Corzine named as his own replacement Rep. Robert Menendez who has a long history supporting LGBT issues. Menendez would serve out Corzine's term in the Senate and then be forced to run on his own in November - a race he is expected to win.
Carl Mayer and Bruce Afran, Princeton Township-based lawyers known to accuse both Democrats and Republicans of subverting the democratic process went to court to fight the appointment.
They argued that such an appointment was illegal arguing that a provision in state law could be interpreted to allow a special election for congressional vacancies when the next general election date is at least six months off.
