Kerry stays in the Ohio Greens/Libertarians election theft lawsuit
This morning (at 4:30 am), I received an email that many of us have been hoping for. It was from someone near the Kerry camp, and the email said that John Kerry has decided to stay and fight the Ohio election theft as part of the Greens' and Libertarians' lawsuit.

While I have sent out several emails this morning to people who are at the center of this lawsuit for confirmation, I want to believe that what I have just been told is true. And on that basis, I wanted to share this with all of you.

For weeks, this forum has been occupied with "will he or won't he?" threads, starting with DemoDonkey's thread started at the Atlanta voting rights march. Hundreds (maybe thousands) of us wrote John Kerry (some of us multiple times) to ask him to stay the course in Ohio. Ten days ago, I got a chance to do a little more.

Through a contact made here on DU, I had an hour long conversation early on a Sunday morning with the person who wrote me the email this morning. She said that Kerry's attorneys were still not convinced that fraud had occurred in Ohio. After asking whether they had posed for this month's Harper's magazine cover (the "see no evil, hear no evil" chimps), I reviewed just a smidgeon of the overwhelming evidence that we have marinated in on the 2004 ERD forum for the past ten months. And then I helped organize a flood of audio tapes of Ohio election theft experts to be sent to Kerry's camp from the National Election Reform Conference in Nashville, from the Houston Election Assessment Hearing and from the BradBlog radio archives. Within six hours, we had over a dozen MP3s emailed to Washington with hard evidence of the Ohio election theft for Kerry's attorneys (who should have already known this information) to hear and review. Within a few days, I got word back that our audio tapes were having an effect and that John Kerry was going to meet with John Conyers to discuss what was known about fraud in Ohio.

And then yesterday came word that indictments had been handed down in Ohio against corrupt election officials there. It's my belief that Cuyahoga County is the first of many Ohio counties that will have their election officials brought before judges to answer for the felonious behavior that helped ignore the consent of the governed and steal our country's soul.

And then the email early this morning that Kerry is staying in the Greens/Libertarians Ohio lawsuit. Again, I am working to corroborate this story and I will post here as more confirmation arrives. If any of you folks have heard anything, post it here also. But for now, I want to thank DU once again for being the righteous spider's web that links us together so effectively, so powerfully and so purposefully. Without DU, we would all be on Bourbon Street without a paddle these days.

Late word: As I was getting ready to post this, I got this email from my Kerry camp "contact":

"The information is good--you can rely on it--but I doubt there will be announcements--they just don't work like that. I could be wrong, but JK is pretty uncomfortable with calling attention to either changing his mind or to fighting the battles he fights. I wish he would be less self-effacing about these things, but it is part of his natural discomfort with horn-tooting.(Remember he fought Iran Contra AND BCCI and you never heard much about it).

"Anyway, please let people know you have it on good authority .... And thanks for all your care and time on this issue--it DID make a difference."

1. Thank you for all your hard work
on this. I hope the Kerry camp does join in that lawsuit. I think and have thought since last fall, that not fighting it has caused serious damage to our democracy - such as it is these days. Who knows what will come of it but that election needs to be challenged.

This is good news. Many, many thanks for working the connections you have and acting to do something about this.

I will never forget what dear Andy said he was told by one of Kerry's attorneys in Florida when Andy was down there investigating the November election.

That attorney said to Andy:
"Back off -- you are making US look stupid."

Good for you Bernie, and anyone who did what they could to influence Kerry / Edwards to at least leave their "friend of the court" brief in place in the Cobb v. Blackwell lawsuit.

Everyone please keep their eyes on this...

Bernie, are you OK in TN? We heard that some of you guys really got it (at least rain-wise) from Katrina, depending where in the Orange State.

and is working on the best route he sees to make it an EFFECTIVE battle, not one that pleases an audience begging for hot rhetoric.

If Kerry had sought out base-pleasing soundbites in the early stages of IranContra and BCCI, neither investigation would have moved forward at all.

You don't like his style, but if it proves to be more effective for the change this nation needs, then what are you going to do - Brag about how good it felt to dump on Kerry for a year while undermining his personal integrity and credibility?

