Only religions (Catholic) annul marriage so you can remarry in their church. But in the eyes of the law, you were still married.

that's what was squashed.
Gays have been able to have private marriage ceremonies with clergy for a long time.
The fight was over the legal status of gay marriage. The rights and benefits which are hard to cobble together under a patchwork of civil unions that vary from State to State.
