SEC Opens Formal Invesitgation Into Diebold

Reuters is reporting that the U.S. Securities and Exchange Commission has begun a formal investigation into how Diebold recognizes revenue. In a public filing in May, Diebold has acknowledged that SEC staff had begun an informal inquiry but the company’s latest filing on July 27 reported that the investigation had been converted into a formal nonpublic investigation.

SEC investigations typically begin as informal inquiries. A formal inquiry is one in which the commission authorizes the staff to look at whether laws have been broken and carries the power to subpoena witnesses and documents.

Though both Diebold spokesman Mike Jacobsen and SEC spokesman John Nester declined to comment on the investigation, it was clear that the focus of the inquiry relates to Diebold's election division, Diebold Election Systems, Inc.

3. HOLY SHIT! Big news is an understatement!
Our only chance to rid the world of the madman and the rest of em. An honest vote is our only hope as we don't seem to have the guts to hit the streets when elections are stolen like the great citizens to the South of us. If millions would have hit the streets and Kerry would have not so quickly given up things would be different now.

5. I wonder if the RFK Jr. suit triggered this..
If there should be a case filed on this - would it delay the first suit?
Can his Diebold whistleblowers be subpoenaed and gagged?

9. My first thought also. Is this an attempt to shut this up until after the
elections. Will they delay and delay and then say "move along, nothing to see here"?

11. Nah, this is totally unrelated. the Kennedy suit is about
Kennedy's suit is a whistleblower suit, on Diebold making false claims to consumers.

This SEC thing is an investigation into their accounting practices and how they are keeping their books.

I thought Diebold was stealing elections for idealistic, patriotic reasons, like having Jesus bomb the gay Mexican stem cells.

Don't worry about this one going anywhere, though. The SEC is doing what everyone else in the Bush Administration does: make a sham of policing themselves or anyone else and firing anyone who dares to testify to the Senate Judiciary Committee about it.
