An appeals court was told Monday that a lower court ruling that bars a man from living with his partner while raising his 12-year-old son is unconstitutional.

The argument was the center piece of a legal brief filed by Lambda Legal and the National Center for Lesbian Rights on behalf of Ulf Hedberg.

The brief argues that the lower court ruling violates the U.S. Supreme Court's 2003 decision on privacy. (story)

Would you please include in your original post the jurisdiction of the court? For example, is it a state court? If so, name the state. Or is it a federal court? And if it's a federal court, then please indicate within which federal circuit court it is. That is, of course, if this information is included in the online article from which you are gleaning information.

Here, in this instance, "365Gay.com Newscenter" is reporting that the case is in two state trial courts, each issuing opinions/orders, one in Virginia and one in Maryland, and an appeal by the gay father to a Maryland state appellate court (Maryland Court of Special Appeals).
