My response from Barney Frank RE: Election Fraud
I wrote to Barney Frank shortly after the first info from Ohio hit DU. I was very insistent that he begin investigations into Ohio, Florida, NH and other questionable states based on the Ohio info and the exit polls issues. Here is his reply, dated 11/22:

In other words, it is not a lack of concern that may put and end to our efforts to fight this, but the unavailability of any place in which we can make the fight.

So, they (the Dems in Washington) see the issues and support our claims but it seems that there is no place to make the case where we will not be laughed out of the room. The only thing left is for us to take it to the streets and get some public support in the fight. We have to want it bad enough to be willing to stake our lives on it, not unlike what is happening in the Ukraine. We have to want it bad enough to seek support from other nations as well. If we don't do it now, we can kiss all our hopes of leaving a better world to our kids goodbye. We will be leaving them to a one party, big brother knows best world.

I don't know about you, but that is unacceptable to me. The fascists have to go!

1. I wrote the same thing here when someone was pounding on Kerry
for not doing something. With the Repuke mob controlling nearly everything, who do we go to with election crimes or high crimes of treason?

but all of us have to really pay attention and make sure all our friends are helping and starve the beast. here is the link where we can all find out who is supporting these bstrds and who is supporting us http://www.followyourmoney.org get the list and make plenty of copies and give them to everyone you know imo we must do this in conjunction with demonstrating and telling everyone we know. the ukrains have been demonstrating for seven days in the snow and rain with nothing but barrels used for heat. have we grown so fat and complacent that we can't do this to protect this fragile democracy for our childre. if there was some way we could comunicate with the ukrains. they have the world presses' ear and let them know the same thing happened here. do any of you du ers
have friends in the ukrain or any addresses we can all email? any press contacts. it might help if we all sent letters to the ukrainian press. links anybody

all the more important to fight. We MUST fight. The alternative, not even trying, ensures our defeat.

I don't understand why people don't get that. It's the DEFEATISM that will kill us.

And it sure is a drag on those of us who are doing our small little parts to make a fucking difference to see people advocate rolling up into a ball, pretending to be already dead.

And that includes Barney Frank, for whom I used to have a lot of respect.

that's the least they should be doing.

It's depressing, but at least it would show their heads aren't up their asses.

Frank should really figure something out. With this anti-gay crusade going on, his seat will go asap.

to start an investigation? we've got the congressmen what about a senator? barney frank is a senator. i know people in calif are camping on barbara boxers office door. how can we further that and make sure we have a senator to stand and call for an investigation? kerry is of course a senator do we all need to email him?

I appreciate Senator Frank's advice, but there are other ways to achieve our ends if the Repubs thwart our means.

We just have to think a little harder about how to accomplish our goals. To me, the most important thing, besides the effort of "the people," is to get some big name Democrats on board. And if they don't stick their neck out, make their lives miserable by constant writing and telephone calls.

i was reamed as a doomsayer a couple days ago...

sounds like 17,000 Kerry lawyers would have known there was no legal venue to press for an action by now...

I'm disappointed by Barney- especially since he wanted Kerry's seat...

this is a battle for enfranchisement... a constitutional issue...

it seems that whether the courts are republican or not, you still use the avenues that do exist to make your case... while cultivating other avenues.

shit. such unbelieveable cowardice. in 2000, it was sheer out-strategizing. In 2002, it was foolish failure to learn from 2000. In 2004, it was staggering incompetence and a lack of imagination. How could we have been so unprepared? To wait until after the election to prove fraud, and then discover there is no legal recourse to challenge it? And Barney, the smartest person in COngress is parroting this crap?

And they expect me to stick around until 2006?
at this point, the rationale for supporting a third party isn't the repugs, it feels like its the dems.

i recognize we were screwed. i guess i expected a little more than a whisper of a december surprise and some shrugged shoulders, better luck next time.

