New Marriage Setback For NY Gays

A midlevel New York state appeals court ruled on Thursday that it is not unconstitutional to prevent same-sex couples from marrying.

The court was considering an appeal by the American Civil Liberties Union of a lower court ruling that said only the legislature could decide whether gay and lesbian couples can wed.

The ACLU was representing 12 same-sex couples, among them New York State Assemblyman Danny O'Donnell and his partner John Banta. (story) O'Donnell is the brother of Rosie O'Donnell.

"In our opinion, the Legislature is where the changes to marriage" should be addressed, Justice John Lahtinen wrote in the 5-0 Appeals Court decision.

5. Bloomberg's PR machine is astonishing.
It had lots of NYC gays voting republican, on the grounds that he *said* he "supported marriage rights for gays". Meantime he ordered city lawyers to fight it in court.

Rationale: marriage question should be decided in the NYS legislature, not the courts.

Subtext: He knows the legislature ( Senate has been majority republicans for DECADES) will not vote for marriage in Bloomberg's natural lifetime.

Point to ponder: why are people so guillible?

6. I also understand
that Spitzer (yes Spitzer) threw the power of his office to fight against equal rights for gay people. There was a time when I was genuinely excited about him, thats gone. Seems like he is just another politico grandstanding on issues that are much ado about nothing. He had a chance to really lead by standing up for equality for ALL, but no. He could have done something to fight against the vapor vote machines and uncover the lies of 9/11, no. I may hold my nose and vote for just another politician or I may not, wondering if my vote even counts anymore I'm seriously questioning my participation in the farce. I wish a REAL leader would appear someday, but no longer really believe it. VERY depressed about the whole picture these days............
