Calif. Supreme Court Upholds Gay Co-Parenting

The California Supreme Court on Monday upheld the rights of people in same-sex relationships to be the co-parents of their partners' children.

In three separate cases the justices ruled that partners have equal rights and responsibilities in raising and caring for the children.

"We perceive no reason why both parents of a child cannot be women," the court ruled.

Elisa B. v. Super. Ct. of El Dorado, No S125912 (Cal. August 22, 2005)
A woman who agreed to raise a child with her lesbian partner, supported her partner's artificial insemination using an anonymous donor, and received the resulting child into her home, is the child's parent under the Uniform Parentage Act and has an obligation to support the child.

A woman who provided ova to her lesbian partner, so that the partner
could bear children by means of in vitro fertilization, is a parent of those children.

Plaintiff is estopped from challenging the validity of a stipulated
judgment which states that she and her partner in a lesbian relationship are the parents of child born to plaintiff.
