The real story of impending election fraud in Memphis, TN -- read and weep
The following is a letter that I sent to Governor Phil Bredesen, Harold Ford, Jr, and our Tennessee Democratic Party chairman, Bob Tuke, several weeks ago. It tells a chilling story of what we discovered when we successfully got the central vote tabulator impounded in Memphis after the primary, and examined its innards. The amount of illegal software on the machine was mind-boggling, the number of times that the tabulator had been accessed after the primary to introduce new software was unbelievable, and the complete lack of concern of our State Election Coordinator and the Shelby County Election Commission spoke volumes.

While the Rethugs get their panties in a knot because of a handful of missing Smartcards (which I'm not that crazy about either), here is the real story of how easy it is going to be to steal the election in Memphis, in most other counties in Tennessee that have had Diebold shoved down their throats, and in too many other places around this once great nation.

I am sending this thread to Keith Olbermann in hopes that he will cover the real story of how the votes will be flipped in the birthplace of the blues on Tuesday. Peace out.

Subject: The upcoming election train wreck in Tennessee and a plea to prevent it

As a life-long Democrat and someone who believes strongly in the power and
genius of the "consent of the governed" as the basis for establishing the
legitimacy of our government, I am writing to make you aware of what will
likely be the largest scale election fraud ever perpetrated in Tennessee
and to ask you to do something to prevent it. As someone who personally
registered 909 voters in the 2004 election, I am committed to free, fair
and verifiable elections; and I am confident (and very disheartened) that
the 2006 election in Tennessee will be none of the above.

Anyone who has paid attention to issues of election security over the past
few years can cite hundreds of examples of where this unverifiable voting
equipment has caused problems. Here in Tennessee, our own recent primary
gave us ample examples of the unreliability of this equipment. Equipment
failures, both hardware and software, occurred in many counties, most
notably in Williamson county. In addition to the equipment failures that
we are aware of, we are completely unaware of problems that may have
occurred (intentionally or unintentionally) to affect the accuracy of the
reported vote count. However, efforts by four candidates in Shelby
ounty -- Shep Wilbun, Sondra Becton, Vernon Johnson and Otis Jackson --
to challenge the propriety of their primary have surfaced evidence that
should concern all of you very much. These four candidates filed suit to
gain access to the voting equipment used in Shelby County and the vote
totals recorded there. Here is a small sampling of the chilling findings
of the review conducted there by a qualified computer software and
hardware analyst:

"Shelby County ran its August 3, 2006 election in a fashion that violated all basic security procedures.... Evidence from election official declarations and discovery documents obtained in litigation reveals that:

- Illegal and uncertified Lexar Jump Drive software was loaded onto the Diebold GEMS central tabulator, enabling secretive data transfer on small USB "key chain" memory devices.

- Other uncertified software of various kinds was loaded onto the system and, according to the event logs examined, was used. This opened the door for hand-editing of both vote totals and the reporting of election results.

- Evidence of actual attempts to manipulate election reporting results was found.

- Shelby County election officials opened the central vote totals repository to widespread network connections via the internet from all county government computers and, through them, from the internet.

- PC Anywhere, a software program which would allow opening the central tabulator to remote outside control and manipulation, was found on the central tabulator, and no explanation was given for the presence of this uncertified and highly risky software on the tabulator.

- MS-Office 2000 Professional software was also loaded on the central tabulator. One of the software programs contained therein, MS-Access, can be used to change vote totals on the software used by the tabulator without leaving traces that these manipulations had occurred."

This is only a small taste of what has been found in Shelby County through
discovery that indicates that every county using Diebold equipment in
Tennessee is ripe for (undetectable) election fraud in our general
election. When called to testify about these problems, Brook Thompson
dismissed all of them as unimportant and thereby showed himself to be a
servant of the voting machine companies (and their Republican owners),
rather than a servant of the citizens of Tennessee. Now it is up to the
three of you to do something to prevent the theft of our next election
and - through that theft - the maintenance of illegitimate control of our
government by the radical right-wingers now in power.

