GOP Warns Washington Supreme Court On Gay Marriage Ruling

As gay and lesbian couples in Washington anxiously await for the state's Supreme Court to issue its ruling on same-sex marriage GOP lawmakers are warning the court that they not the court should have the final say.

Arguments challenging constitutionality of the state's Defense of Marriage Act, which bans same-sex marriage, were made before the Washington Supreme Court last March. (story)

A decision in the case has been expected for months and could come down at any time.

Republican leaders from the House and Senate said after a meeting where they unveiled their 2006 legislative agenda that if the court rules the ban to be unconstitutional the court should leave any new remedies to the Legislature.

1. This is likely to backfire on legislators.
Judges resent being told how they must rule on cases. It is likely to make them wish to frustrate such meddling.

3. Typical GOP tact: willful ignorance of constitution`l checks and balances
I am apalled but not at all surprised that Mike Armstrong (R-Wenatchee) would be so blatant in his ignorance at how the checks and balances work.

The courts are the arbitrators of what is and what is not valid law. The Supreme Court is the final guardian of constitutional rights and protections. If a law violates the Constitution in any way, IT IS THE COURT`S DUTY AND OBLIGATION to strike the law down. THAT IS THEIR PRINCIPLE FUNCTION AND THE ENTIRE REASON THEY EXIST.

Why, oh why is this such a difficult concept for neo-cons to grasp?

5. Because you can't be a neo-con and support the concept of
a Constitution. This is one reason why the crazies support the theocrats of the Religious Right. You can't establish dictatorships and one-party government unless you attack and discredit all the other institutions which are provided by the Constitution to protect the public.
