Nestlé Plans Push into Functional Foods, But FTC and FDA Are Cracking Down

Is POM a cautionary tale for Nestlé?

The Swiss food maker says it’s putting about $500 million towards research into functional foods and drinks over the next decade, creating two new units to “develop products that may prevent and treat chronic ailments such as diabetes, obesity and Alzheimer’s disease,” the WSJ reports.

That announcement, however, came the same day the FTC sued the makers of POM Wonderful (as in pomegranate) juice, saying the juice and branded supplements make “false and unsubstantiated claims” for the prevention and treatment of diseases such as prostate cancer. Both the FTC and FDA are stepping up efforts to crack down on marketing claims made by makers of functional foods and nutraceuticals.

(POM filed its own suit against the FTC earlier this month, saying that the agency’s new rules — which requiring companies involved in food ad settlements to get the FDA’s okay before making further health claims — violate free speech rights.)

1. Would POM be cracked down if we had a Republican president?
Would the FDA and FTC be doing their jobs?

2. There would be a crack down on POM under a GOP administration if they thought it cut into big Pharma
profit.

3. I remember when we boycotted Nestle for telling mothers in 3rd world countries
that Nestle formula was better than breast-feeding.
Now I avoid them because almost nothing they make is safe for my son (peanut allergy).

4. This is exactly what we need
the supplement industry is brimming with products making claims, vague enough to avoid previous regulatory authority, but descriptive enough for the audience to fill in the blanks. the simple fact is that, unlike "big pharma" which is required to demonstrate the efficacy of their "products" the supplement industry can simply hide behind fuzzy wording to skirt past such regulations.

mix that with the utterly non-existant education when it comes to critical thinking skills, and you've got a public that thinks that useless supplements are the go to source for health.
