How does Bev have the power to "Lockdown"?
It was just described with putting seals with her signature on them...

There is no federal court order, so what is the deal?

Is this like a citizen's arrest? DOes she have citizen;s arrest tape or something?

There's a huge, long update.

Here's the beginning of the update:

TUESDAY NOV 16 2004: Volusia County on lockdown
County election records just got put on lockdown

Dueling lawyers, election officials gnashing teeth, Votergate.tv film crew catching it all.

Here's what happened so far:

Friday Black Box Voting investigators Andy Stephenson and Kathleen Wynne popped in to ask for some records. They were rebuffed by an elections official named Denise. Bev Harris called on the cell phone from investigations in downstate Florida, and told Volusia County Elections Supervisor Deanie Lowe that Black Box Voting would be in to pick up the Nov. 2 Freedom of Information request, or would file for a hand recount. "No, Bev, please don't do that!" Lowe exclaimed. But this is the way it has to be, folks. Black Box Voting didn't back down.

Monday Bev, Andy and Kathleen came in with a film crew and asked for the FOIA request. Deanie Lowe gave it over with a smile, but Harris noticed that one item, the polling place tapes, were not copies of the real ones, but instead were new printouts, done on Nov. 15, and not signed by anyone.

6. i know if they touch it, it has to go to court, so maybe they
don't want to blow it up and end up in court? (that's what she said on the interview w/M. Malloy) There are lawyers floating around here...I'm just a college student, sorry can't help much

16. Not true
a FOIA request entitles you to the items on your request - nothing more, nothing less.

If state law protects the items you request through FOIA, they don't even have to produce what you ask for.

Certainly, nothing in FOIA gives anyone carte blanche.

valid reason. Is that when she was allowed to lockdown?

14. yeah, the news article didn't say anything about poll tapes in dumpster
But reading the account of the poll tapes and the trash bag and police on blackboxvoting.org seems... odd. I mean, I want to see bev blow this whole thing open, but something seems weird.

She goes to the election warehouse, and lo and behold, someone has the poll tapes she wants right in their hands, and then there is a trash bag with tapes sitting there right in front of her? Seems too convenient. She said that Wynne was videotaping; it would be interesting to see the videotape.

18. Haha, well these are just county officials, they prob. are not the best
at keeping secrets...

They probably freaked out when she came there and tried to clean house. Bev anticipated that by going to the warehouse and found them doing just that. Hense, the bag with exactly what she was looking for. It doesn't seem all that strange to me.