Kerry was given information that it could not be won on the face of it, the
provisional votes, the Ohio courts, a non-existent Dem party, Blackwell kept
ignoring the law and subpoenas, and the media is still not buying into the
conspiracy. In fact, he held out longer than others' advised. Mark C.
Miller's recent article in Harper's admits how difficult going against the
media at the time. We still don't have discovery on those machines, central
tabulators. So many tried to be helpful with calling about incidents, but
ultimately not helpful because we came up empty. Too much time was spent on
smoke.

That said, he and Teresa went looking for the whistleblower, something of
pattern, anything to overturn. The fraud was done in many ways, from
disenfranchisement to vote switching on the computer. No one would admit on
record. Conceding is not binding if they found definitive proof from someone
who'd come forward. He still has two suits pending, despite PDA's misleading
email. Many more discovery efforts throughout the states, but they did too
much everywhere.

The Congressional Black Caucus did not want him to stand in January, but
look to the future. It wasn't to be about him, at that point understood
lost. We are in the minority trying for election reform, and even our own
Joe Andrews went awol.

The public at the time was still under the power of the press, and more than
55% didn't want a change. It would have to be during a war, and barely
knowing Kerry. Our own media was worse on Kerry than the MSM. There was not
a groundswell to topple Bush at the time, and their internals showing those
few points drop after the Bin Laden tape proves the fear. That's where we
were.

That said, Kerry believes in forward thinking. We lost state legislature
seats for 20 years until 2004, when we won. In fact, great advances, except
we lost Senate in the south in states we always would have lost. Clinton
didn't win the south. Texas redistricting took more House seats. So Kerry at
the top was not so terrible. Plus, we still have pro-security creds.

He's still trying to elect and build the Dem party from the ground up. He's
a public servant, like always. And a gressroots guy. Unfortunately, he had
to play by the margins to win, and not the way our diehards, nor I, would
have liked.

Bottom line to anyone, our own, they better had voted before passing
judgment. Reports show that more blue state popular vote would have given a
popular win, and bragging rights to force recounts, which weren't done
anywhere sufficiently. Most states still don't legislate enough of one,
impossible on electronic, which is why we need paper ballots. We can even
weigh them fast.

The Green Party presidential candidate is hardly anonymous. That information was posted within 24 hours of the initial thread posted here several weeks ago that was concerned with Kerry's potential withdrawal. It was also confirmed for me at the time by another principal in that lawsuit.

This new news comes to you in this form at the request of the person who wrote me. I don't doubt her but as I said in the OP, I am also working to confirm it with other principals.

Rather than be peeved that folks would be concerned that Kerry might withdraw and that we were willing to do whatever it took to communicate with him and discourage that action, be thankful that this "stay the course" news is being greeted so positively. And that millions of us still have Kerry/Edwards bumper-stickers on our cars and K/E signs in our yards.

I don't doubt Mr. Cobb, but I still think there might have been a miscommunication somewhere or that someone jumped the gun. Anyway, I'm sure our cards and letters didn't hurt.

I just wish folks wouldn't be so hard on the man, regardless. It seems it really doesn't matter. Does what some folks consider the right thing, he still gets shit. Does what some folks consider the wrong thing, he gets shit.

It just doesn't seem to matter.

39. Speaking from experience, I think its because people held high......
Really high, expectations about Kerry given his history....They expected him to stand up to everyone based on his honesty, his warrior qualities and how he was willing to do anything to get things done.

Everything about Kerry was presidential quality......the exact opposite of *. And that made a big difference....He let people down, especially republicans by failing to fight the fascists in Ohio that day.

It could all be made up for by convicting the scum. Its just it is still in people's memory from that day.

Rove. This has much less to do with honesty, decency, or bravery. Personally, I'm sick of watching KKKarl cut our leaders from the herd and destroy them. Anyone who thinks Kerry is keeping his head down because he's weak-kneed just doesn't see the danger. I'm convinced it is wise to fear KKKarl and his cronies. Not to be confused with a lack of courage.

Gregory White is the Special Prosecutor investigating Thomas Noe who's at the center of this scandal.

Special Prosecutor Baxter should NOT share the evidence with White!!!! White is a friend of Noe, Rove!!!

