invasion--and guess what? --almost 60% STILL oppose it now.)

However, THAT is NOT the point. The point is that, with the grass roots left and the Dem leadership cooperating so amazingly well, WE WON THIS ELECTION. And they goddamned stole it from us.

That's what Dem leaders and commentators should be talking about--and ONLY that!

Like you, a leader in the U.S. Senate, DON'T KNOW that they stole this election??? You DON'T KNOW that Bush "Pioneers" control the vote tabulation with SECRET source code??? You DON'T KNOW that the Exit Polls say Kerry won??? You DON'T KNOW that Ohio was one big, illegal, Republican scam from beginning to end??? You DON'T KNOW what Jeb Bush was doing to Democratic voters in Florida? You DON'T KNOW that this was THE most NON-TRANSPARENT election since Josef Stalin?

As if they don't know. I find that really hard to believe.

BIG POINT ON "PROOF": SENATOR TALKING POINT

They DON'T HAVE TO SAY the election was fraudulent. All they have to say is that the violations of the Voting Rights Act of 1965 were so prevalent in Ohio and Florida, and the voting process was so non-transparent, that those elections cannot be validated. THAT'S ALL THEY HAVE TO SAY! (--and there is so much more!)

There is a whole lot more they can say, short of the "f" word. But they really don't have to say that Bush isn't president--if they're too chicken to say that. ALL that is required for a challenge is proof of non-transparency and of massive violations of the law.

The Ohio and Florida elections MUST be done over--re-voted--because their results are so questionable. And THIS time, with paper ballots and a hand count of every vote.

Put the onus of proof on the BushCons! With such non-transparency, and such egregious suppression of black, poor and Democratic voters, YOU GUYS have to PROVE THAT YOU WON those states.

35. I think anyone who has run for senate must be aware of fraud potential
in their own state. They know where their votes are coming from (or supposed to be) and probably have an idea which counties/precincts don't add up.

Most of our focus in this forum has been on fraud in the presidential race, but how many other races may have been affected by fraud that we aren't hearing about?

I hope they are receptive to challenging this election on Thursday, its the only way we'll ever know the extent of the fraud in this country.

It was Kennedy that influenced Kerry...Kerry has always looked up to Kennedy and Kennedy hasnt always made the right choices or seen the truth in the details.

An example was when Kennedy convinced Kerry to support Bush's invasion of Iraq, with conditions, of course. I thought this was bad judgement and obviously a political tactic/setup. It was stupid. Kennedy thought he was being clever...doh, I never forgot it.

sufficient voting machines?

I truly believe that senators will be more persuaded by the simple logistics of not enough voting machines to accommodate all the registered voters in a precinct within voting hours, than by claims of fraud substantiated by anecdotal information and vague "they could manipulate the vote because there's no backup" claims.

Understand that I do believe there was actual computer fraud in addition to this logistical nightmare caused by Blackwell's bs.

But we here have to understand that senators will not stand up in front of congress and claim someone "may" have tampered with the vote because statistically blah blah blah, and we have no paper backup. Or "someone must have" tampered with the votes because of the exit polls.

Hard facts like "only 35% of registered voters in XXX precinct could have voted within the 10 hours the polls were open" could be more persuasive.
