Bonds trial delayed
Federal prosecutors will appeal a judge's decision to exclude evidence of three positive drug tests from Barry Bonds' perjury trial, likely delaying its start for several months.

Prosecutors notified the judge of their intention to appeal a couple of hours after Bonds' personal trainer, Greg Anderson, said at a Friday morning court hearing that he would not testify at the slugger's trial.

U.S. District Judge Susan Illston had barred prosecutors from showing the drug tests to the jury unless Anderson took the witness stand to authenticate them.

The Feds have no case..they're just prolonging the inevitable. Plus the judge is none to happy with them:

A reluctant and annoyed Illston told lawyers earlier Friday that the government's action would force her to halt the trial. She said she had little choice but to wait until the 9th U.S. Circuit Court of Appeals decides the issue.

1. How were the drug tests administered?
I understand Anderson would be required to authenticate any calenders, schedules or other paperwork that may be connected with Bonds, but I thought the drug tests were administered by MLB. What does Anderson have to do with them? Are they not permitting the drug test results unless they have the other documentation that they want Anderson to verify?

2. These 3 tests
were actually seized in the raid on BALCO in 2003. They are alleged by prosecutors to have been collected and dropped off by Greg Anderson.

3. The tests in question were done by BALCO before there was any
MLB steroid testing. The problem is BALCOs records were not good enough to show a chain of custody or to positively identify the samples as coming from Bonds. The only person who could say "Yes. These are Barry Bonds samples" is the person who took the sample from Bonds, took it to BALCO, and received the identifying number.

That person is Greg Anderson, and he is refusing to talk.

in progress.

What a disgrace, but I'm happy they continue to infuriate the judge.

One nail at a time .. but it's unfair to hold an innocent man like Barry hostage in the penal system for so long.

5. Yeah, it's a sign of desperation all right
If they had a case as it stands now, they wouldn't be appealing the judges decision.

Looks like the persecution of Bonds will be dragged out a little longer....pleasing the Bonds haters, as it gives them a little more time before having to face the reality of a not guilty verdict.