At this point in the campaign, every Democrat paying attention should be
excited by the prospect of what we should expect on November 7. Nationwide
polls suggest that Democrats will take back control of one or both houses
of Congress, with the projected shift in power on a scale seldom
experienced in this country. Democrats lead Republicans in all aspects of
polling on both policy and character-related questions and President
Bush's approval ratings are in the tank. And yet, with the clear prospect
that the Republicans will lose their stranglehold on Congress and, with
that loss, that in-depth investigations of numerous violations of national
law and international treaties (and even impeachment proceedings) will
follow soon after, President Bush seems oddly unconcerned and both he and
Speaker Hastert have spoken with confidence that the Republicans will
retain control of the Congress and all branches of government. Why on
earth, in the face of such deep and widespread disgust with the Republican
party, can Bush seem so unconcerned?

I would suggest that it is the same reason why Bush remained in the White
House in 2004, in the face of exit polls that showed that the American
people had overwhelmingly rejected Bush and elected John Kerry as
President. It is the same reason why Senator Max Cleland reached election
night (2002) with a 15 point lead in Georgia's polls, only to wake up the
loser. It is the same reason why you, Congressman Ford, will be favored by
a majority of Tennessee voters (perhaps a sizable majority) the night
before the election, only to wake up yourself also a loser.

As all of you know, our group, Gathering To Save Our Democracy, has worked
hard over the past two years in Tennessee to get Tennessee counties to
choose voting systems that use or produce paper ballots, so that if there
is any reason to question the results of an election, something (paper
ballots) will be available for recounts. Despite our best efforts,
Tennessee's State Election Coordinator, Brook Thompson,
and our Secretary of State, Riley Darnell, have succeeded in
insuring that Tennessee's coming election will be the most insecure and
unverifiable election in our state's history. Those two state officials
(neither one of them either intellectually or morally qualified to serve)
have not only replaced verifiable voting systems with proprietary,
unverifiable touch-screen machines, but they have succeeded in making
Diebold the most prevalent voting machine provider for our Tennessee
counties.

What can you do? Here are four suggestions:

1) Familiarize yourself with the Shelby County situation. Go to
www.bbvforums.org/cgi-bin/forums/board-auth.cgi?file=/1954/44242.html and
get the full report of what was learned in Shelby County. This site should
link you to depositions and affidavits filed there.

2) Explore any remedies that are available to us right now that would
allow Tennesseans to vote on emergency paper ballots in the upcoming
election. Nothing less is acceptable, anything less will insure that
Congressman Ford will not represent our state as our next rightfully
elected Senator.

3) Go public with your concerns. Encourage everyone to vote but tell them
that the known security problems associated with this highly risky
equipment are just too dangerous to use that equipment for anything as
important as our next election, that emergency paper ballots are our only
safe recourse.

4) Begin immediately to investigate Brook Thompson's ties to Diebold and
the other unverifiable voting equipment vendors he has foisted on our
state. As you may remember, Brook's predecessor was convicted of bribery,
back when the stakes (and the money) were not nearly so big. An
investigation of Brook Thompson, and why he has placed the integrity of
our elections at such grave risk, is long overdue.

Think about it this way: Governor Bredesen, there is nothing to prevent
every vote for Governor in Davidson and Shelby Counties from being
recorded for your opponent, with your having no recourse to ask for a
recount, other than the patent absurdity of that result. There is much
less to prevent votes from being shaved in every county from Congressman
Ford and shifted to his opponent, particularly since a loss in a race that
is being marketed as "close" would not seem quite so absurd. Regardless of
the apparent absurdity or plausibility of either result, they are both
possible with this new equipment. And the recourse for either result would
be equally as unsatisfactory - since nothing will exist to recount in
either event.

There is a fifth option you (and we) might have to explore. Google "the
battle of Athens (TN)" and read about how a group of World War II
veterans, faced with the prospect of a stolen election in McMinn County
after the war, stormed the National Guard armory, grabbed rifles and
dynamite, and fought a day-long battle with a corrupt sheriff and his
deputies to rescue their ballot boxes and throw the rascals out. Please
prevent a reprise of the Battle of Athens in our state, if for no other
reason than the next time, there will be no ballot boxes to rescue. You
must act preemptively to save our democracy. We're happy for you to get
around in front of our parade - we'd be thankful for the company and the
leadership. After all, it's only the legitimacy of our government we are
asking for. Thanks for your attention and your swift action.

2. Thank you. I'm here in East TN and trying to follow all this info.
We use the Hart Inter-Civic(?) system.

I'm Election Officer for my precinct, but there's really little I can do about what's on the machines. We set up what's delivered, make sure that we operate the election process fairly and accurately, then deliver the cartridges back to the Election Office at the end of the day.