27. Don't be disappointed in Barney
this is a dialog that is just beginning. What you are reading is just what many here have been expressing - frustration, depressions and disbelief in our situation. This is the first of many dialogs we will have I am sure. With encouragement from us (the people) he will continue to be a voice for us and if we all work together we just might be able to brainstorm some way around this thing. Always remember, BFEE and their ilk are everywhere in Washington. Admitting that he shares our feelings and questions and is asking questions of those on the ground as well as this fellow Reps is more than I have seen from others in his position.

If we keep the pressure on them, the ones that are there to be our voice and have more clout than we do at this point and support them in their efforts, we might just get somewhere.

Where ARE the people demanding transparency? Not out in the streets making our displeasure known. Not demanding that we get answers in a way that can't be denied.

We need to learn the lesson from Kerry himself. We must be visible, determined and patient. We are not going to change things in a day, a week or a month. We must do all the things that have been suggested by his fight in the 60's. We must band together and present our case to the public (and maybe it's the public of the world where our best support is right now) with facts and with conviction that this is the most important thing we have ever done or will ever do in our lifetimes.

We must be willing to be that fated student at Kent State to effect change. We must be willing not to accept the status quo nor go along to get along anymore.

The biggest problem I see is, we are in an economic box. We are tied to lives that involve responsibilities (children, homes with bills, cars, retirement funds, etc.) that have to be weighed against what we will lose if we remain silent. What we will lose is a way of life for our children and their children is we don't "bet the farm" and work our asses off now.

We must come together and share the burden of saving our nation and we must do it soon.

So, allow Barney the time to grieve as well, then tell him to get off his ass and get moving because we depend on his voice bringing others to our table too.

but i still think you have to take it to the courts because that is one of the remedies we have a constitutional right to, and it will keep the issue alive in the eyes of the republic.

someone wrote iin another thread about October 15 1969- Moratorium Day... it was one of the most powerful days i recall...

another thread posted the idea of wearing a black ribbon until this all gets put right...

Civil Disobedience and any legal means are now authorized.

Now who wants to talk about marching?

I know one thing that may be effective, (will be effective)

Take this letter, print it, make sure it is crumpled up and leave it at public places, so people can pick it up and ahem read it... human nature being what it is...

Oh and start wearing something that will identify all of us at all times... I sugest a neckerchief, or just a piece of blue clothing at all times...

The Ukrainian candidate stood up when the results came in - Kerry sat down. I would rally for Kerry, but it is hard to be taken seriously when most people perceive that our leader has quit on us.

The unanimous Declaration of the thirteen united States of America,

When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. --That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Franks and the other elected Demos can start SCREAMING IT FROM THE ROOF TOPS!!! JeezuzH!!! "It's not easy to figure out a way..."

They need to pursue ever legal avenue they can, file every lawsuit imaginable, debate the issues in the house and on the floor, ride the Justice Department until they are blue in the face.

To say they can't think of anything to do is outrageous. We sent them to congress to represent us, damn it, they should be representing us.

And I don't doubt they are busy with a thousand other things besides this issue. BUT they have GOT to get this through their pointy little heads: They CANNOT play nice with these bastards. The Dems cannot do this. They cannot win so they gave up. Nevermind the credibility they would lend to the fight if they came out and explained to the people all the evidence we have:

-The fact that the Republicans killed the paper trail. (This alone should have been made a HUGE issue when it happened)

-The studies from reputable institutions pointing to massive fraud.

-The hard evidence collected by BBV in Florida.

Have they screamed bloody murder about any of this? No.

If they could at least break the cone of media silence we could do the rest ourselves. Goddammit they are pissing me off! It is sobering to realize that in the fight of our time, we are faced with vast numbers of cowards as well as criminals.

Both Major Political Parties have failed us.
We must march and uncover the truth for the people.

What, they think they got a job at 7-11? Get out there and fight and scream and agitate for the preservation of DEMOCRACY, ya chickens! We elected them for a reason. If we wanted somebody in office who would just stand around and shrug when our democracy is threatened, we needn't have bothered to elect these congressmen and senators, we could have just hired the kid from the local copy-shop.