That is BAD!!!! All evidence and testimony Baxter confiscated must be shared with an independant special counsel, appointed by the GREENS!!!!!

This message MUST get out there!!!

Kkkarl Rove is facing treason charges and may be out of the picture soon, its time to pull out all the stops on him.....He's a frying fish, it is high time to rip open the Ohio fraud.

Look at what happened with Al Gore for example! So much has gotten done and we know their game. And if Kerry was going about this like Al Gore a lot of people would've gotten angry and tired of it etc. I remember someone said to me how they respected Kerry for conceding and not doing like Gore. This pissed me off since this person did nothing but bash Kerry. :mad:

there's so much going on against Kerry. And he's a prosecutor and any good prosecutor knows that if you want to win a battle you have to have the proof, but I am glad and hoping and praying Kerry is staying on this. Where is Edwards? Or can he not do much since Kerry is the top person on the ticket?

That's very good news. But I just don't understand why he was even considering dropping out. The reason that you state in your original post just doesn't sound rational.

The purpose of a recount is to see whether or not there was fraud. Does one have to be convinced of fraud before the recount in order to go through with it. If that's the way he thinks, I really do hope that we get a different nominee this time around.

How can an average person get a hold of a comprehensive package that contains the kind of convincing evidence you have? I once tried printing out 1/16th of the amount of articles I have saved to my desktop, and got as far as 2 copies each of 3 articles before I realized I had not set enough time before my meeting. I personally taped the Conyers hearing off of c-span, and have distributed it to a couple of friends. Is there anyone working on putting together a NICE DVD set of ALL of this evidence? Is there anyone here that wouldn't pay $50 just to have it on a shelf for their kids? To be able to have Election fraud house parties and really spread the word would be so much easier with good material. I am trying to put together a simple Power point presentation for my Selectman about the secret software, without appearing partisan. That means i can't use this election as an example because it was clearly all benefiting the GOP. Someone with the talent and the resources should put this together. you sound like you might have all the raw material.

If you want to win a case, investigation of the facts is pre-requisite.

I'm truly grateful that you put this info together for them; but if any substantial portion of it was new to them, I'm mystified.

The existence of this info, and much of its substance, has NOT been hard to discover.

I find it difficult to believe Kerry was ignorant of it. If he was, he should replace his lawyers or staff.

He also needs to start reading DU!

Don McTigue, attorney for John Kerry and John Edwards, appeared in federal court in Toledo, before Judge Carr, on August 30th, and told the Court that Kerry and Edwards intend to remain in the case.

Judge Carr set an August 2006 trial date.

Additionally he consolidated the two recount cases, Rios v. Blackwell and Yost v. Cobb & Badnarik. He gave the plaintiffs until September 15th to file amended pleadings (plaintiff's counsel had requested an opportunity to streamline their claims).

Judge Carr set a discovery cut-off of May 1, 2006, and ruled that any summary judgment motions must be made by May 15, 2006.

Thanks, Amaryllis, for posting raybeckerman's link. It's official now -- help is already here and it's not going anywhere until the Ohio election thieves are caught and punished.

In addition to this link, I heard directly both from Brett at Velvet Revolution and David Cobb, both of whom substantiated the good news. So folks, pat yourselves on the back one more time for speaking loud, long and reality-based truth to power (even to a power that should have been) and making a difference for the effort.

Now it's time to get/stay busy influencing local and state-level decisions regarding acceptable voting systems. There's lots to do and now is the time to be doing it.

But at least for today, I am reminded that John Kerry is on the job. And the best way to get our local officials to start paying attention to our election reform platform is to facilitate four-score televised perp walks in Ohio. It is time to get serious, and I'm glad to know that the person I helped elect President is still in the fight for the life of our country.

Thanks, Senator Kerry. For listening to us and then acting on what you learned. We're not going anywhere -- so let's keep talking (and listening).

Here is a BIG KICK for everyone who worked to bring this about.

David said that it's not official yet that Kerry will stay but Kerry's people attended the hearing yesterday and did not formally withdraw. A trial date has been set and they may actually get to have discovery (discovery IMHO would be a GREAT thing -- could get a lot of good stuff brought to light.)

Everyone PLEASE keep following this.
