Groups challenge domestic partnerships as unconstitutional
Madison — Supporters of Wisconsin's ban on same-sex marriage and civil unions have asked the state Supreme Court to declare a system of recognizing domestic partnerships unconstitutional.
Under a provision that was part of the budget Gov. Jim Doyle signed in June, couples will be able to apply for a declaration of domestic partnership with their county of residence starting next month.
Allowing such domestic partnerships establishes a legal status that resembles marriage because it creates and acknowledges such relationships in ways identical to marriage - a violation of the state constitutional amendment banning same-sex marriage and civil unions, the lawsuit says.
"Elected officials should never pass laws that violate the will of Wisconsin voters who legitimately amended the state constitution in a fair election," Julaine Appling, president of Wisconsin Family Action and lead petitioner in the lawsuit, said in a statement. "This new domestic partnership scheme is a sneaky assault on marriage from those who are determined to redefine marriage in Wisconsin."
Appling was joined in filing the lawsuit by Wisconsin Family Action board members Jerry Hiller and E. Lee Webster.
