Advocates of Recount File New Lawsuit in New Mexico


New lawsuit filed in fight over election

Advocates of a recount in the presidential race are shifting gears with a new lawsuit on behalf of voters who are seeking election reforms as well as an order to block county clerks from erasing general election data from voting machines.

The lawsuit was filed Friday in state District Court in Albuquerque by attorney Lowell Finley, who also is representing the Libertarian and Green party candidates in another recount action. It claims certain voting machines used in the general election malfunctioned and produced inaccurate results.

The candidates have argued that there were irregularities - particularly with push-button voting machines - that warranted a recount and are seeking to stop the use of some of those machines in future elections.

The lawsuit also asks the court to force Secretary of State Rebecca Vigil-Giron to adopt regulations to make the counting of provisional, emergency and absentee ballots uniform throughout the state.

12. I heard the temporary restraining order was declined
and that on Friday counties began clearing machines. Does anyone know about this and how it affects this new lawsuit?

4. Recount in N. Mexico is very important; the case is overwhelming
that there was large scale vote machine fraud; ballot stuffing(phantom votes); and dirty tricks and suppression to prevent minority votes. And the margin was only 6,000 votes. More than that amount is already documented.
