After expelling a student for a same-sex kiss, officials at Covenant Christian Academy are claiming a constitutional right to ban homosexual students.
Jessica Bradley, who now resides in Pennsylvania, was expelled last April for kissing one female student at an off-campus sleepover and having a relationship with another.
Her family is suing the school for $1 million in damages for invasion of privacy, breach of contract and intentional infliction of emotional distress.
This week, the school filed an answer to the complaint, defending its decision on First Amendment religious grounds. The school raised the “ecclesiastical abstention” doctrine, which prohibits the government, including courts, from interfering in the internal issues of a religious institution.
