. . . and more again on Cote-Whitacre et al v. DPH et al (SJC #09436, oral arguments on Thursday, October 6, 2005)

1.) For those who missed the Cote-Whitacre oral argument (webcast) before the Supreme Judicial Court (SJC), but still want to hear the oral argument in this case, Suffolk Law School/SJC have archived the live webcast here:

2.) For those who want further information about the 1913 Massachusetts statute at issue in this case, together with an audio interview of one of the gay couples (from R.I.) that are a party to this Cote-Whitacre case, as well as an interview of the lawyer (Attorney Michele E. Granda, of G.L.A.D., for plaintiff/appellant) representing the gay couples, a local NPR radio station (WBUR-FM 90.9) did a story on Thursday, October 6, 2005, and the audio may be heard here:

3.) For those requesting speculation as to the outcome of this case (and there have been several DUers PMing me), it's difficult to guess as to the legal outcome in this case despite favoring a party's legal argument as being on point in law. I've learned long ago as a lawyer never to assume the outcome of a case from the questions asked from the seven sitting Massachusetts SJC justices on the bench during oral arguments. Good news reporting won't speculate either! Note the word "good" in that last sentence. The better tactic is to wait patiently. And, when it comes to this case, I won't speculate as to a timeframe when the SJC opinion will come down.