We'll do everything we can to make sure our part is clean and honest, but we have no say over what's been put on the machines ahead of time or what's done with the data on the cartridges later.

7. Are the vote totals for the candidates posted in the
precincts after the polls close? One thing you could do to help mitigate the potential hacks/malfeasance being discussed in the OP is that you can keep a record of what the vote totals are for each race on the ticket, if that's not already a standard election procedure.

Here, the evidence of tampering is at the central server level, so if vote totals were manipulated, an audit of the totals from the precincts against the state's certified results (from the central servers) would show discrepancies if there was malfeasance or server errors.

Of course, if the code in the DREs and optical scans in the precincts statewide has been intentionally manipulated or if there is a computer error, say in the ballot definition files, then the totals from the precincts and the central servers could match and the election results would still be inaccurate.

12. We are trying to get the League of Women Voters to do this...
... since they have a greater statewide reach than we do. But they are an interesting group these days, having worked actively in support of DREs at the national and state (e.g., Mississippi) level in recent months.

The documentary is called "Eternal Vigilance: The Fight to Save Our Election System". It will give you a powerful tool for educating folks about this serious threat to our democracy. I ran into someone in a grocery store this morning who had seen the film on Wednesday. She bought a copy to send the chairman of our State Election Commission, someone we've been trying to get through to for over a year. Will miracles never cease?

Fraud comes in all kinds of shapes.

My own little piece of evidence for this one is that after I read the first MP piece, I contacted David G. Mills in Tennessee, and he'd had a call from the pollsters as well. Genuine poll samples are normally in the hundreds. I don't know the population of Tennessee, but my guess is that the chance that the one person I happen to know there received a call, if the poll was a real poll, is extremely small. So my inference is that a large proportion of the entire population of Tennessee were "polled" in order to spread this junk. AKAICT, Ford's poll numbers dropped sharply short after people started reporting this push poll.

Anyone have any more information?

I have heard about the "push polls" here in the Orange State, but frankly there is so much crap being slung by the Smirking Chimp's flying monkey minions down here that it's hard to keep track. I don't care how honorable a man Bob Corker once was -- if he is in bed with these racist, anti-American election thieves, he'll never get the smell of sulphur off his $1,000+ suits.

I would really appreciate as many DUers as possible taking a few minutes to send this story out to CBS, CNN, NPR and any other news outlet (most especially newspapers that have done a legitimnate election fraud story in the past week or two) to let all of them know that what we found on the Diebold central vote tabulator in Memphis is very likely also on every other Diebold machine in the country.

I am glad that some of the slumbering beast that is the corporate media is finally waking up to this story -- likely too late to do anything about it. Here in the Orange State, we see evidence for media suppression of this story every day. We set up a meeting with our State Election Coordinator (sic) this week and invited a local NPR reporter to join us. She got pulled off the story literally a few hours before the meeting. Then last night, a story about our concerns which included an interview with one of our Gathering To Save Our Democracy members made it on the 6:00 pm news on Nashville's Channel 4, but not on the 10:00 pm or Saturday morning news and the story was scrubbed from the TV station's web-site.

Ignorance might be bliss, but it also enables fascism. Corporate media, you're killing America (not so softly) with your intentionally missing words about this story.

I remember seeing Rove had installed computers in the White House to observe the vote results as they came it.

With these two tools

much more serious alterations can be made than merely observation of the remote counters.

Also if with PC Anywhere anyone has access to the counter PCs then they are probably open to the universe as well. Some teenager in a foreign country could manipulate the data to elect Mickey Mouse.

What they found should alarm all voters, Republican and Democratic alike. This letter could open some eyes if you can help them to see why election integrity is important to them. Accusing Republicans of stealing elections won't reach Republican voters. But they already beleive al Qaeda wants to influence our elections. Ask them if they feel comfortable with our voting systems exposed to the internet with no way to validate Osama bin Ladin's surprising "write-in" victory.

Documented Election Law and Security Violations in Shelby County

Shelby County’s conduct of the August primary election may have violated basic election system security procedures. Documents released earlier this month reveal multiple breaches of security and cast doubt on the legality of the election process.

As part of a lawsuit alleging illegal voting brought by four unsuccessful candidates for clerk positions, election officials’ declarations and discovery documents call into question the election results. Although their case was dismissed October 5, Shep Wilbun, Sondra Becton, Vernon Johnson and Otis Jackson have performed a valuable service. Jim March, a computer professional who examined the county’s Diebold voting systems as part of this legal case, calls his findings “some of the most irregular procedures in America today. Nobody else in the Tennessee elections process did their jobs except for these four candidates and a handful of citizen supporters and researchers.”

