Truitt/Arnebeck Just Filed Motion to Dismiss Moss v. Bush
This is from the Case_Ohio discussion group:

I just spoke with Susan Truitt, and she told me she just non-suited
Moss v. Bush, today.

Why?

Because Susan and the other lawyers re-assessed the current legal
situation, and concluded the best thing to do would be to dismiss the
"Election Challenge," and to file a federal civil lawsuit in U.S.
District Court, alleging civil rights violations and election fraud.
Susan and the other attorneys decided, that since the purpose of their
lawsuit was to change the outcome of the election, and Congress already
voted down any Congressional investigation, non-suiting Moss v. Bush
was the best thing to do -- since, at this point, Moss v. Bush would
not change the outcome of this 2004 Election.


But why dismiss Moss v. Bush?

Susan said her and the other attorneys concluded the
Republican-dominated Ohio Supreme Court was most likely going to
dismiss and rule moot Moss v. Bush anyway, on or about Inauguration
Day, January 20th, 2005. She also was concerned the biased,
Republican-dominated Ohio Supreme Court would assess huge fines and
penalties against the plaintiffs/attorneys filing the suit, in order to
attempt to "deter" any further legal action.

Susan is working hard toward the federal civil action which will be
filed very soon.

I'll post it as soon as it's filed.

It all sounds GOOD to me, and makes logical sense at this point.

I was unaware of fines and penalties.. ugh.