WHY do we call them "leaders"???

I can understand that there may be no legal recourse, but I do NOT understand why they hide in their leather-upholstered offices, rather than leading street marches.

It is up to US to make enough noise to get the attention of those on the fringe that think something is wrong but don't have the time or inclination to investigate on their own. We need to make it so uncomfortable for things to be "business as usual" so we can mobilize those that aren't fully vested in the fight too.

We have to be willing to leave our own personal comfort zones to effect a change. That means sacrifice just like what is happening in the Ukraine. We need to make our voices heard and not be swept under the carpet again.

We MUST!

They should ask all Democrats and members of other parties who believe voting should not be rigged to take to the streets in protest. The leaders should name a specific date and time for simultaneous demonstrations in front of the Capitol in Washington and in Capitols of all 50 states. Invite the big progressives groups like Moveon.org and Democracy for America (Dean's group) to attend the conference, too. They could send out word over the Internet grapevine to mobilize busloads of protestors to DEMAND that Congress and the Courts take action. As long as the GOP weasels can hide in obscurity, they will do nothing. The Dems should also announce plans to send a flyer to EVERY VOTER OF EVERY PARTY informing them how the GOP thinks rigging elections is just fine--with details to back up the assertion.

It's Slate of Electors should be rejected by the Electoral College when it votes.

That's the Constitutional remedy; Democrats need to adhere to it.

Another way to combat this is to leak information to the foreign press. Attach to it a paraphrase of Bush*s own words: "the world is watching you." Start with The Mirror.

Been following these threads....a few thoughts

Each state decides the manner of elector selection. It is not a requirement to even select them by popular vote(at one time, some state legislatures picked them, as US Senators were once picked)

Of course, all states DO give the electors to the winner of the popular vote(NE/ME exception. split)But in the end, the final ruling on what electors are send to the Electoral College is clearly decided by that state legislature, NOT the courts.

Article II, Section 2, Clause 2: "Each State shall appoint, in such Manner as the Legislature thereof may direct"

12th Amendment: "The Electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice-President, and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate; -- the President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted; -- The person having the greatest number of votes for President, shall be the President"

So once Ohio's electors forward their votes, the Senate opens the votes and there are 20 votes for Bush, one or two or 50 Senators may object.....(only 44 Democrats + Jeffords now)but in the end, Bush will have 286 EVs....and be President(again)...I do not see anything about the Senate/House approving them, and even if that is so, both houses are solidly Republican now....as they are the NEW Congress(same as the old boss, LOL)If somehow the electors are blocked(fillibuster?)....then the House votes Bush due the Republicans controlling more state House Delegations, (28 I think) and the Senate votes Cheney.......same result as the EV count...

So, with a Republican Gov and House/Senate in Ohio, and SCOTUS clearly on the side of Bush.....how are we gonna stop this? Protests and posts here certainly help rally the faithful.....but is that gonna get it done?

I guess the only way is to either overcome the 130k vote lead Bush has(not looking good), or prove MASSIVE fraud, but if those Ohio electors vote Bushx20...it I feel is ALL over....sorry to not have more cheery news, but thats what the Constitution says, and short of a Constitutional Amendment, its the Supreme Law of the Land....

Also, I often hear the words "Constitutional Crisis" if the House were to select the President, and the Senate the VP....but since they are doing exactly what the 12th Amendment says, how is that a crisis?

Anybody got an answer to these facts, sucky as they may be? I am listening, and thanks for the kind welcome from so many to a newbie!

I received this hard copy reply from his office on Saturday. I didn't have time to post it until last night though.

I have since written to him again and requested that he inform me of when he will be in his local office so that we might meet in person as well.

Barney is a straight from the hip kind of leader. If there is anything that we can present as a viable path, he will step up to the plate. He is secure in his position here in MA and has been through the "fire" before and survived. He is one tough old bird!

I realize that you don't know me, thus your question of it's authenticity. I assure you that I have the hard copy to back up this post should I ever need to produce it in person.
