Ohio's GOP Attorney-General Launches Revenge Attack on Election Protection Legal Team

COLUMBUS -- In a stunning legal attack, Ohio's Republican Attorney-General has moved for censure against the four attorneys who sued George W. Bush et. al. in an attempt to investigate the Buckeye State's bitterly contested November 2 election.

Robert Fitrakis, Susan Truitt, Cliff Arnebeck and Peter Peckowsky were named by Attorney-General James Petro in a filing with the Ohio Supreme Court. Petro charges the November Moss v Bush and Moss v. Moyer filings by the Election Protection legal team were "frivolous". Petro is demanding official censure and fines.

"Their cage has been rattled and they popped their cork," Arnebeck said. "The chairman of the Ohio Republican Party is going berserk because he can't stand the fact we are not going away. We are still pursuing the legal investigation and the legal interrogations. They are just besides themselves because they cannot withstand cross examination."

Petro's filing is widely viewed as revenge for the heavy toll taken by grassroots activists on the credibility of the Ohio GOP and Petro's cohort, Secretary of State Blackwell. Spurred by the lawsuit, by extensive coverage at http://freepress.org and other web sites, and by a nationwide grassroots campaign that was escalated by Rev. Jesse Jackson and a series of public hearings around Ohio and in Congress, some three dozen Senators and Representatives mounted the first-ever challenge to a state's Electoral College delegation.

7. This article doesn't really say what's going on
with what I thought was a Federal Suit filed in Ohio where the judge was a Clinton appointee.

This is kind of vague from the article..makes me feel all is dead there...except for filing another action last week and "discussions of filings for civil rights violations. I was hopeful that there was more ongoing in Ohio. Anyone know, anything more? What lawsuits are actually pending? :shrug:

Arnebeck has since filed another action attempting to stop Bush's inauguration. That filing, in U.S. District Court in Ohio's Southern district, was filed late last week and seeks to depose Blackwell for his role in election "fraud" that awarded Bush the state's presidential vote and a second term as president.

There has also been discussion of the possibility of filings based primarily on civil rights violations against African-American and students who were denied the right to vote on November 2 for a wide range of reasons, most importantly a shortage of voting machines in critical precincts.

11. You're right, it is kind of vague

but I think the emphasis is on the fact that there is still a lot of investigation happening, that these guys are not giving up on Blackwell, and Blackwell knows it. The Ohio GOP is freaking out, they are feeling desperate or they wouldn't be doing this. If Arnebeck et. al. had nothing, why would the A.G. bother filing this? Why would they even continue to acknowledge a case that has already been dropped? I think there may seriously be some evidence or something and the GOP in OH is trying so hard to keep these cases out of the court - like the first one which was withdrawn because it was too late. If there was anything fair about the court system in ohio, that case would have been expedited through the system. Since it wasn't, it was meaningless and dropped.

Speculation, but for now, that's all we can do. Speculate.

I think patience is key. But I think it's working.

19. The one you are referring to is the one filed by Cobb, Badnarik, and Kerry
Edwards got into it also. It's the one Will Pitt wrote the article about.

31. Pacer is a great site to use. It is relatively inexpensive to access
the dockets and the documents ($.08 per page) and they will set you up an account and bill you ever 3 months or 6 months or you can just put it on a credit card.

Looks like the AG is trying to use the Ohio Supreme's opinion to bolster his motion to have some of the documents (evidence) tossed.

The wheels of justice grind slowly!

37. Merh, if you understand legal jargon, I would appreciate a brief
summary in plain English. And I thought Sargus was going to be dealing with this case? He was the one who overthrew the restraining order on recounting Delaware Co. and was considered to be the most impartial.

41. I have not read all of the pleadings.
Kerry/Edwards Campaign are intervenors and I believe their attorneys filed pleadings asking the federal judge order that the voting machines in ohio be seized and inspected by independent experts. I also believe they have asked for depositions. I am on dial up at home. I will review tomorrow and let you know what I understand the substance of the issues involved are. I do know that the Ohio AG has filed a motion to dismissed on behalf of Blackwell, stating that the reasoning in the Ohio Supreme Court is controlling. (Affidavits are not proper, etc.)

You can count on it every time. Anyone who takes any significant stand against the regime will be targeted. Despite the vast media scandal of having covered for *'s WMD lies, and the confessions that followed, nobody has been reprimanded or fired. But expose *'s military record, and they will hang, draw and quarter everyone who had a part in it, even though they were right.

It reminds me of Wellstone's death and the anthrax against Daschle, too. And it reminds me of the 8-year crusade against Clinton.

We can expect a lot more of this.

Think about it - 2 "slam-dunk" confirmations postponed until next week...Conyer's asks for an investigation...things aren't going as smoothly as they'd planned! Bummer! Then to top it all off...they've got to deal with four brave patriots who will not be silenced until true freedom and liberty is realized for all Americans! And for this, you have my utmost respect and admiration. Thank you for not giving up on the future of our country! Ours is a noble and just cause. The court will have to make a ruling on whether the legal arguments which would have been made in the electoral challenge either are within the current law, or whether they might reasonably be expected to change existing law.

Now would be a good time for irrefutable, concrete, evidence of malfeasance that would change the outcome of the Ohio presidential election result to come front and center.
