Fax and phone info for all Frist and Hastert offices
Call or fax as many offices as you can, let them know you are seriously concerned about voting irregularities in Ohio, must be an investigation, even though it won't overturn election. It is still really important to you to have the votes counted. Say it, even though we know that the election would be overturned if all the fraud were known. Do you think anyone would investigate if they thought it would put Bush out of office? NO. Will they have to if voters demand it, even though they know it won't overturn the results? YES

So get busy calling, then report it to Kerry.

1. If you do fax them, send this!
Originally posted by hootinholler:

Comes from Bush V Gore in Justice Breyer\'s dissent, when speaking as to why the Court should not have heard the case to begin with: (Emphasis mine)

To the contrary, the Twelfth Amendment commits to Congress the authority and responsibility to count electoral votes. A federal statute, the Electoral Count Act, enacted after the close 1876 Hayes-Tilden Presidential election, specifies that, after States have tried to resolve disputes (through “judicial” or other means), Congress is the body primarily authorized to resolve remaining disputes. See Electoral Count Act of 1887, 24 Stat. 373, 3 U.S.C. § 5 6, and 15.

The legislative history of the Act makes clear its intent to commit the power to resolve such disputes to Congress, rather than the courts:

“The two Houses are, by the Constitution, authorized to make the count of electoral votes. They can only count legal votes, and in doing so must determine, from the best evidence to be had, what are legal votes .... The power to determine rests with the two Houses, and there is no other constitutional tribunal.” H. Rep. No. 1638, 49th Cong., 1st Sess., 2 (1886) (report submitted by Rep. Caldwell, Select Committee on the Election of President and Vice-President).

The Member of Congress who introduced the Act added:

“The power to judge of the legality of the votes is a necessary consequent of the power to count. The existence of this power is of absolute necessity to the preservation of the Government. The interests of all the States in their relations to each other in the Federal Union demand that the ultimate tribunal to decide upon the election of President should be a constituent body, in which the States in their federal relationships and the people in their sovereign capacity should be represented.” 18 Cong. Rec. 30 (1886).

The way I read this, there is no requirement of evidence. The only requirement is a compelling enough argument. Once a challengable vote is in fact challenged, each Congressman is Duty Bound by thier oath of office to act in judgement of the acceptability of the electoral votes from that state.

11. Good idea! I faxed that the other night to the senators on the "list", but
Frist and Hastert weren't on it, of course.

I will add it to all the letters I fax them today.

I think it's a good idea to fax all offices, that way there is a greater likelihood that staffers will be up to speed. Many have reported that there is a lack of awareness about the whole issue.

5. Yes, I got that too.
It's hilarious really. Frist's office just redirects you to a voice mail message that hangs up on you. So much for listening to voter's concerns.

6. Wrong #s
Those aren't the #'s we're supposed to call. I just got Kerry's letter. These are the #s to call:

Speaker Dennis Hastert: 1-202-225-0600

Leader Bill Frist: 1-202-224-3135

Ask them to hold full hearings into the voting problems in the 2004 election and demand action on election reform.

10. But if you can't get through, by all means, call the other numbers.
The more calls they get, the better, from all sides.

Ojai, thanks for posting these!

On edit: I couldn't get through to Senator Frist's Washington number. The lady I spoke with in Memphis was most helpful and said she would be forwarding my comments to the Washington office immediately.

Dear xxxx:

Thank you for your e-mail, and I look forward to reviewing and responding as soon as I can. Unfortunately, due to the high volume of mail I receive daily and the press of Senate business, your response may be regrettably delayed. In the meanwhile, you may find my website at http://frist.senate.gov to be helpful, as I endeavor to post my positions on most major policy issues there regularly along with other information of interest.

Again, thank you for contacting me and know that I always appreciate hearing from you!

Sincerely,

William H. Frist, M.D.
Majority Leader
United States Senate

Please do not reply to this email, it is coming from an unmonitored account.
