Yep I think some of my hearts came from here, because this
is one forum I love to read and respond too.

Sometmes Valentines Day can be a hard day to get through...so thank you...you cannot know how much these hearts have meant to me.

I could use a few good vibes my way also. Mine and my neighbor's sewer backed up and the city said they were 100% responsible. (2 weeks ago)

I get a letter today from Travelers Ins. out of Texas refusing our claim totally AND the city told me to notify my home insurance. I will not. My neighbor says we probably don't have sewage backup.

The disaster team (sent out to us by the city) knocked out 3 walls...... tore up flooring and carpet in 3 rooms. I have a total DISASTER. I cried and cried tonight...but the city says they will give us some compensation.

I knew it was too good to be true, that the city said they would pay...What was I thinking???

All I want is to put my rec room, laundry room and garage back together.

Contact the city asap and file a claim pronto. It is quite common for the period to file claims with municipalities to be very short. Check and get it filed before the opportunity to file passes.

And, yes, file with your homeowner's insurance. If there is recourse to collect from the city they will pursue that on your behalf.

And, if you feel confused or intimidated or have questions then contact the consumer affairs division of your state insurance department. They can and will make inquiry on your behalf.

I used to work in the insurance industry. Among other duties I supervised property and casualty claims in a five state area. Some state regulators are very proactive on behalf of their residents. And any insurance company that receives an inquiry from s regulator will tend to give the matter special care and handling because they know it is likely to be reviewed.

3. Did the city admit "guilt" in writing?
I'm thinking I'd be calling a lawyer real soon--like YESTERDAY--if the city put it in writing that the sewer back up was their problem and then left you with a mess like you describe.

I understand that mold can be an issue, and that sewage presents a pretty serious health hazard, but I'd also think the city would be at least a bit worried about getting sued if they don't repair the house to living condition after the clean up. Were there several properties impacted by this sewer issue? Can you talk to other property owners and get a lawyer to represent you all?

I know from experience that government will sometimes move mountains if they think they will get sued and have it hit the media. It could be that all it would take would be a letter or phone call from a lawyer to get the city back to work and cleaning up the mess.

I'm so sorry you are dealing with this. Our basement family room floods sometimes (like a week ago when we had record rains!) and our lives are just in complete turmoil while that is happening. We know it can happen and plan for it--but it still is such a mess when it does. I can't EVEN imagine what it would be if it was a sewer back up.