March’s inspection of the Diebold voting system, performed on behalf of the 4 defendants, focused on the central vote tabulator. Computer event logs show major security violations including:

1. At 6:30 pm on Election Day, Shelby County’s main vote tabulation computer was connected to the internet through Shelby County’s computer network. Election officials claim they did this to allow electronic transfer of voting results from four regional elections offices across the county. This county network connection allowed access to the vote tabulator for anyone with access to the county’s computer network..

2. The day after the election, after 4 attempts, someone succeeded in loading uncertified software onto the Diebold central tabulator. This software enables data transfer on small USB "key chain" memory devices. Such devices can easily hold the entire file containing Shelby County’s primary election vote totals. This raises questions as to whether hidden vote manipulation may have taken place.

3. On 8/7/06 someone loaded a complete copy of Microsoft Office Professional 2000, including MS-Access on to the vote tabulation computer. This program is well known as the simplest way to edit the contents of a Diebold central vote database (and banned for use in elections in virtually all jurisdictions nationwide). It cannot be secured against tampering.

4) Evidence of actual attempts to manipulate election result reporting results exists. The computer event logs show repeated failed attempts to use an HTML editor. On 8/22/06 for a period of over an hour -- and during a period when the voting equipment was impounded by a temporary restraining order -- someone attempted to edit computer data files on the main Diebold server. The only significant files on it are vote total reports.

5. A copy of PC Anywhere, a program allowing opening the machine to outside control was found on the backup central tabulator computer.

State Election Coordinator Brook Thompson, who testified in the lawsuit, claimed nothing was amiss, while citizens in Memphis and elsewhere disagree.

“Shelby County election officials need to examine conditions that may have permitted unauthorized access and installation of software. Otherwise voters in this county (and ultimately the state) can have no confidence in the integrity of the November election,” said computer expert Joe Irrera of Nashville, a member of a non-partisan voting reform citizen coalition, Gathering to Save Our Democracy and Common Cause TN. “It's hard to explain these violations of known standard security practices in election processing,” he added. “Our group simply wants to see that votes are counted accurately in November. The Secretary of State and the Coordinator of Elections have a duty to the citizens of Shelby County.”

Irrera suggests the following 5 corrections that, if made immediately, would go a long way to fixing these problems:

(1) Remove all unauthorized and/or uncertified software (including the Lexar Jump Drive encryption software, PC Anywhere, Microsoft Office Professional, and the HTML editor) from the GEMS central tabulator and backup tabulator:

(2) Change all administrator passwords;

(3) Insure that the Shelby County central vote tabulator NOT be connected to any network (via Ethernet card, wireless card, infrared port, USB port or modem).

4) From now until the election results are certified, all central tabulators need to be physically protected from unsupervised access by anyone.

(5) Before the polls close, audit all central tabulators for the presence unauthorized software.

29. I visited the Maury Co (TN) Dem HQ today
I left blue in the face and frustrated from trying to explain all of this to Guy Derryberry and Gary Ledbetter ( past Chairman of the Tenn Dem Party). I was in Gary's class in High school, so I guess I've known him 40 years now.
No matter what I said He kept repeating "the people who are against the machines have lost all their credibility.
It's all just talk. I wanna see some proof." to which I kept repeating " Give Me your email address. I'll have it in your email
box by tommorrow morning" This went back and forth, over and over, at least 20 times. He never gave me his email. On the other side of the room, the TV screen had in two inch letters " VOTING MACHINE PROBLEMS WIDESPREAD". He doesn't want to see.

This is how Guy faired against Tom DuBois today. In 2004, he lost to him by only 900 some odd votes:

Tenn. House 64th District
Candidate Votes Percent Winner
Guy Derryberry (D) 9,185 47%
Tom Dubois (R) 10,565 53%
Precincts Reporting - 18 out of 18 - 100%

In 2004, if he had contested and asked for a recount, according to the numbers for spoilage we got from election superviser, Todd Baxter, There was enough spoilage that he might have just prevailed. But they were using ES&S optical scan ballots in 2004.

Now, they use ES&S iVoteronic DRE's. There's nothing to recount. no paper.

You can't tell those guys anything. They think they know it all.
